    Request for Evidence

    On January 10, 2011, we mailed a notice requesting additional evidence or information in this case N400 APPLICATION FOR NATURALIZATION. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    Guess this is for the biometric appt.

  2. Assuming that your wife has filed her tax returns in the last 3 years and that she doesn't have a felony to worry about, stayed long enough in the country. etc... I don't think it will be a problem to get it done before June or July. Every case of course is different and every office works different. Some offices have same day Oath Ceremonies. Most don't. You have to check this. Because of the same day oath I had in Newark, I could pick up my passport the next day in Philadelphia. This is not a general rule though.

    We've filed married/jointly for the past 3 years so no worries and neither of us have any problems. Gonna get the transcripts also. Her trips overseas have totalled less than 100 days since 2005 and I mailed off the plane ticket receipts too as proof. 6 years of marriage and a 5 year old kid should convince them. Thanks for the heads up. Unless someone else here knows about Los Angeles, I'll call them and find out if same day swearing in is available.

  3. We've been married since 2004 and our laziness is embarrasing. My wife's Kyrgyz passport expired back in 2007. She received an extension at the time and now that expires 12/31. The Kyrgyz embassy doesn't do jack by mail nowadays even though they processed the extension w/ payment by mail back in 2007. No one is being understanding and the guy on the phone insists that we fly cross country to file for a new passport. It makes no sense to visit DC just to apply for a passport in person so we got off our butts and filed for her US citizenship. My wife is trying to visit her country for her annual trip with our kid and sad to say we got complacent building a career,raising our daughter(5 yrs old) and her attending college. We neglected the N-400 since the greencard lasts so long. I'm hoping that we can get this all knocked out by late June/early July for summer break. It's really sad and weird that she'll have to get a visa for her own country. I see alot of folks getting same day oaths and receiving the passport the next day. For the passport, is that simply through expedited service or bringing the docs with you to the Immigration office? The packet was received on 12/23 so hopefully we can pull this off! Thanks for any help or suggestions. Good to see this place is going strong since that K1 back in '04.

  4. Indicating on a tax return that you're single when you're not could be considered tax fraud. Tax fraud would not be considered evidence of good moral character for an aspiring citizen. It would also leave you open to suspicions of immigration fraud.

    Bottom line... Don't give the USCIS any rope they can use to hang you with.

    Cool. We waited this long so no rush. She has her greencard and that doesn't expire anytime soon. I'll wait till next year after I receive my 2009 tax return and after her and our daughter visit grandparents. Thanks for the input.

  5. Wow, I have the exact same situation, however we've been married for 5 years in October and our daughter will be 4 in October. Will USCIS realy think it's fraud with these circumstances? The single status was filed under the 2006 tax year. I was wondering if I should go ahead and apply or just wait until after I file my 2009 return in order to send in the 2007, 2008 and 2009 transcripts.

    It's been years since I've been here, but this forum has always been good to me and I doubt we'd be where we are without the support here. We intend to file the N-400, but is there some type of citizenship/civics class my wife has to take? Does she have to do this prior to or following the submittal?

    In general, you must show that you can read, write, and speak basic English.

    You must also have a basic knowledge of U.S. history and government (also known as “civics”).

    You will be required to pass a test of English and a test of civics to prove your knowledge.

    Many schools and community organizations help people prepare for their citizenship tests.

  8. Sorry if I didn't give a reason for this post but, I'm in the middle of something. Is it possible for her to stay in the US if she want's to? He is her sponsor and is responsible to support her right? How can divorce proceedings go on if she's in Los Angeles and he's in New Orleans? If I end up footing the bill for her ticket home can I sue him to recover the expenses?

  9. Hello everybody. It's been a while since I've posted here, but this is the best place for advice. My wife has a friend from her same country who has married a guy and recently moved to the US. They were on a vacation trip to Las Vegas and her friend was mulling visiting for a few days to see our 4 month old daughter. I'm on campus now and get a call that here friend is on a bus on her way HERE because the hubby wants a divorce. (Here's a little background: Guy was an independent contractor, lost his job in her country, semi-alcoholic, maybe 15-20 years older than her, has money) It seems that he's always verbally abusive when he's drunk and he wants to ship her back home. Mind you I don't know these people but my wife's friend is my friend. I met her when I lived in her country (Kyrgyz Republic). Sorry if my thoughts are jumbled but after my last class, I gotta drive home and then downtown to pick her up at the bus station.
