    IF

    an I-130 was filed for the child.

    The USC would submit an I-130 petition.

    Is possible to ask for an expedite, and get it, on initial filing..

    Thanks for your response, but if my husband USC submit another I-130??? we have to wait the long time of tramit?? or Can my husband submit a form I-824, Application for Action on an Approved Application or Petition????

  2. I´m here again. i submit I-601 (overstay)on April 2010, i still waiting, but i have a question?..if my waiver is approved, i need to submit petition for our son 4 years?, thanks.. Note: he was born in my country and my husband cann´t come to here for registration abroad. My husband lives with my oldest son. My visa IR1 can derives to my baby (IR2)??? or i need apply for him?.

    eludy... another question for you that may be helpful for the rest of us (though unfortunately not so much for you).. what did she mean by your answers didn't match up? did someone tell a little fib? were there trick questions? what kinds of things were they asking y'all separately?

    hi phirephly , the consul told me about my personal life with him: example: where did you take dinner yesterday? do you have a pet? name? when your hubby gets divorce? i didn´t remember that date, what is his email? i know that! but i don´t understand whyyy she told me differents answers, my hubby was very sad with her because in my opinion she doesn´t believe us because my hubby is 56 years old and i´m 29 :(:angry::angry: what do you thing???

    I guess that would depend on how one interprets the comment. The Conof may have been told of that by the OP, she doesnt appear to hide the fact that she was aware she would need a waiver........ but because of descrepencies he found in their answers he denied the visa on those grounds. By saying no to the need for a 601 would be correct in this instance as until an appeal is successful and it is routed back to the Embassy, the option of a waiver wouldnt be there.

    thanks for your help with my case. do you think that after appeal i had to do a waiver I-601 for overstay? how long take all process??

  4. We were denied a visa in Peru in 2004. It took about 6 months for the case to get reopened. It would of taken another 8 months or so for it to go through the process. In the mean time, we were married in Peru, filed the K3, had it approved and now my wife is here in the states. Once your petition is denied and sent back to the states, the porcess becomes very drawn out.

    Hi STEVE thanks so much for your help but i need to know more information about your case. My visa denied is CR1 , is different?? than K3 ... what my hubby had to do? wait a letter?? from NVC right? explain for me please. :thumbs:

  5. The petition will be returned to the consulate and a Motion of Intent to Deny will be issued by the Service Center . Can you explain to me that? please, sorry but i don´t know nothing about that :( Your husband need to retain legal counsel now to get this resolved and put together the best appeal to the Service Center.

    The consul told me that my case will sent to DHS and they will sent to my husband a letter and then he cans appeal so how long will take this process?? i never heard about that?? why they never told me about a waiver for overstay in USA? will I need?? Anyone like me situation????

  6. hi my friends, i´m so sadddddd :( because my visa was denied in Feb.08 my hubby was with me but I'm confused, let me explain to you.

    First window = questions about me and my husband aprox. 25 minutes,Woman told me that I need some aditional papers.

    Second window= take a fingerprints only one finger

    Third Consul room= She asks separately my hubby and me all questions about my married, My hubby and me answered our true story, but finaly SHE told me (""I can´t to give a visa because you answered different than him)" she told me YOUR CASE will send to back DHS and your hubby had to appeal.

    I´m feel badd help me please ...what will happen? anyone visa denied?? hereee??? what i have to do???

    PD: I was overstay in USA 4 years and the consul never told me about that only DIFFERENTS ANSWERS, NOT NEED WAIVER 601. why???? :(:(
