  1. Today I was granted my Permanent Residency in Kansas City. The interview was so easy. I had everything they needed which was mainly 'proof of ongoing relationship'. The officer said I would be receiving my GREEN CARD in the mail in 2 weeks!!! Can't wait to travel and see me family! There were some complications with my work permit and he doesn't know what went wrong but said he will make it his priority to make sure that everything is worked out today. That too will be mailed to me in two weeks. It has been a journey never to forget and best of luck to all. Next.....naturalization..............in 2 years and 6 months. Oh, and of course, renewal. Right now,................Time to celebrate!!!!!!

  2. My wife is 2.5 months pregnant and she is working 50 hrs a week as a restaurant manager. I HATE the fact that she is on her feet about 10 hrs a day. It's just not good for her. I am still waiting for my EAD, since I had my Biometrics on June 28th (6 weeks). I realize it takes about 3 months to receive it, but does anyone know if it is possible to quicken the process by writing a letter to the USCIS explaining my situation? I really need to work for a fairly valid reason. I also understand that it wouldn't necessarily be fair for everyone else waiting for the same thing but I feel horrible about the situation. Don't get me wrong, I'm ecstatic about the pregnancy and I can't wait to start a family with my wife. Please, if anyone knows if there's something I can do, let me know. Thank you.

  3. On June 28th I had my biometrics appointment in St. Louis. It is now July 24th. On average, how long does it take to receive it in the mail? I got a job at Federal Protection Inc and cannot start working until I have the permit. They are already starting to get impatient with me, sending me emails, letters and phone calls wanting to know the status. I keep telling them it's out of my control.

    I JUST got off the phone with a USCIS rep. and she said the they received my EAD application on June 5th. She said that was all the information they had. How annoying is that?!?!?!??! How can I find out whether or not I will receive my work permit any time soon?

  4. I recently got married and filed for the AOS. My wife's dad is a joint sponsor along with her. One of the requirements for the AOS is your income tax return forms and W2s for the most recent tax year. Her dad was granted an extension for his 2005 taxes and has not yet filed them. If he submits his 2004 income tax returns and W2 along with his document from the gov't granting him the extension will that be alright or are we going to have to wait until he files his 2005 taxes?

  5. I went to the DMV today to get a Driver's License and they said that they are unable to issue me one due to the fact the my I-94 expires in three days (June 15th, 2006). They called the Missouri Department of Revenue and they said the same thing. I received both my NOA's for my AOS and my EAD. Do I have to wait for the next step of my AOS process? What should I go upon doing inorder to be able to receive a license?

    I'm in the process of putting together my AOS package. I have two quick questions. The first is where do I find my Non-Immigrant Visa Number (I-485)? And lastly, do I still need a sponsor AND co-sponsor for the I-864, Affadavit of Support? My fiancee's Step Father-in-Law was my sponsor and my fiancee was my CO-sponsor, in the origianl K1 fiance visa process. Does my fiance need to fill a form out or JUST her step father, the original Sponsor?

    For AOS, a *spouse* must file I-864. Does your spouse/soon to be make 125% of the poverty guideline? I'm guessing no.

    Reading the instruction for the I-864 and its FAQs, you'll see that the law allows for a Joint Sponsor's I-864 when the Sponsor doesn't earn enough.

  8. Thank you for your response. I drove through the Detroit, MI entrance and I DO have a stamp on my I-94 which says "EMPLOYMENT AUTHORIZED". They also told me that if I get married and adjust my status within 90 days that I do not have to apply for an EAD. She also clearly stated and I repeated back to her that it IS OK for me to travel anywhere I wish. I even joked atound and said, "so I can go to china and BACK?" She said yes. I was very surprised.

    I think you may have gotten some bad information. If you did not enter through JFK airport, you probably did not get an EAD stamp in your passport. You require either the temporary work authorization stamp in your passport, or else you will have to wait until you apply for the EAD with form I-765, along with your AOS application (form I-485).

    And you will not be able to travel outside of the U.S. without first applying for, and being approved for, AP (which is form I-131). If you do leave the U.S. without AP, you will be denied entry back into the US and have to apply for a spousal visa, which would be starting all over again at the beginning.

    You should read the Guides here on VJ on AOS. You will get all the necessary information there on what you need to do after you are married.

  9. Hello all. I have a few questions. I just entered the US on my K1 and I'm wondering what step I should take next. The Customs Border Patrol Officer said everything so fast that I can barely make any sense of it. She did tell me that I have "Employment Authorization" and the I CAN travel outside the US whenever I want. She also mentionned something about having another interview for the AOS. Do I have to make an appointment or is it a walk in process. I really don't even know what I'm trying to say, all I know is that I need :help: . PLEEEEEEASE!

  10. Just wanted everyone to know that after being temporarily denied my visa, the prolonged process has been cleared by the FBI. I had not one, not two, not three, but FIVE misdemeanor offences while I was attending University. Oh the good times! :dance::P Definitely not proud of them though! :P Anyways, we called yesterday and the consulate said they received the fingerprints back from the FBI and everything was good to go and the visa is in the mail and will be here sometime today! Thanks for everyones help throughout this process. Good luck to those still in the process.

  11. You can apply for AP (Advanced Parole) but only once you are married alongside your AOS & EAD applications. Until that time, although you won't be stopped leaving the US, you will be stopped on re-entry. This will normally mean that you'll need to re-apply, either for another k-1 or for a spousal visa.

    Basically without AP you won't be able to travel outside the US without experiencing almost garunteed problems when you try and get back in.

  12. Hello everyone. Thought I'd update you on my visa experience. I had my interview in Montreal on Valentines Day, the day of love, but that didn't matter to the consulate. I was TEMPORARILY denied for a couple reasons. So for those who are getting nervous about an upcoming interview, don't be, because if you're not in my shoes and won't experience what I'm about to tell you, everything should be 110% fine.

    I showed up for my interview at 8am. Walked straight in. Went through security. Make sure you don't have a bottle opener on your key chain :no: . Waited in a room until the elevator was opened. Once I got into the elevator, the unthinkable happened. I notice a woman infornt of had a large yellow envelope in her hands and that's where it hit me. I was so nervous before leaving that I actually forgot my medical. I couldn't believe it! I We went to a large room upstairs and waited for the notorious window #14 to open. Once it did, I let a couple people go ahead of me. Once I decided to go up, I paid my $100 and was give the number 4. My fiancee and I waited about 15 minutes which seemed like an eternity. Finally my number was called for me to go to a back room which had several booths with a glass window separating me from the consular officer. Of course, the first thing she asked for was my medical. I just about dropped to my knees and and broke down. But I contained my self-control and proceeded. She asked for my affadavits (I had a co-sponsor and a sponsor). Then she asked for the DS-156 and DS-156k and I signed them. Then she told me to take a seat and that my number will be called again shortly. After another grueling 15 minutes my number was called. I went back to the same booth and the officer told me that the FBI did a background check and found some problems. She asked me if I had been arrested or convicted and of course I told her the truth. Before I went to the interview, I typed out a description of each incident that occured to me in the past. She was very appreciative that I did this. I'll tell you this, whatever helps them by making things more clear and easier to deal with makes the process much smoother. So she was very thankful that I wrote that up for her. Then she told me that I will NOT be receiving my visa today because ANOTHER check had to be done due to the fact that I had "MULTIPLE INFRACTIONS". I was taken to another room so they could take my fingerprints which cost me $85!!! Not cool!!! I was broke after that. Then they told me that the prints will be sent to the FBI and they will compare them to prints that I have taken in the past. They just want to make sure that I was the same person who had prints taken at the time of my incidents to the prints that were taken at the interview. Now, if the FBI approves, the all I have to do is send in my MEDICAL, PASSPOSRT (so they can staple the visa to it), and a LONG FORM OF MY BIRTH CERTIFICATE (I only had my short form, which is the card). The officer told me that technically it didn't matter that I forgot my medical. Still a downer though :crying: . That process could take another 2-3 weeks. If I'm NOT approved by the FBI because of the multiple infractions, I would have to apply for a waiver through the Department of Homeland Security, which could take up to 1-2 more months.

    Other than that, the interview wasn't bad at all. For everyone out there that have a clean record, have all the correct papers and don't forget anything extremely important, there will be no problems at your interview.

    Last thing, MAKE SURE YOU HAVE THE LOOOOOOOOOOOONG FORM OR YOUR BIRTH CERTIFICATE! I was never informed that I needed this.

  13. Hello VJ Family. Just wanted to let everyone know that I pick my fiancee up from the airport on Saturday the 11th and we leave together for Montreal on Sunday. Ironically, our interview date fell on Valentines (L) day which will hopefully help out the situation. I'm pretty sure that they'll consider it as just another day. :unsure: I'm going into the interview with a criminal record under my belt from when I attended University in the USA. My record in Canada is clean as a whistle! Hopefully this won't affect things to drastically.

    One quick question before I sign off. What photo do I attach to the DS-156 in the bottom right corner? Thanks again for everyone's help throughout this gruelling process. I'll be sure to keep you up-to-date. Can't wait to see my babe! :dance:
