  1. My husband got a very good international job offer that would require him to live overseas in Europe it is a 3-4 year post with the possibility of extending past that.

How does it work for me in terms of loosing my rights to come back to the US if I go with him etc?

We are married and got married in the US.

    I entered on a K1 visa

I have a social security # and m now just waiting for my green card which hasn't come after 180 days.

I heard about something like reentry permit or something like that were I can't work and if I do I will loose my green card.

I don't want to loose my green card is the only way for this to happen is for us to stay in the US until I become a citizen.

What would happen if I loose the card and move with him, would I have to do the same thing all over again? Or would I never be able to live in the US again and only apply for tourist visa?

Thanks in advance for your help.

  2. Hello,

My wife and I are married, in the US, and she is currently waiting for the i485 adjustment of status.

We also filed the I131 application for travel

We expedited the document with a hand written letter and evidence explaining why it was urgent.

I also called them to expedite it under Immediate Urgent Action however I got an email that said:

The status of this service request is:

Due to the high volume of expedite requests for this case type, we are strictly enforcing the criteria that has been set for these expedite requests. While your situation appears serious, you have not provided evidence of an extreme emergent need.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.

I have not gotten anything in the mail if the case is declined or approved we are supposed to travel on May 13th - May 20th as noted in the application for Travel.

The application was received and processed on April 4th, 2012.

My question is, is there even a remote chance that my wife will be able to accompany me to visit my grandmother overseas for the 7 day trip? Or will she not be able to see my Grandmother before she passes? (With whom she has not yet been able to meet due to waiting for our K1 visa) This is a very upsetting situation.

Any help or suggestions would be more than welcome.

We are currently getting a detailed doctors note to see if they may rethink expediting the case even faster.

We do have her biometrics appointment set for May 1st 2012; however I would assume that is only for the i485 and of course if the i131 gets approved.

Thanks in advance for any suggestions

  3. Hello Everyone,

I am finishing up the final papers before we have our interview :)

I wanted to know if it is just me (the sponsor) USC and my fiance (Poland)

If I need the i864 or the i134?

    If I need the i134

    I have some questions:

1). For Personal Property I have a lot of cameras and computer equipment as I run my own company and we have a lot of professional grade applications and support most of which is owned by me personally for personal work as well. Can I list this as personal property with the values?

2). For question #8 about dependents, would my fiance be considered a dependent as she cannot work to she gets the visa and is approved with a working visa/status in the US? Or is this solely if I have children or other family members who depend on me?

3). For question 9 do I need to put anything in for previously submitting forms of support?

4). For question 10 I would need to list when I filed the original petition for my fiance right?

    Thank you!

  4. Hello Everyone,

My fiance and I are working on her checklist:

    http://photos.state.gov/libraries/poland/275705/cons_iv/IV-F04%20Instructions%20for%20applicants_rev_%20Dec%202_%202011.pdf

    We have some questions:

    For Question 3:

My Fiance has never been married or divorced before does she still check it off or leave it blank?

For Question: 5: She has never been committed of a crime or gone to court etc as stated in her police records would we also still check question 5 off or leave it blank?

    Last but not least:

    For Question 7:

She currently has a part/full time job but she wouldn't be able to do that when in the US to she gets her social security number and authorization to work. That being said I am going to support her and I have already filled out the I864 does she also need to do one of these forms. Or if she brings evidence of my support (pay stubs, taxes, and the I864 that I am filling out is that sufficient?).

Again all in all would we simply check off the boxes even if that information does not pertain to us, we don't want the embassy to think we forgot to get the required information.

Thanks in advance for your help?

  5. Hello Everyone,

I have some questions regarding the timeline from when we got approved (NOA2 and when we will get the checklist etc).

Right now all of our stuff is in Warsaw we called to switch places from FrankFurt to Warsaw. They now have our documents and we are waiting for them to send them to us how much time will it take before we get the checklist of the documents that we need to send into Warsaw.

Once we get everything back from Warsaw, how long do we have before we have to send back the documents to Warsaw.

Also once and if we are approved for the Visa. How long do we have from being approved to having to move to the US. Is it 90 days from approval or is it open and the 90 days applies only to the moment you step into the US. Meaning to be married.

  6. Any joint sponsor must meet the income requirement for their household plus the intending immigrant(s).

See the form I-864 and the form instructions for what is required. This FAQ page may also be helpful >>> http://travel.state..../info_3183.html

The I-864 standards will apply to your I-134 affidavit of support submitted in support of a K visa petition.

So to make sure I understand this:

My family would fill out an I-864 forum and I would do the I-134 or would they also need to do an I-134 on top of doing an I-864?

    Thank you!

They are interested in your PERSONAL income, not business income. If you file a schedule C that needs to be included with the copy of your 1040 as well as any 1099s. They will consider the income claimed on line 22 of the 1040.

Ok, like I said I make 1-2K a week and have evidence of this, however I do not have 24,000 hanging around in my bank account for disposal on a rainy day. :)

Will this be an issue? This is why I am thinking of a co-sponsor (my family).

  7. We just got approved NOA2. As we are moving forward with everything I had a question regarding the Affidavit of support:

I am an independent contractor working on www.oDesk.com for large IT companies what can I do to prove my income of roughly $1K a week? I can print out my contract from oDesk with Google and my past earnings. However I don''t keep all of this money in the bank as I pay rent, food, and other bills so I don't have a high balance in a savings account? I also have my own business which is registered in the US however we are new and are operating near a profit/loss but have a lot of revenue a year close to $200K all of which I can prove if needed again not a lot in the bank as it is being invested to expand the company. Recommendations? Also my family who we will be living with initially has offered to co-sponsor what would they need to write up or send to back us up as a co-sponsor for my fiance?

Thank you in advance all of you have been very helpful so far!

  8. I have a question I have been like everyone here constantly checking the status between Visa Journey, Igors List/Berkley List and USCIS.

Our case still says Initial review on USCIS website all of the EAC###### after and before us have moved on, does this mean there could be something wrong with our case?

Every time I call USCIS no one gives me any information instead they respond as if I am asking them for their social security number and bank account numbers. (Never a pleasant call)

Any insight would be greatly appreciated.

  9. When I applied for it as I live in New Hampshire normally they told me to send it to the VSC not Texas I called to verify this. As for the fees there was one fee on the website which is what I sent in a check they said it was too much however all the documents had been marked as received they just needed me to resend a check for the correct amount.

I was under the impression that once it is approved the next step would be for the documents to go to my fiance overseas as then she has to take the necessary steps over there (medical exams etc no?)

Will the NOA2 come to my home in the US or her location in Germany. I am actually with her in Germany now.

So the question is also will it be 5 months from July 6th? Or 5 months from July 22nd which would really suck as I would take it that the offices will be shut down for 2-4 weeks during the Christmas holidays if they don't move slow enough already :)

  10. Hello Everyone,

My fiance and I sent everything in to the VSC on July 6th then it was sent back as they changed the fees so we had to send in a new check.

This was sent in and noted as received by the VSC as of July 22nd

My question is has anyone else submitted around the same time (July 22nd to the VSC if so have you heard anything in regards to your NOA2?

The other reason I am asking is our lease is up on our flat in Germany in 1.5 months and I need to know if we should change the address on on our application to my fiances home in Poland.

Thanks in advance for your help.

  11. I have another question. so all this story about my sister is true but i didnt mention that she is only my half sister ( the same mothers) but she has a last name from my dad. What if I would take some birth certificate of her or something if I say I have no family members in us, to prove i am saying true?
