  1. The validity of the K-1 visa is six months from issue or the expiration date of the medical, whichever is sooner.

    The foreign fiance can obtain a Social Security Number within a few days of arrival. That does not authorize work, however. K-1s need an Employment Authorization Document (EAD). It's possible (but pointless) to obtain one before the wedding. Realistically, the foreign fiance won't be able to work until you've married and filed for adjustment of status with a concurrent EAD application. The EAD often arrives about a month before the GC, so figure 2-3 months after the AOS filing before he can work.

    Stocks are assets, not income. To make up any deficit between your income and the poverty guidelines, you need three times the amount in assets.

    From the time you file for adjustment of status (after you marry), 3-4 months is typical.

    Thank you for your detailed reply. Regarding stocks, can you explain further? Do you mean if I can prove three times above the poverty line in stocks it would be sufficient? I am wondering if I can prove this for my income verification instead of employment?

  2. Hello, I have some questions if anyone can help.

    1. If the process is approved and the foreign fiance recieves the visa how long or what is the time period from which they get the visa to when they come to the united states?

    2. Regarding employment vertification of the foriegn spouse how long does it take so he can start working?

    3. Regarding petitioner income do stocks count as income or must you be employed if there is no co sponser?

    4. How long does it take to recieve the green card?

  3. Him being shady or sneaky and you catching him texting another women is a bad sign. First off, who is this women a friend someone he met randomly. Call her and find out.. is what I would do. Try to get down to business and find out everything so you dont waste anytime. This immigration process is a true nightmare in the begining which I am dealing with too. I guess only the strongest of relationships and true love will survive and go on. To me a soulmate is one who will be there no matter what. If a person is not meant to be with you or love you it will come through and it is important not to hang on if you really really know something is not right. The purpose of our life is to try to obtain hapiness and PEACE right?

  4. Hello all. I am new to all of this and am feeling pretty down. I have not filed yet for theK1 but, will soon.

    I have a question. Does anyone know a good calling card or phone plans that are at a good rate?

    I have been using my cellphone and am really upset how high the bills are.

    I feel like the process is draining me physically,financially and emotionally.

    I need advice what service of phone cards work?

    On average how long does it take to approve or not if I am petitioning someone from the middle east to comes to the US?

    I am also concerned financially since, I am still looking for employment!

    If this visa works and he gets to the US, how soon can he work here?

    I am so bummed out and am wondering if this is the best thing for me.

  5. time's do vary, and yes, it can be sooner, but prepare to wait at least 5 months. after there is also a waiting period for interview and medical etc, so from start to actually physical move to US could be more like 9 months on average. If you spend some time looking at everyone's timelines, you'll see that they vary. Also, a helpful forum is your country's forum (or your fiance's country) because you can chat with people there about embassy processing times etc. You should be able to get all the help you need here.   6. Welcome to VJ. We're here to help you before, during and after your fiance's visa, but you also have to do your part by reading the guides posted here on VJ.

    1) You are NOT submitting the K-1 visa, you are submitting the I-129F PETITION to USCIS for approval. Once you receive that your fiance will interview for the K-1 visa at the Embassy in the country they live. The I-129F petition takes 3-6+ months for approval, then you have the embassy interview wait whih varies by Embassy. Some are only a few weeks, others are months out for appointments.

    2) Once you are approved for what? The I-129F petition? Your fiance's K-1? You gotta be a bit more specific please.

    3) The USC does not take the physical - your beneficiary does at doctors approved by the Embassy before the interview. Medical costs vary depending on the country from $200-$300+. It can be more if your fiance needs vaccinations and they are performed by the panel physician.

    Actually, I need to quit here. I am not trying to insult you in any manner but this is YOUR petition, not ours. It is apparent that you haven't even tried to learn anything about this process by either researching the USCIS.gov website or simply by reading the various guides and/or searching the 1,000's of posts in this very forum. I know the process can be confusing and daunting but not so much if you take the time do your basic research here.

    I hope you will heed my words and learn about this. It is not difficult if you put some time and effort into the process. Then if you have questions AFTER reading through VJ we're here to help...

  7. 1. Depends. Wait time was 3 months, then it was 5 months, then it was quicker again...

    2. Once the petition is approved then the file is sent to his countries consulate for him to submit paperwork to apply for the visa.

    3. No.

    4. Depends on the country. Provide country and you can get more specific answers. For example, Australia is quick. You'd be looking at around 3 months or less from NOA2 to interview, many other countries are slower.

    5. He must apply for his adjustment of status (AOS). He must marry you in the 90 days to AOS based on the K1. It costs $1070 at the moment, will probably go up again before he gets his visa. That process is more paperwork, possibly another interview and then 2 years later removal of conditions (ROC). Yet more money and paperwork.

    6. No. He has ZERO credit history. I got a capital one credit card to start building my credit history. I paid $50 or thereabouts for a $200 limit. Secured card was all someone like me, with no history, could get. Health insurance I get through my husbands work, so no idea there.

    7. They want proof of funds from you at the interview stage of the K1. (so not until he gets the paperwork in his home country). The form is I-134 (though again depending on country you could need the I-864). For a household size of 2 (assuming no kids and just you and him) you need an annual income of $18,387. Again, could change slightly by the time you apply.

    **Note: Fee wise you have the 340 fee for the K1 petition, the cost of the medical, cost of shots (if required for his country, mine was $400 for the medical + shots), police check (mine was $120) and the visa application fee of USD$350 (converted to whatever currency of his home country at the exchange rate at the time of interview).

  8. Hello all. I have some questions regarding the K1visa application process.

    1. Once I submit the K1visa how long until I know it will be approved? I am asking a time period?

    2. Once approved what is the next step?

    3. I am the american us citizen do i get the medical exam too and what are the costs?

    4. usually how long does the process take for my fiance living overseas to recieve his interview and visa?

    Does he take all the documents I submitted to the interview?

    Also, do I do the interview or is it only for the foreign fiance?

    5. Once my fiance gets to america and we get married how does he apply for the green card and how long does it take?

    Since we have 3 months to get married and he applies for his green card during this point.

    6. Regarding financial things since he is new to the country will banks give out loans, what are options for health insurance if anyone with experience knows.

    7. Do they ask for proof of funds money for myself and fiance? What does this mean and what do they ask for?

    I am going to submit everything next week.

  9. Its been awile since filing the 129-F but this post is non-sense. What you are asking here is Covered in the 325-A Forms signed in ink and dated by the Petitioner/Beneficiary separately with your Petition. Nothing is required to be Notorized for the 129-F. The 325-A asked these questions. Be sure and include your "Letters of Intent" stating you are free to Marry signed in Ink and dated. (no copies/scaned, etc.) USCIS will do their own background check based on the Information supplied including a Birth Cert for each party. (Petitioner/Beneficiary)

    If both parties have No Criminal Convictions they need not list them on the 325-A Form for each party.

    does the letter of intent have to be notorized? i am the petitioner BTW... and new to this process. Thanks

    My Husband and I dont have children together yet. I do have a daughter, who he helps to father though. As of now we don't have many problems with religion, he does his thing, and I do mine, and my daughter follows my religion...and we do all holidays together. We have talked about how we are going to raise our future children when we have them. We talked aboutthis before we got married, and after, and still now. We know that we are going to try to teach our children both religions, and once they are older let them choose for themselves. I know that this will be our greatest challenge in our relationship, and with our future children... but it is something we will have to work thru, and make comprimises about. Hopefully we can teach them to see the good in both religions, and teach them to be open to learning, and choosing for themselves. I think thats the best we can do, and i think thats all we can do when it comes to our children.... do the best we can, and pray they will make they right choices for themselves. Sometimes I wonder if I had been given an option in religion, or was educated on all religions if I would have choosen something different for myself. Since I was only taught one religion my whole life, it is ingrained in me now and has always made perfect sense...but if I had knowlege, and the option of another choice... would I have chosen the same? Anyway, Im not sure if having two religions will be a gift, or not. Time will tell, but I am sure we will have some bumps in the road. Both religions have so much good in them, so at least we are sure we can teach them good morals, and values.

  11. I assume YOU are the beneficiary (non USC). Depending on what country you are from will indicate where you need to obtain a certificate of being single.

    As far as police records, you must obtain official records from anyplace that you lived since the age of 16.

    IF you are the petitioner (USC), then YOU don't need to obtain these records (other than divorce records if applicable).

    In either event, you really should do some studying about this process before you begin. Start by reading the K-1 guide posted on this site.

    Yes, I am new to this and will send the file this week after getting all the documents. I have read through and understand most of it just the specifics now.TY :whistle:

  12. Hello, can someone tell me where to get a document proving I am single? I have never been married or divorced and am applying for the K1 visa this week? Is this something I write and get notorized I am confused?

    Also, what do they mean by submitting police reports after the age of 16 years old?

    I have a clean record/past just wondering what they mean,

    Hello, again. I know this is not directly related to the K1 process. However, I have a question to those married to someone who is not their own religion and plan or have children. Is this a challenge to have children if you are another religion.

    This is somewhat of a concern for me. I only want a good life with as little issues/problems as possible. Any advice, suggestions would be helpful/interesting.

    Please reposnd only if you are in that current situation.

    I think that many of us who are married to a muslim, but not muslim ourselves have not had problems about this in geting our visa's. However they will most likley ask your fiance about this at the interview... I know they asked mine, they also did an interview with me over the phone and asked me about this as well (they asked me about alot more then this, too) Here are some of the things that we were asked regarding religion

    -They asked what's my religion?

    -What's Hamza religion?

    -Will you ever convert ?

    -Does he talk about converting ?

    -Do I want kids?

    -How many ?

    -What will their religion be ?

    -What do hamza parents think about this?

    -What do my parents think about this ?

    -Do you think hamza parents are very conservative?

    They also asked explained how a person can have a religious ceremony, without being legally married.

    -Then he asked if I experienced anything like this (no, i didn't)

    B/C religion is such a big factor over in MENA countries (Im assuming your SO is from MENA) this plays a big role in relationships, and so the CO is trying to discover any inconsistencies with the cultural norm. Anyway, everything ended well :) Im sure it will for you too!

Hello does anyone has any experience about filing for a fiance visa and your fiance is a different religion?We recently met and want to get married in the US after he arrives here. we are two different religions he is muslim and I am not. I am a US citizen.We are similar in age and love eachother. Does this make any difference being different religion? I hope not. Any feedback or advice would be nice those with experience only please.

  16. You must be a legal resident in Israel for 6 months before you can file for DCF. DCF is not available for K1, only a spouse visa petition.

    Thank you for the response. I know this is a personal question however; does it make sense to try to get the fiance visa for my fiance who lives in Israel

    rather traveling there to get married?

    Are the fiance visas easy to get and is it true it takes about 5 months for everything so he can get his green card?

    Do you suggest I talk to a lawyer or service which can help me or do it alone?

    I am so new to this and a bit confused.

  17. Hello, how long does it usually take to get the fiance visa? Can someone please give me an average timeline?

    I want to file for the dcf in israel but, do not know if i am allowed to do so. I am currently not living in Israel although I was there this summer for 2 months.

    How will I be qualified for a dcf

    My fiance lives in israel and i am a us citizen.

    also. Is it recommended that i marry over in israel and come back to the us or apply for a fiance visa here in the us?

    I have heard people say it takes less time to apply for the fiance visa?

    Please reply with advice those with experience.

  18. Hello, all I have some questions about the dcf. I am a us citizen. Do i need to be living in israel for over 6 months to file for the dcf?

    my fiance is living in israel now and i need help? i need to know if i am qualified to do this?

    if not how long does the fiance visa take? is it always approved?

    i would like to make the process and fast and painfree as possible. please message me with any feedback answers or advice from someone

    with past experience.
