Based on the previous circumstances, http://www.visajourney.com/forums/topic/380167-please-i-need-some-advice/page__p__5562350#entry5562350, does the OP or husband need to be concerned about a possible ban/deportion due to circumstances (marriage) appearing as for immigration purposes? I am not saying they married just so he can remain here, I am just asking based on the whole situation.

On this note,
What if the benificiary doesn't have a "mailing address" or a post box to receive mail? I don't remember putting either his or my email on our I129F (I forgot to send in the notification form, so i just received a hard copy of NOA2 and could check it online). I did however put his phone number on one. Any ideas about this?
Also, is there a fee the benificiary has to pay in excess of medical or interview fees? Does anyone have updated information pertaining to this?
And last, does the beneficiary have to have a sort of "criminal record" from each city they have lived in for x number of years? I read this somewhere but don't know if it includes Cameroon.
Hoping somebody who has recently gone through this can help....
I dont know as much about the K-1 process,however, I am sure the criminal record part is the same all across the board. I have attached the information regarding that. Hope this helps and someone else can be of more assistance regarding your other questions.

I am a little bit panicking right now. I will explain my situation.
We started our immigration process for a CR1 visa back in August 2011. By mid-December 2011 we got approved by NVC and my interview was scheduled for January 18th 2012.
Unfortunately, I have been obligated to reschedule due to personal circumstances. I rescheduled for September 19th 2012. Right now I am preparing myself for my
interview and I just realized something...
When I submitted my DS-230 I did send an original Police certificate (Canadian), which is dated from September 29th 2011. I have no clue when those certificates expires,
but it will soon be a year. And now I am worried that they will ask for a police certificate at the interview (I have a copy of it, but obviously the original was sent to
NVC).
So can someone please
me... Are they going to ask for an updated police certificate at the time of interview? I am sooo worried right now
Also if you guys have any tips for my interview in Montreal... I will gladly take some!!

Hello everyone
let me start by thanking everyone here who has helped me through this process, which at times can be very long and drawn out. this site literally saved me with all the information and advice. so THANK YOU to everyone i and my wife sincerly appreciate it. on to my question, i read alot about when you line up at the bogota embassy they give you a checklist. you need to put your documents in order etc. well, i have sent the NVC all my original documents, so i am not sure aside from the medical what other documents they are wanting me to bring. of course i do have complete copies of both my wifes and my stepsons cases, which i am taking with me when i leave tonight. and those contain copies of the civil documents, but does anyone know what the document list looks like for a CR1 visa applicant?>? as with others who are going through this i am feeling a mixture of stress, happiness, and anxiety. havent been together with my wife for 8 months, of course we skype all the time and text back and forth, there isnt a day that goes by where we dont share a morning wake up call or a goodnight call. so additionally do i need to make copies of the text and skype call logs and take them too?
or can i feel confident that it all will be in the case file i submitted. i leave in 8 hrs so i hope someone can help me out with this as soon as possible. many thanks again and best of luck to everyone, i will keep you posted on what happens at the medical and the interview. I'm not sure how it works for your country, but how long was your police reports valid for? If they have expired by the date of interview. Please obtain new valid ones before you take off. Just wanted to give you a heads up on that since I am going through that right now. By the time my husband interviews, his police clearance reports required by the embassy will no longer be valid. Please check into this before you leave. As the other poster said, you dont want to be denied for lack of evidence or documents. Good Luck and God Bless you on this journey and your travels.

The soonest an LPR can file to remove conditions on residency is 90 days prior to the expiration of the green card. The application still has to be processed and like all other things involved with US immigration, there is some wait time.

Thank you. I was confused, thinking that the removal had to be completed 90 days after receiving the permanent green card.

She will receive a conditional 2-year green card in the mail, within a month from her POE. She can file for removal of conditions 90 days before it expires, and she will receive a 10-year green card then.
Wait......you can remove conditons on a 2 year conditional green card in 90 days and NOT after 2 years?
I thought there had to be that wait time of 2 YEARS. Wow! Where would I be without VisaJourney?

no, i didn't get visa issued...infact i had interview for the visa approval....I'll tell u what happened....i married an american citizen. she processed my papers for CR - 1. as soon as all the documentation was complete and interview fee was paid, i got call for interview. Wehn i went for interview, they said that i'll have to wait for 6 weeks for AP(administrative processing) and during that time, my wife cancelled everything, saying that we are getting separated...
How are you certain she cancelled everything since you guys were on administrative processing? Did you receive notification that your visa application was no longer pending? Verify that she took the complete steps to "cancel" the process before you guys start all the way back over. Not exactly sure but maybe your case can be re-evaluated since you were under further processing (administrative processing)anyway. How long ago was this? Has the 6 week timeframe already passed?

I'm sorry, but I am confused.......were you issued a visa after your interview? Were you approved for the visa?

How long ago did she "cancel" the application......if you guys never received the NOA2 (approval) for the petition, then you may have to start over, as in filing everything all over again. Familiarize yourself with this guide, if that is the case http://www.visajourney.com/content/i130guide1
Give a little more detail in your situation and more people will be able to weigh in on what takes place after a cancellation.

yes i agreed because on the second home visit by the consulate officer. she was old that she was to go to the us just to make her life situation better. at first she was being told that she is my cousin.
OP, what's the status update of your case? Did you contact your Senator? Or request a 2nd interview? Plese let us know how this worked out! I pray you were able to get some more clear answers or schedule another interview before they sent your case back to USCIS.

Really? I didnt know copies of the birth certificate could be sent to NVC. I thought it had to be original form. So all will be fine if I submit the original & then request it back at the interview?

Anyone out there that can shade some light on this issue for me (maybe its a none issue). Okay i am a very Experience QA Analyst for over 10 years. In July 2008 I resigned from my job of over 13 years to be closer to my daughter and grandkids. My daughter just had twins and already had two toddlers. So I had planned to take some time away from work and be a stay at home grandma caregiver. Than as you know the economy about fall 2008 went south also with my 401K I was planning on living on for a spell. Anyway this is my work history.
1. 2008 worked 7 months made $32,584
2. 2009 worked 7 weeks and also collected unemployment made $19,330
3. 2010 worked 7 months (2 jobs) made $38,570
4. 2011 was living with husband in Nigeria half the year didn't work. collected unemployment collected $4150
Now the bright spot is i have been job offered and I start my new job July 9th. Lets just say I about 3 times the poverty level. As you can see I have the ability to work and get good paying jobs so does anyone see an issue with 2011. And with my new employment well being so new and it is a contracting job that;s renewable after 6 months. A co-sponsor is not an option.
So what you think? A letter of explanation for why no work in 2011. Will they be concerned with me not having worked a solid year since 2007. I do have my 2008 tax transcript I ordered because I did want to show them I do and can make good money. Thanks for reading.
Did you file your taxes for 2011? I believe they are mainly concerned about the aspect of filing and reporting income for the following years, not necessarily if you are capable of having solid income potential. I think a letter explaining the employment situation (for 2011) and living abroad would be sufficient enough, along with a 2011 tax transcript. HOWEVER, still submit copies of your current employment pay stubs once they are obtained and obtain an employment verification letter from the employer.

The DS-230 form asks for residence over 6 months & although you didnt live 12 months consecutively, I would still supply the police certificate. You will have to provide the information that you have lived at another residence so include the police certificates for it so there will not be any more delays.

Transcrips but they where faxed through the IRS
Maybe the fax didnt go through completely..........????? If you have the original transcripts also, can you just mail the originals?

Well, we both want to finish school. So it wasn't a complete lie that he wanted to be a student. But, the main reason was for him to be close to me. Would this be an issue? I just hope and pray that noone asks. Thanks everyone! Good luck to all!
No matter whats asked of you two, just be honest. I know you would much rather a "delay" in your spouse's arrival than an actual ban from the US. Please take everyone's advice here seriously about honesty......its really the BEST policy.

I would really like to do it the soonest, so I (beneficiary) can travel to the US if needed, but my ex-fiance (petitioner) wants to wait until we get the NOA2, he is saying that's the best way, because he can send a letter making reference to the NOA2. At this point, I just told him that I would let him do the things the way he wanted, but I don't know if me (the petitioner) can do something to be sure that the petition will be away from my record and I will not have any problems with CBP the next time I would travel to the US.
This two parts of your post are going to be confusing to those trying to help you......are you 1) the petitioner or 2) the beneficiary. You have stated in your post that you are both?????? Or am I completely reading your post wrong?

In our culture arrange marriage is very common. But since I left for USA, we have phone record that can proof that we talk atleast 2 calls thru skype or phone everyday(every single day) for few hours. She live with my parent now. After reading some other post another flag could be agre difference, we do have age difference of 11 years. But thats common in our culture too. My parent, inlaws, sister in law has similar age difference between them and their spouse. I know there is some kind of red flag in my case, not sure which one, but I am optimistic that everything will be fine since I havent broke any law. But it's heart breaking for both of us that it going to take another 10+ months (uscis+nvc+embassy) after waiting for 7 months.
OP your current status for processing is based on the many red flags you have listed. Somehow, you are still not recognizing YOUR own red flags. Yes, arranged marriages are common in your culture. Age difference is also common in your culture. Unfortunately, what is common in your culture is also common in fraud. As others have stated "arranged" marriages can also mean "paid" marriages just for opportunity purposes to arrive in America. You arrived in America via immigration purposes. Even though your marriage was authentic, USCIS want to also make sure your NEW marriage is authentic as well. Think of it as being "common in American culture". The background checks and waiting is not to convict you of being guilty for breaking the or any law. However, laws are in place to deter people who might.

This sets off red flags in my head.
This is what I would do:
I would tell your spouse/ fiance that you understand that it is not financially viable for either of you to take a trip right now, but you feel it is necessary for the both of you to spend more time together before he moves and changes his life so drastically. Tell him you want to look out for him and yourself. I would ask my spouse to help you set a realistic time frame or goal dollar ($) amount that would signify a better time for you to go to Cameroon to visit for an extended time before he moves here.
If your spouse agrees- great, it seems like he is fairly committed to you and your relationship.
If your spouse disagrees (for whatever reason)- to me this is a major red flag and I would consider your relationship very carefully and what the ramifications would be if your fiance/ spouse was not entirely honest with his reasons for wanting to immigrate to the US (I am not implying he would be using you for immigration purposes if he did disagree, but it does not sound promising that someone who loves you and wants to spend their life with you would not want to see you and or protect you and themselves from making a mistake if the relationship is not a good fit).
Thanks, we are currently trying to rectify this whole situation. He admits he wants me completely comfortable when I come there & at the current time, he's not sure he can provide the comfort that I'm used to. I'm honestly not concerned about being "comfortable". I basically just want to be with him (for the connection, bonding, & etc). Hopefully, this ordeal won't cause me to not trust my spouse...................that's not a good look.
