  1. Hi all, my friend TB blood test is positive and she had chest x-ray ( in the meantime, the result is not coming yet ) and she will have interview on 16th may

    the question are :

    1.Will she get a problem if her I-693 there is TB (latent TB or class B ) on her interview later ?

    2. Will she really needs take antibiotics for 6 months? how if she refuse it?

    3. Or should she just not to bring I-693 on interview? even her status out of date when she process AOS so means her medical exam for K1 already expired which is she need and have to bring new form for medical exam (I-693 )

  2. Hi everyone, i don't know if this topic is in the right place or not. i would like to know how bad is a latent TB or latent tuberculosis? As i knew a little, it is not an active TB which is danger for other people. My friend just told me that her blood test is positive for TB, and she is fine and healthy

    And now she is afraid that this cause will cause something on her interview later. And how to do the treatment for this latent TB? couple months?

  3. Do you understand that she does not need to worry if she doesn't get EAD??? If she doesn't have it, then she can't bring it. They know that. There is no reason to hope it comes in a month other than she could get a job with it. No EAD doesn't affect her interview.

    She needs to take her birth certificate if she mailed only a photocopy. They may want to see the original. There is no reason for children's birth certificates unless they are applying for a greencard.

    yes i got it, and for her husband children birth certificate it was mentioned on USCIS letter for their interview or this is just for children who wants applyiing for green card too?

    it wrote like this : "birth certificates for all children of this marriage & custody papers for your children and for your spouse's children not living with you >> my friend's husband children already grown up and not living with them so kinda hard to get their birth certificate, is it will become a problem if USCIS asking to see?

  4. EAD /AP card is not required at interview. If she has it, they sometimes take the cards back at the interview if she is approved for a greencard. With a GC she no longer needs EAD or AP. Sometimes the interview comes so quickly that it is before EAD/AP approval. They will not issue the EAD/AP if her greencard approval comes first. Not a problem at all.

    Thanks Nich-Nick, yes she is kinda worry because still got no EAD / AP but i said it's still 1 month before the interview so who knows EAD / AP will come later before interview

    now she try to update her medical exam form just in case if USCIS asking the update one

  5. You can only skip getting another medical exam if your K-1 medical was done within a year of filing for AOS. So, they need to get the full medical done and the I-693 filled out by a designated civil surgeon. Yes, she should bring it with her to her interview to avoid getting an RFE at the interview for the I-693.   6. If she did not file for AOS until over a year after she arrived in the US on a K-1, then yes, she needs to get a new medical and an I-693 filled out by a civil surgeon.

    thanks Jay,oh i see, so she can get new medical and bring form I-693 to the civil surgeon and bring to USCIS on interview, it will be fine right? she just need to asks new update or full exam btw? cos last time i just paid for update thing

  7. If you had all the required vaccinations at the time of your K-1 and they were marked off on a properly filled out DS-3025, then you may be okay without the I-693. If your medical was not within one year of filing for AOS, or you did not have all the required vaccinations marked off on the DS-3025, then you will most likely be given an RFE at the interview to see a civil surgeon, get the missing vaccinations and the I-693.

    Jaykay, it's happen too with my friend. she will get an interview on next may and she was process AOS after 1,5 years came here, which is now her I-693 must be expired for USCIS. so i would like to know if she really need to do a new exam or update medical exam form or it will be fine with the old one without get any RFE? thanks

  8. Hi all, i have a question for my friend who will have an interview on 18th may. She had biometric on 28March and til now haven't got EAD / AP which is must be bring on the interview

    I was told her, maybe EAD / AP will coming soon cos when i process mine, it took around 1 month after i had bioometric.

    So my question is, do you guys think she will get EAD / AP before her interview? if not, is it possible if USCIS sent a letter for interview before she get her EAD / AP?

    and her medical exam form I-693 still use from K1 visa process, should she bring it on her interview too? Because she told me, her lawyer said just use the K1. Is it will be RFE for her later? if yes, so she needs to take a new medical exam and sending to USCIS or how? Would it make her AOS fail?

  9. If she is the applicant she will need to bring her original passport and a certified copy of her marriage certificate if she filed for AOS under married name. I can't imagine why the applicant would send her original foreign passport to the IRS, I hope you will enlighten us on this.

    she sent her original passport because she doesnt have any ID except her passport for her husband tax. because she doesn't have any SSN so while filled tax, now IRS need to see in real document with photograph for her ITIN

    so for now, she has to waiting til her passport back then process her AOS :)

    i've some question for my friend here, i want to keep for myself but i can't, need to help her to find solution

    Ok here is the story. she came to USA 1 year couple months ago and married already but not process AOS yet. last time she told me about her husband who seems have a problem with alcohol. he is like addicted ( not everyday but most of weekend being crazy etc not abused her at all )

    she just can't take the situation like that because what she wants is normal husband, who can talk with normal situation and i think she is really worry a lot for his health )

    once time her husband said doesn't have money to afford her GC, do by your own, pay with your own money.

    question is : she feel sick couple days ago, being like this, feels like a fool, every morning after a nite before husband got drunk and morning forgot everything, always like that. so she asked me one time, can i sue him not be responsible?

    1. can she sue her husband for being not responsible asked her to pay for own her GC?

    2. how if let say she already get GC, and can she do divorce and still live in USA?

    3. how if her husband die, and she still doesn't have GC yet? what will happen to her? will she has to go back to her country? or she can file her own GC ?

    i think that's all same questions she always asked me and i don't know the answer too

  11. You are talking about two entirely different processes. The IRS and the USCIS are two completely seperate government agencies. The IRS is under teh Department of Revenue and the USCIS is under the DEpartment of Homeland Security. What you do with one has no impact on the other unless the USCIS requires copies of your tax return, then you need to deal with teh IRS. I would file the AOS and get that going if you have the $1070 inorder to pay the filing fee. If you need the refund in order to file the AOS, then I would get teh ITIN number. You can go to a local IRS office near you for help and might be able to apply for teh ITIN number in person and get it before you leave. I have never needed an ITIN number. You might want to search for Darnell as he is the SME (Subject matter expert) on getting an ITIN. I just want you to be aware that her medical will expire one year after she had it. If it is expired then she will need to go to a Civil Surgeon for a new one and that will cost you approximately $150-$300 depending on the Civil Surgeon to get the I-693 completed. One reason to file AOS ASAP after marriage.

    Thanks for the info and she told me that she already called IRS office and they just want her to send original passport which is still valid with photograph because now IRS didnt take any authorize acceptance agents anymore, they need original one

    and they will fill AOS soon after they get the refund, and yes she already knew about another medical check up again but she just got GC for 2 years right?

    I suggest something else. Go into a local IRS office

    with W-7 form and her passport and the tax return (bring the husband)

    and file it there, in person, with an IRS officer.

    The IRS Officer will make a photocopy of the passport right then and there, and will forward all to the ITIN office in Austin , TX.

    Thanks Darnell, yes they did before but IRS in her city just gave some list for acceptance agents which is not valid anymore, they already gave local IRS all copies of passport, birth certificate and wedding certificate certified

    and now she will just send the original one and make it done :)

  12. First thing to clearify is that the K-1 visa expired the day she used it. Now that her I-94 is expired she is out of status and accuring over-stay days. Once she hits 180 days the advance parole (AP) is worthless as she would not be allowed back in to the US. Now that 2 years has expired, she might need to file the I-130 with the I-485. She will need to do another medical examine. Until she adjusts status she cannot work, cannot leave the US, cannot get a SSN, is not a LPR, and can be detained by CBP if she gets close to the Southern Border and is stopped by them.'

    She was eligible for a SSN and now must follow all the rules for getting an ITIN. See the instructions for the W-7 here.

    Thanks Dave, she came here last June or July as i remember and waiting to get $ from tax refund to process the GC and now IRS reject because need original document.

    I asked my other friend's lawyer about this, do they need to fill AOS for 10 years and the answer is they can't, they still have to process for 2 years GC first

    So better process GC while IRS doing cross check tax W7 or just waiting tax refund first? kinda confusing me hahahaa

  13. i don't know if this topic in the wrong place or not, but i have some question for my friend. It's about her ITIN case. She doesn't have GC yet and SSN because she was late to process it before her visa expired K1 visa ) so now been almost a half year after tax time, and IRS reject her application because they need original document not just certified her passport from certified agents like H&R Block

    She did certified in H&R Block acceptance agent from IRS in her city ( they gave her the list ) but suddenly IRS sent a letter said rejected and needs to send original document ( in this case the only one document which is valid for her just her passport )

    My question is :

    Does she needs to certified her passport from her embassy / acceptance agent ( from IRS list ) or just send the original passport to IRS ? and is she needs to send another original documents like birth certificate? or wedding certificate ?

    So maybe anybody here know the answer would be very helpful

    And btw is that okay if after almost 2 years married but she doesn't apply for AOS yet? is that will be a problem in USCIS later?

  14. Hi all, i have a question for my friend case about tax refund. Her husband filled on time around April but til today, they haven't got the tax refund. The case is when they applied, she doesn't have green card yet so they used Tax ID number for a while ( i forgot the form special for spouse who doesn't have any ID yet )

    so now my friend seems worry if IRS will reject the tax refund cos her status is not legal yet?

    Do you think is it possible they will get reject and won't get refund but have to pay the owe to IRS? because it's been around 8 months and they still not get the refund back

  15. If you are asking how much it is to adjust status and file with the I-130 if you have been married over 2 years, the I-130 is $420 and the I-485 is $1070. Add on the fee for seeing a civil surgeon and getting a medical done.

    The fee for removal of conditions in order to get a 10 year card when you already have a 2 year green card is $590.

    so if my friend waiting til their marriage 2 years and filling the Greencard, so she will directly get for 10 years greencard with fee around $1500? and pay for another medical test again ( is this will be the same like k1 visa medical test or much different? )
