  1. OMG!!! Girl you better find another place to stay for you and your daughter. Your husband is F*****G crazy., he might do "something" to your daughter. Did you adjust your status already? If you do then pack your things and ask someone to help you.You will be good there in USA without your husband..Be strong.. for your daughter, GOd is always with you just remember that.

  2. Hey guys...i'm new here too! I'm inquire alot of information about DCF. I\m so glad I found a forum that gives alot of details about the DCF. My boyfriend and I want to be together..we live in the Philippines. Im the US Citizen (DUAL) and his non-US citizen...so by the looks of it..we have to get married first here in Manila right? Then after start filing? Where do I start filing? Can someone give me address and phone numbers? I have a magicjack so I can easily call out.

    I just need help on getting started with DCF.

    Please advice...I would like to learn about this so I dont want have any errors in the long run and have to re-do all the process again.

    Just follow TAHOMA's instructions... and you can download any forms you need here at Vj's or USCIS website.. and you can find example forms also on Vj's. And

    you can find all informations needed on this site /or USCIS website. And start gathering necessary documents.

  3. Hello, everyone! :) I'm new at this website. I need advice or :help:

    I, Dual Citizen, lives in Manila for 3 yrs now because I am currently enrolled at a nursing school. I will be done in March. I've been in a relationship with my boyfriend, Non-US Citizen, for 2 years. We are planning to petition him so he can come with me USA. Just like everyone else, I researched from US Embassy to K1 Visa forums and immigration website. Unfortunately, the K1 is out of our question, since I don't work and only he works here in Manila. My parents are willing to support us and sign any Affidavit Sponsor forms. My question is:

    1. Am I qualified to file for the DCF without financial income? try to read more on this site www.uscis.gov

    2. Can my parents co-sponsor for his petition?

    3. How do I get started? Should we get married here first? I'm confuse. :blink: write any questions on the blank before search and you will find lots of answers.

    Any advice and suggestions would surely help. :yes:

    USEM Consular Officers are very strict when it comes to K1 visa applicants co- sponsor.. sometimes they do accept but most of the time they don't, well i guess it depends on the petitioner's situation. USCPetitioner that don't meet required income annually , students, unemployed etc. uses CR1 visa petition if the marriage is less that 2 years old and IR1 if 2 years and above, so they can have co-sponsor.

  4. until now we're still waiting for our NOA2 but time should not be wasted, so we are preparing documents and stuff for "hopefully" incoming interview..everything goes smoothly until i found out that my fiance's recent year income tax return fall below the required income. Income tax return total income year 2008 and 2009 are ok bec after retirement on 2006 he had worked as a part time worker in a company until last year..

    he's been receiving..

    8,940 from pension (tax already deducted)

    9,500 from unemployment compensation

    17,526 from social security benefits and

    19,542 total income?????????? :( only

    Why is this so???

    HE have SSA form 1099- social security benefits statement and form 1099R from his retirement pension as a proof that he's been receiving the said amount annually. if we add this 2 income, the total income annually would be 26,466 and this is for life?!!and $3000 beyond required income for 3 person household, unemployment compensation not yet included.But the total income on 1040A really bothers me, is social security benefits not considered as income in 1040A ? bec this is written on 14a line on all ITR form. Does this would mean a red flag? or does the statements we have provided are enough proof to consider his income to be above poverty level?. Pls give me suggestion regarding this matter.. thank you so much!!!

    Lawful permanent residents may not petition to bring their parents to live permanently in the U.S.

    There must be some way for a greencard holder (my wife is a conditional green card holder) to sponsor their parents

    to live permanently in the US.

    Or could they come on a visitor visa, then return to their country, and after some specified time, be able to

    come to the US again on a visitor visa?

    Yes this is true..just wait until your wife got her US citizenship .. by then she can petition her parents immediately. and Yes they could apply for visitors visa.

  6. Flyhighrtr: It's not for the sputum test, so she will likely (fingers crossed) be cleared on December 8th. I'm hoping the interview will happen before December 20th, that's when I figure they won't get the Visa done before the New Year. Still looking for insight the typical time delay on St. Luke's rescheduling.

    That was my friend told me.. if it's not sputum test maybe you knew a lot more better. Pray Harder maybe in God's time he will give you what your heart desires.that's the only thing i can advice. Good luck too!!! :ot::innocent::whistle:

    Due to unforeseen circumstances my wife was unable to meet her Visa interview today because of a medical holdup. She has an appointment at St. Luke's on December 8th, and hopefully she will get final approval that day. St. Luke's said they will reschedule her Visa appointment for her. Has anyone here experienced St. Luke's rescheduling for them? I know it will depend on case load, but what is the typical waiting period between final medical approval and the rescheduled Visa appointment?

    I only ask these questions because we are in a very tight window. I fly back from the Philippines on January 3rd, and would like to have two extra people coming back with me.

    my friend took about 2 months, her problem was St. Lukes found out that there was a small spot on her left lung,they gave her medicine and did sputum test afterward... well it depends upon the reason of her medical holdup.

    I am sending my I-129F this coming Monday and I need to ask you last couple questions and I hope you guys help as you have done in the past.

    1. I have all other proofs of our ongoing relationship such as emails, phone calls records, skype and messanger chats. The only thing I have not printed is our Face book messages we has sent to each other back and forth. This may sound stupid, but i could not get it to print. Does anyone know how I could print face book messages?

    2. I am the petitioner and I do need to have my birth certificate and or copies of my passport, do I need to have a copy of my alien fiance's birth certificate and passport copies to send along with I-129F petition?

    3. I have a total of 12 pictures of our engagement and pictures of us together, will this number be fine?

    4. What would be the last advice, comments and sugestions you guys would like to share with me to help me send my package as perfect as possible?

  9. Hello everyone, i am so worried now coz my fiance (the petitioner) sent the rfe response yesterday to the USCIS. OUr RFE is the G-325A of the Petitioner because my fiance overlooked to sign the form and was not able to fill up the box on the bottom part of the form so he submitted a new copy but the problem is my fiance was confused about the item File Number A____________, on our RFE notice of Action, the USCIS assigned already an A# so my fiance put that particular number on the File Number Item which it should be NONE coz he is as US Citizen. Would it be a problem? What shall we do? Call the USCIS once they received our RFE reply and explain to them about the typo error? Any advise and insights from you guys is a BIG Help. Thank you very much to those who will answer.

Hello just going through some of the K1 procedures for a K1 visa on this site and have found some very helpful information, but is there any way we can try and organize a checklist together for the beneficiary as regards to what documents they will be needing through the whole process. Also maybe we can include the CFO requirements as well

    Through just thumbing through some posts I guess they will need the basics like Birth Certificate and a Passport, But what about other things like vacination record, My fiance is pretty skimpy on documents (and I would imagine that this becomes an issue for many Fil- Am couples) so i am trying to get a list together for her so she can prepare on her end.

    This is what i have come up with so far. Please provide any feedback ,additions or experiences you have had with any of the requirements so we can all get a better idea of what is required

    6 passport style photos

    Letter of Intent to marry created by foreign fiance

    Passport

    G-325A form filled out by foreign fiance

  11. even if the Philippines does not recognize divorce. your wife divorced to her former husbands are legal and valid. i don't know what's the reason behind it.. but... let me tell you a short story i had a friend who is now married to a US citizen and presently living in California. before she marry her husband. her marriage is still valid to her former husband and not even started to file for annulment and also she was considered as illegal alien in the US.. but 2 months prior to her wedding. he filed for divorce with the help from her atty.in SF CA and then sent documents to the Philippines for her former husband's approval(signature)and then that's it the rest is history.

    I guess judge in the US are knowledgeable enough to know everything about law in the US as well as in the Phils. if the law does not apply to both country decision will not be made.

  12. As you may or may not know, the Philippines does not recognize divorce and their law states that a Philiipiine Citizen cannot obtain a divorce no matter where in the world they are. My wife is a Philiipine Citizen who married one time in 1982 to a Philippine Citizne and was able to hide that marriage, and then a US Citizen in 1991. She came here in 1991 and we met in 1996. Before her and I married, she was able to obtain divorces from both men. She was neither a US citizen nor a greencard holder and I am not sure if the Judge who granted her these divorces knew that at the time. Now my question is this: Since the US obviously recognizes divorce, but the Philippines does not, and she is a Philippine Citizen. Is she legitimately divorced and was she free to marry again in the US? If you are aware of any links, please list them.

  13. We recently received notice that the I-129F 2nd NOA was approved and also received a verbal case number from the National Visa Center. Currently waiting on the official letter from NVC so we can schedule the appointment in Manila. Next, we will schedule the interview at the embassy for my fiance. We also included her minor child in the same I-129 application. Does anyone know if we will have to pay a separate $350 Interview Fee for her minor 12 year old child.

    Yes! you need to pay $350 for your fiancee and $350 for her minor child. and don't forget separate medical fee to both

  14. hello everyone.. i hope you can help me with my questions. I'm on K1 visa petition.. and I've read different blog about affidavit of support(I-134) and up to now I am confused on what to do regarding this. Do we really need to provide separate I-134 on k2 and documents for affidavit of support? and do we really need to notarized this. it's really funny!! but i need a concrete answers. thank you so much VJ members.
