    My husband sent in his AOS paperwork in December 2012 and had his biometrics taken in January. We received an RFE in January and responded to it in March. I realize that the RFE may have set back our receipt of his green card, but we sent in an E-request in July due to outside of normal processing times and it was accepted by the system. After not hearing anything, we gave them a call on September 9, 2013. The request was submitted and the woman told my husband to expect a response in 15 days.

    Today, we received a letter in the mail that states:

    "Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below."

    I'm completely baffled by the SIX MONTHS notation. Six months?! It seems like an awfully long time to wait for his green card, regardless of RFE. Even with RFE, that means that we will have waited 14 months for his green card. Has anyone received such a letter and what was the wait time for you? I want to believe that he will receive it before the six month mark, but the time seems crazy long.... When we began this process, I thought he would receive his green card in 6-8 months TOPS. Now we are pushing 10 months (not including the RFE time, which was a 2 month setback) and it might push to 14 months.

    Is there anything I can do about it?

  2. Hello all VJers,

    I have a friend whose girlfriend is from England and is planning to travel to the USA in June to do missionary work at a church here, doing work as a volunteer ESL teacher for 1 year. We have searched on Google for the documents necessary for the interview, but we are coming up short on this type of information. The lawyer that he spoke with told him that she will come on a B1/B2 visa and it will be valid for 1 year. Does anyone have experience with this type of situation and/or can you point us in the correct direction to find out what she needs to bring to her interview?

  3. I would suggest waiting for one or two paystubs to provide enough evidence of your current income. That along with a letter from your employer should help establish your ability to support your husband. I am not sure if you are required to send in what you already sent but I think it is safest to fill out a new i-864 and send it with tax information and the new supporting documents from your new job. Good luck dear!!

    Something I might suggest, depending on how well you get along with your boss (I understand it's a new job, so circumstances may vary), is to get your boss to write a letter (with company letter head) to USCIS with the following information:

    • When you started
    • How many hours per week you'll work
    • how much money she guarantees you will make this year

    Reason being is if your employer promises you'll make X amount over the poverty line, USCIS will sometimes honor it.

    I'd wait for the 2 paycheck stubs to send along with other documents you have. Like others have already advised you in your other threads, you only have 1 chance to respond to this RFE and you'd want to do it correctly.

  4. Hey all - quick question (although I asked this on the main forum and no one had answers so I hope someone here can help me out!):

    I start my new job tomorrow and currently have only a job letter from my employer. I need to respond to the RFE for my husband's AOS by the end of March, but I really was hoping to do it ASAP because I want him to get his EAD as quickly as possible. But I don't know if I should send back the RFE response with: a) new I-864 with new income (it is above poverty level), b) employer letter, and c) tax information (again). OR if I should wait until the end of February when I will have two paystubs to send with the previous mentioned items. Just as a note, our RFE was for insufficient income so I want to try to prove that I am now CURRENTLY making enough money.

    Any advice?

  5. RFE was for the I-864 (insufficient income). Submitted my tax returns from last 3 years, but recently got a new job that meets poverty limits so we don't need a co-sponsor.

    I'm only wondering if I should wait until I have pay stubs (I will have 2 at the end of this month - I start my job on Monday) and time to respond to RFE expires end of March. Or if I can resend in I-864 noting my current income with job letter only + tax returns (again)?

    We received a RFE for my husband's AOS at the beginning of this month in regards to the I-864 and I've since been offered a full-time position (finally!). The thing is that my employer has given me the job acceptance letter (it states on the letter that I have accepted the job, and my pay rate, on company letterhead) but I currently do not have any pay stubs because I begin my job on Monday. I want to send in the RFE as soon as possible, as the 87 days expires at the end of March and I would really like my husband to get his EAD ASAP, but I am unsure if I should wait a week or a few to show some of my pay stubs - at the end of the month I will have 2 only. Or should I send in the employer letter only? Don't really want to wait but I don't want to send in things too early if it is wiser to send in the pay stubs that I will have in a few weeks.

    Suggestions?

We bought the plane tickets before we got the visa, but we were literally driving back and forth from our city to the Embassy (4 hours away by bus) two days prior to our flight, hoping we would have the visa issued in time. Luckily, it was issued but I was almost in serious panic mode. I'd advise against it. I also flew back to the USA with my husband, and I literally HAD to be in the USA on the day that we flew back, but it was so stressful and I wish that it didn't have to be that way -- so if there is no reason why you HAVE to be in the USA (I'm guessing no - my reason was a family matter) then wait until after the visa is issued. You will have time to say goodbye to family, friends, pack up slowly, etc. And you won't be so stressed!

  8. Ugh. Just checked our online status and we are getting an RFE. I can't imagine why because I followed the instructions and guides and checked and double-checked everything. I guess we will have to wait and see when the mail arrives. It was sent yesterday so hopefully it will only take a couple days.

    Hopefully it will be something easy to fix!! We got our hardcopy a few days after the online notification.

  9. Biometrics done!

    Super easy... there was literally only ONE other guy in the room when we walked in and he was surrounded by like 100 chairs. On the website for our location they said that only "necessary" people should come due to "limited seating space" which was such a crock because it was completely empty!!

    We were in and out of there in 10 minutes. Drove 1 hour and 30 minutes round trip for something so easy breezy! But one more thing DONE! Yay!

    Now we gotta send back the RFE but I'm not so worried about that :D

  10. I think you will need to send them a complete tax return or IRS tax transcript to prove that you filed. It doesn't matter if you made any money in the US or not. Documents such as pay stubs and letter from employer would establish you ability to support your spouse based on your current income. You have that covered! However, tax return is to establish that you filed taxes as is expected of all citizens of the US, both at home and abroad.

    Received our hard copy of the RFE today. I already knew what it was going to be for (need to provide evidence of salary for the affidavit of support and I just got a new job so I will able to provide them with that... although I will NOT have tax returns because my taxes last year were in zero due to living overseas). Can I provide employer letter and pay stubs only? Will that be sufficient?

  12. Sorry to hear this.

    My package has been delivered on December 3oth (Sunday?? huh) and I talked to USPS they said, its p.o.box so it might have delivered on Sunday 10-30PM.. lol

    BTW I tried to Intercept the mail as I found out that I selected wrong option on I-864 part 2. but its delivered already.

    so can't do anything else.

    Don't worry... I already knew it was coming haha so I am not bothered by it, just wish it wouldn't affect the EAD (I'm pretty sure it does, so I'll have to try to send the RFE back ASAP)!

  13. Hello everybody. I just got the text (January 3rd) that both the AOS (December 31st) and EAD/AP (December 28th) have been accepted for processing and the NOA1 is on its way. I see you are all getting biometrics appointments. How and when I am expected to get one too? FYI my number starts with the letters MSC.

    We received the biometrics letter 10 days after our AOS/EAD was sent. It was scheduled for two weeks later than the day that we received the letter. So you should get the letter for biometrics in the next week or so. I don't know if we got ours on the average timeline, but we live really close to Chicago.

  14. I just happened to check the online status today and saw that an RFE was issued today. So we should get the hard copy by next week, I guess. I'm 100% positive it is because when we filed I didn't make enough money but I recently landed a new job so it won't be such an issue anymore. I think the other issue might be that I was working overseas for the past two years so my taxes show in zero for last year.

    I'm just hoping that the RFE does NOT affect my husband's EAD because we wanted to get that expedited due to possible job offers on the table...

    We're December filers as well and we have a quick question.

    We submitted our AOS package along with I-864 using 2011 tax transcript. Will USCIS request an updated tax return or tax transcript for 2012?

    I would doubt it... considering 2011 was the current one when we filed. But, I did think about that fact myself! I just submitted the most current one that I had. I would hate to imagine that they would RFE everyone who filed during this time.
