  1. Hi everyone,

    We're in the process of submitting I-290B to re-open our case (I-485). (They denied it because we didn't submit Federal Income Tax Return for our co-sponsor)

    We are very confused with the instructions that came with it. It says, the petitioner should fill it out, is the petitioner me (foreigner) or is it my husband (US Citizen)?

    And where should we send it? The denial letter said to send it to Chicago Lockbox, but the officer we talked to on the phone said to send it to AZ.

    Anyone here who filled out this form, kindly help us.

  2. Got here in November 2010 thru K1 Visa, got married within 90 days but didn't file for AOS/EAD until May 2011.

    In July, we got an RFE saying we need a co-sponsor. We submitted my mother-in-law's w2 forms, payslips, bank acct info etc.

    Las Monday, USCIS website is saying they denied our application.

    We just got the denial letter today.

    It's saying we failed to submit:

    Copies of the most recent Federal Income tax for the joint sponsor.

    Which we never really did (how stupid and ignorant of me)

    We submitted W2 forms of my Mother-in-law (together with bank accts, employment letter etc.,) we thought it'd be sufficient.

    And we're thinking, since we only missed 1 paperwork, which we can submit right away, why didn't just send us another RFE?

    They're saying I can file for a motion which we have to pay $630!!

    I talked to a USCIS officer on the phone today and he said, (he thinks) that the best option is to file for a motion because it's a very simple misunderstanding. He also gave me an option to re-file and start over again which we have to pay $1070 (again)if we're gonna do that.

    I'm still thinking what I should do. Please help me. Re-file and start over again or File for a motion? Which is faster and more convenient?!

    Also, SHOULD WE HIRE A LAWYER? Or since it's very simple, we can do it on our own?

  4. They received our RFE response on time.

    I don't know why they won't believe our marriage is for real. Is it because I didn't send any wedding pictures? We've been friends since 2005 and been together since 2008 and we waited for 2 years to get to know each other, get engaged and process our k1 Visa. We even got married twice, first one is civil and then a garden wedding. I'm really scared. I came here to start a family and I didn't expect it's this complicated.

    This is what I saw yesterday from the USCIS website upon checking the status of my AOS and EAD.

    Decision

    On October 3, 2011, we mailed you a denial decision notice for this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of October 3, 2011, please call customer service at 1-800-375-5283 for further assistance.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    I got here November last year (2010) Got married within 90 days but didn't file for AOS/EAD until May 2011.

    In July they sent an RFE saying my husband is not making enough money to support us, so we got a co-sponsor, my mother-in-law making $33,000 a year.

    Together with that, we sent everything they asked from us.

    They received the RFE response in August 9th, and after almost 2 months, both my EAD and AOS has been denied. We haven't gotten the letter yet, so we don't know why it got denied. We called USCIS and talked to an officer and said she can't tell us what's wrong until we receive the letter.

    Guys, I'm very very worried. Will I be deported?

    Do you know the reasons why I might get denied? Is there anything to do with my late credit card payments back home? (Which I'm trying my best to pay even when I'm here)

    Please help me, I don't wanna leave my husband, after so many years of waiting for us to be together.
