Overstays are generally forgiven when you marry an American citizen. What type of immigrant visa have you applied for?
I-130, married to me, a US citizen and we have two US citizen little kids together! I hope you are right!!!

Do not recall any of these on the Cdn forum! I know quite often they ask at the interview if you have ever been denied entry or banned! As well you have to list as best as you can the times you have been to the USA. If you have any doubts, have the waiver ready to go when ur at the interview.....Hopefully you won't require it.

This basically means that a large percentage of the applicants flat out lie in their application, right? I guess that was the way to go...
What about admitting to a single-time usage? Would that be somehow better? I saw some exception regarding that.

Nothing is impossible so don't think that all hope is gone. Hire a good attorney and have a plan for your interview and what ever you do, don't lie so then you wont have a misrepresentation charge as well. I have seen people who have committed fraud get approvals. Good luck to you.

I've just filed my Visa request forms, and have naively selected "Yes" for the drugs issue, with the explanation:
"Sporadic recreational use of marijuana. Last time was approximately 10 years ago".
I have never been indicted or convicted of anything.
My interview at the consulate is scheduled for 6 weeks from now (I'm an Israeli citizen, residing in Israel).
Will this make me inadmissible? How much trouble am I looking at?

I am pretty sure that they are going to deny you based on that answer. I am sorry to say. I guess you can file for what is called a waiver once you have been formally denied.

Thank you!!!!He will need proof to show that he will be returning to Canada. Lease agreement,proof of mortgage, letter from his employer expecting him back such and such a day, proof of bank accounts in Canada etc.
He can travel back and forth as much as he wants, by land or by air. Keep in mind once they see he has a visa in process, he will have to answer a lot more questions, and it is ultimately up to the CBP whether they let him in or not. Always have a back up plan.

I am US citizen with two US citizen kids, I have applied for greencard Canadian husband. Can my husband travel to USA while greencard is pending?
Also is it better to travel my land or air?

This is my first time posting here. And I think that my story will shock many of you.
I am a US citizen. My husband a Canadian citizen. I made the biggest mistake of my life by filling his I-130 myself and not hiring an attorney. I did not know that I need to fill out a change of status form because he was currently living in US. Make a long story short, our interview letter came and so we went to Montreal, Canada. Everything went fine. His case got approved. I flew back home to US. A week later he got his passport with the immigrant visa stamp. He went to the airport in Montreal to fly home. A CBP officer started questioning him about when was the last time he entered US, and how he got to , why his interview was in Montreal and not Vancouver and many other questions. They questioned him for 6 hours and finally canceled his visa and told him that he has to go file a waiver because they feel that he lied on his application.
I have two little kids at home who miss him like crazy. Financially,we are falling apart. My beautiful life has been destroyed. Can a CBP officer do this? Can I appeal this?

Hi there,our waiver was approved in Oct 2013 and we submitted documents to Montreal consulate in nov 2013. Then in jan 2014 our status went from refused to ready to administrative processing. By the way, we still have not gotten our visa issued!!!!!!!!!!!!!!!! As far as the Lachine, I was very concerned about that too because obviously that is not the final destination but it turned about to be correct because 2 months later the consulate acknowledged the receipt of our documents.
Please post the progress of your case because I am dying to know if it is normal for montreal to take so long to issue immigrant visa after a waiver approval or that there is some sort of an issue with our case.
