  1. I just got the RFE in the mail today sad.gif Although disappointed I did expect this. Any help here would be great. I'm not sure if I have messed up all of this stuff or not. If anyone can give advice:

    I filed the I-485/I-601/I-765 together and paid all forms together with one cashier check (I have copies).

    I have received payment receipts for all forms submitted.

    I will have no supporting evidence for the I-485 that I filed for my husband. My question is if I send a letter and the I-485A form filled to the best of my knowledge with copies of receipt for the I-601, when the I-485 is denied will the I-601 then be processed? Will I have to re-pay the I-485, or file a I-290B and pay the fee to have the I-485 appealed and re-opened? A bit confused, and obviously with out the funds to hire a lawyer sad.gif Any advice greatly appreciated.

Hi everyone, i lived in the US for 13yrs an did not get marrried until 12yrs after i started the process of filing for citizenship but had to leave the US 8months after i started filing because my father was in his last days an i had to return back to my country (Trinidad). I had my interview June,2012 , which didn"t go well at all beacuse they told me that I jave to file form I-601. Do noot know how to start filing such document, I would kindly appreciate some help from anyone who has been through that process. Thank you.........

  3. So you filed your waiver in the US along with your adjustment of status?

    We filed 601 and 212 waivers in July 2008 in Algeria. There was a fairly short round of background checks(3 months) before the file was transferred to Rome where a decision was made. They received the file in Oct 2008 and we were approved in April 2009. It took a month to transfer the approval back and another month for the interview/visa issuance. My husband entered the US July 29, 2009 just over a year after submitting his waivers. It was the happiest day of my life. Our family was separated for 27 long months while waiting for him to return after his detention and subsequent removal in April 2007. My husband is eligible for citizenship in about 13 months...by the time he is naturalized it will be 10 years since our wedding day and 12 years since the first immigration paperwork was filed. It's a long and complicated story that I will share if anyone is interested.

  4. Hello everyone! i hope you are all well,here is my story of my interview yesterday at the

    US embassy,manila...May 7th booked hotel in ermita,so i can be there early,i woke up at 2am

    get ready,just before i left at the hotel i check my documents and make sure i have everything i need,i Prayed for guidance and called my honey.

    Exactly 3:15am i arrived at the US embassy,

    there was people already waiting at the foot bridge,i thought i will be the first one lol...

    they got there 2am wow!!!so i sit and waited,there's a vendors selling food and telling you

    if you have gadgets you can leave it with them for a fee of 150pesos.then around 4 something

    the vendors told us to fall inline,i been standing for 2 hours :crying:

    Girls,if your wearing heels better bring flip flops but only if somebody with you so,

    you can leave it when you go inside embassy.then about 6 something the guard told us to fall

    inline there first priority are senior citizen and family with kids.then,the staff wearing

    blue shirt will asked you of your Appointment confirmation(1st page)2 copy of DS156,DS157

    1 copy DS156k,Passport they will give you a plastic to put you passport.they will asked

    you what ST lukes gave you.then we go in security check our belongings

    and again,any gadgets is not allowed even USB,food and water is not allowed,

    But they are selling food inside,then we got in and again fall inline for that window will

    give you your priority number,once you are inside the Building the first thing is you will

    drop your papers at window 39,(this are the papers were the staff wearing blue shirt outside

    arranged it for you before you get in).once you drop your papers watch the queuing board

    Numbers changed randomly,base on my experienced i was interviewed first by filipino consul

    at window 49,he asked for my Birth certificate,cenomar,NBI,Passport,as he is encoding some data he asked me question who is my petitioner,when and where did we met,how many times he

    visited me,then,he asked my fiance's I134,W2,ITR,then again he ask if we have

    chat's,email so i show him my huge paper of YM Chats,Emails,Skype Chat logs he said wow!

    ok ok i believed you...lol he didn't bother to check it but it's really better to have more

    than enough,then he asked our pictures together then asked me when are we going to marry

    i told him June 16,and that my fiance's parents book the venue for us.he write down everything particularly my answer.he told me that everything is good that i can take a sit

    and wait,i told him i haven't done my finger scan yet so he said,oh ok ok...then again my

    number flash on the queuing board for window 40 finger scan,the american lady in that

    window is nice and friendly.Girls,always greet the consul and wear your best smile :)

    i was done in 7a.m for pre-interview,finger scan so i sit and waited for my final interview with the US consul. i keep on praying...actually,the US consul window open at 8a.m. but my

    number never called til like 9 something so i was setting for 2hrs, waiting...

    then the moment came,my number flash on the board window 64,she's like chinese she is

    really nice,she asked my name,my fiance's name,when and where did we met,how many times

    he visited me,if we are married before,she saw my previous work on DS156k in kuwait if i

    commit any crime,i said no.and asked me when did he proposed to me,

    and when are we planning to get married,she interview me in less

    than 5 minutes,that was really fast.and the last thing i heard from her was your paper looks

    good and that i'm approving your Visa,Congratulations!!! i was in tears when i heard that

    it's a tears of joy!...God did answer my prayers...i say Thank you to her many times...

    so again i sit and waited at the last window 71,the filipino who is in that window ask my name and check my papers then told me where i want my visa to be delivered

    i told him for pick up in SM center...and he give me back my appoinment confirmation

    with a stamp BIO F/P DONE and dated it.so i walk out US embassy with a big smile on my face Thank GOD!!! thank you guys for all the support and prayers!!!

    sorry guys if this really long i just want to detailed my experienced in my interview and

    share it with you all...like what i said in my previous post "Prayers bring Miracles"...

    keep on praying and believed that you deserve this,apply that law of attraction what

    you are attracting to your life is definitely will be yours...stay positive...

    what a beautiful story, after reading your experience i was in tears........... hope that happens to me. I would like to know what documents should i carry to the interview. My interview date 06-20-2012.

  5. Are you sure you mean your husband filed the "I-824 Application for Action on an Approved Application or Petition" and not the I-864- Affidavit of Support?

    What does the lawyer say about the case? It looks like you had an overstay in the USA of several years. How did you enter the USA originally and how long were you out-of-status? Why did you never get your greencard in the 13 years/ after marriage? If you did overstay, you will get to the interview (filing to interview usually takes 9-12 months), and will be denied at interview. Then your husband needs to file a hardship waiver showing he cannot move abroad and you not being with him is significant hardship (NOT just that he misses you). This will take another few months to be processed, and where the lawyer will be really important.

    what can i possably do i've been in my country for 9months now an my husband sends me money to help me out because i have no one to turn to an he pays my rent for where i live. how do we go about filing a hardship wavier?

  6. If you entered legally in 1998 you could have filed I130 and then adjusted status. Now that you are out of the US, the lengthy overstay will cause you to have to file an I601. If you were in proceedings (notified by USCIS at any point to leave) then you will also be filing an I212. Unfortunately now you will be facing a 10 year bar to re-entry which can only be lifted by the approval of the I601. It doesn't sound like your husbands attorney is familiar with this process, find an attorney experienced with hardship waivers (i601)

    good luck and read the research links here so you know what you are doing and what to ask the attorney.

    what are the requiments to file a hard ship waiver? i've been in my country for almost 9 months now an i have no where to stay my husband sends me money to help me servive what can i do ? plz help me.

  7. tell your husband to come on the forum and read the I601 Research links. The lawyer you have doesn't know what the heck he/she is doing. I-824 makes no sense in the context of what you have described.

    i need help really an truly, dont know what to do any more i spoke to lawyer an now he is saying that i should file I-601. how could i file a hardship waiver whats the best way of filing it?

  8. Did your husband file for u in 2010 or is did he started the petition when u came back home? If it's the latter then u in for a long wait. Like u I came back home cause of family now everyday I regret it. For the past year and two months I have been waiting, its the worst mistake of my life. Like penguin said you've got to go through the process the last step would be the waiver; takes three to four months once everything goes through ie I-864. Its been the longest and worst time of my life but everyday that goes by is one step closer to the man I love no matter how slow the day drages and BS I put up with.

    yes the lawyer sent out the I-824 yesterday an he told my husband that it will speed up the process ... Is that really ture?

    i did enter the U.S legally an my I130 had been approved .... and now our lawyer is saying that we have to file an I-824 Im not familiar with the immigration law's very confused....

  11. Hi everyone, I lived in the U.S for almost 13yrs. I got married in 2010 an i had to return to my country because my father wasn't well at all , he was in his last days. I returned to my country in feb/2011. I im trying to get back to the U.S. I dont know much abt immigration law's but my husband hired a lawyer an so far all i have is an approved I-797 notice of action case type I-130. Now we are abt to file an I-824 where do i go from , an how long does that process take?
