  1. If your parents are going to combine their incomes to meet the 125% requirement, then your dad fills out the I-864 and your mom needs to fill out an I-864A to combine her income with his. Read through the I-864 and I-864A instructions.

    They need to put their individual incomes from the last 3 years tax returns(not the joint amount from their combined income on their taxes) on their forms and they need to provide their most recent 2011 tax transcript, or a complete copy of their return that includes all forms, schedules, attachments, W-2s and/or 1099s. They also need a letter from their employer stating position and salary and a few months worth of their most recent pay stubs. They can provide a copy of their birth certificates or the bio pages from their US passports to prove citizenship.

    You need to provide your own I-864 as the primary sponsor, and if you did not file taxes because you were a student and had no income, then you need to write a statement explaining that is why you were not legally required to file. On #25, put N/A-NOT REQUIRED TO FILE for the years you did not file taxes.

    EDITED TO ADD> If your father is self-employed, then his income will be based on line 22 of his 2011 1040.

    btw,my dad is saying that they dont've fill in two forms because they've always filed taxes jointly.??? should i be filling in another i864A anyway?

    couple questions more on my i-864 part:

    Part5:

    21.a. 01, b: me(1) ..I'm confused on this part.do i need to check G and add my parents since they're sponsoring.

    Part6: 22. I m currently Unemployed . i considered it from the next day of my graduation..so i kept that..because i was in college even after my internship.

    For 25. Im checking yes because I've my tax income tax return for year 2010

    why because?: I worked partime and did internship from jan-aug'2010.. while i was in school and had filed for taxes..of 12k

    i didnt file for year 2011 because i graduated in may'11

    * im just filling it out as it is so i don't get any problems.

    part7: i am adding my assests of 6000 as i've in my savings.

    please let me know if im wrong in any part.

  3. Part 1: Your father is the only joint sponsor. That is correct. He should put down D and you will put A on your form.

    Part 3: Answer yes. Correct. You will answer the same on your form.

    Part 4: That only applies to the petitioner(you).

    Part 6: Do not check 24D. That is only if your father is combining his income with someone else in the household to meet the poverty guideline. For instance if your mother also needed to combine her income to meet the poverty guideline.

    Please make sure that for your household you meet the guidelines. If your mother is in the home and you are the dependent as well as your sibling there will be a total of 5 household members. Poverty guideline would be $40,515 (if you dont live in Hawaii or Alaska). Make sure your father includes his tax return and W-2( or tax transcript ffrom IRS), copy of birth certificate or passport, 3 recent pay stubs, letter of employment. Previous two years are optional but if you feel those will provide further evidence to meet the guidelines go ahead. Can't hurt. Let me know if you have any other questions or clarification.

    for part 6:

    a. his income is 28XXXX.00

    b. wife: income is 11,XXX.00

    c= 40,XXX.00

    i know together combining its 40,XXX.00

    according to poverty guidelines: i just checkedon http://www.uscis.gov/files/form/i-864p.pdf it's $33,762 for household of 5* for considering 125%

    he can give proof of citizenship right, he is the president of the company ,im not sure as of wht he needs to proof for that..i will let him take care of that.

    -- my dad also added assets of 50,000.. i just read on ***removed*** that if we meet poverty guideline its optional to fill

    they're together filing the tax and not dependent so i dont think she needs to fill i864a

    im going crazy :(

  4. For my father's form i've couple of things to clarify:

    part1.D: We checked D.im the only joint sponser ..is this correct..coz im also going to be filling the form as main sponser

    part3: we checked 8Yes for Im sponsoring the principal immigrant in part2

    part4: 20: its No on his form right coz it said petitioner sponsors only.

    part6: my current annual household income: a & b combined to gether in C is $4X,XXX.00 .. so should i check 24.D does she need to fill i864a? ??

    please let me know if anything i need to change..

    Yes the I-864 form needs to be the original but the tax returns, w-2's can be copies.

    I think you should mark unemployed on the I-864 and then provide the date since your last employment. Possibly also mark that you are a student. Your explanation for not filing a tax return I would presume would be because you didn't make enough in any one tax period that required you to do a return. I would only provide an explanation if you wanted to. Essentially you have no income. You're not trying to prove you have no inome, you're trying to prove your father has adequate income to support the household.

  5. I-864A is for when two people in the household are using their combined income to meet the poverty line. If your father makes this amount on his own then it shouldn't be a problem. Remember that amount need to be met for based on the household size(your husband, your sibling, your mom?, and you if you are a dependent on his taxes). You will fill out your own I-864 which will show you as sponsor. your father will mark his as joint sponsor.

    It shouldn't be a problem that you marked employment history as none since you were a student. you are only required to show tax returns for 2011. Other years are optional so I wouldn't add them especially if they don't show you met the poverty line.

    Copies of the tax returns are fine. Remember you need the W-2's as well unless you have the tax transcipt from the IRS.

    *Okay , I understood now :) Me & Father will fill I-864's

    *For tax docs, I was going to send scanned copies but when my husband gathered some info it said this"Each beneficiary of an immediate relative (IR) petition must provide one original signed I-864 and one complete set of original supporting documents" ..So Don't want to take the risk, will've to courier him the docs.

    *So for me, Since i was a student it doesnt matter right, So i don't have to give an explanation why i didnt file for taxes "

    If the petitioner did not file a tax return, then the petitioner must provide a written explanation of why he/she had no legal duty to file the return."

    ok so i will fill in one i-864 form and father fills in another i-864

    1.i dont want to get confused but what's i-864a?

    i've other questions regarding my employment.

    2.When we filed for my husband ,,in emplyoment history we put none because i just did one internship for 4months before graduating and i also did some part time work on campus. it was in 2010. And i think for that year, i recieved tax returns and my employers have filed taxes. Is this going to be a problem when i fill my i864

    3. when going to the interview..does my husband need to carry original tax documents, which i need to send from here.

    I'm a USC got married in november ,,we applied for my husband's CR1 visa in New Delhi,India through DCF in December'11. His interview is on July5th in Mumbai,India.

    I came back to U.S. a month back ,I Live with my parents and younger sibling . I'm unemployed right as of now but will get one soon, hopefully! I want to file i864 through my father as co sponsor. Should we fill two i864 forms or is it different from eachother.. i am above 21 and not dependent but considered as other dependent in his tax claims.

    Also, should my husband take the original tax forms or copies're fine?

    hope to get an answer from any of you

I am actually going on october 5th ,, if the arrival stamp date on the passport applies then it will be 6months for march right?. my purpose of stay will just depend on this process and once in final stage, i plan to come back but if i've to be with my hubby until the final interview/process will stay there,,after the whole process is done i want to come back and start working and plan on bringing my hubby 1-2month after i settle down.

    How long do you plan on staying in India? You will need to reside there for 6 months before you can file. India used to allow people to file earlier- after 3-4 months- but I believe that loophole has been closed.

    Are there any changes in DCF? Is it working and going on ? if so, Am i eligible to go through DCF process at NEW DELHI after the wedding for my HUBBY who's Indian Citizen.

    Should i go to NEW DELHI Consulate..even though we've Consulate in HYD but not sure if they process DCF..??

    If we can goahead with the process , could anyone tell me whats the normal procedure? and when is the good time to start it? Do i've to go to consulate to talk to someone regarding my query and petition at that time.

    (I heard from my family friends that their daughter filed for DCF at New Delhi right after the wedding in march n the interview took plce in about month and her hubby got GC with in 4-5months and they were bck to u.s. in june) I am not sure how this process is taking place now.. if anyone recently went through this there experience or help would be much appreciated.

    i've inquired with my lawyer in regards to brining my spouse here after wedding ,,he wanted me to apply for cr-1 visa after coming back to U.S. but hearing mixed suggestions and opinions that it will take more thn 6months/year.. but have some hope on this DCF process.

    Could you tell me about your whole experience on DCF .

    I'm a U.S. Citizen(i also hold OCI Card) ,, going to India in about 2weeks and getting engaged at the end of October and Married in Nov Last week.

    Am i eligible to go through DCF process - NEW DELHI after the wedding for my HUBBY who's Indian Citizen.

    if we can goahead with the process , could you tell me whats the normal procedure?
