  1. We were at the step of providing Affidavits of Support, and financial documents... But we didn't send anything because of the covid. I have questions, but to put you in the context so you understand, we can not move in US till my 16 yo son is 18 for personal reasons.

Can we pause the paperwork till he's 18 yo? If yes provide me some extra infos on that.

With the covid, is there anything changed in the requirement? Like, will my husband have to go in US to find a job, establish domicile... (He already own a house there, credit card and some bills).

Is a online US work would work?

If we decide to cancel the process of immigration do they refund anything we paid?

It is now so confusing with covid...

    Thanks

  2. I received an email March 7th saying, The national visa center (NVC) has received your approval immigrant visa petition from U.S citizenship and immigration services. Before NVC can schedule your visa interview, you need to complete the following steps:

    Step 1; Pay fee

Step 2: Complete an immigrant visa (IV) application (form DS-260)

Step 3: Submit require financial and civil documents.

My question is, how much time do we have to complete the 3 steps if any? Because with that coronavirus everything is slowing down and I'm scared if I pay the fees there is a limit date to send the forms after.

    Do you have another sponsor?

Is your husband going to keep his job once he moves back to the USA?

We could have a sponsor without a problem but we had heard Montreal doesn't allow it, we have a friend that makes plenty of money in US.

He's working in Canada and his job can't move with him.

    Generally he can either:

    1) Show that he has re-established domicile or

    2) Show plans or re-establishing.

For Montreal it is best to do option 1

Read the last three pages of this thread and it will be clear.

Like I said, establish domicile is not a problem for us, my husband has a house, bank account and credit card in US. My question is about the affidavit of support. Does he really need to leave Canada to find a job or not? I'm reading different things on the forum and it is not clear at all.

Also, can I send my IV before he send the AOS? Or it need to be together?

@canadavisa22 Reading the last 3 pages is still not clear because I'm not talking about establish domicile but AOS. Again you said

many people on this thread who have stayed together and not moved until visa has been issued.

So you are saying here that my husband doesn't have to leave Canada to find a job in US? How would he prove the AOS for the interview if he stay here?

I'm not sure why you say your's will be a test case, there have been many, many people on this thread who have stayed together and not moved until visa has been issued. This thread is to help applicants ensure they have all the documentation to , hopefully, have the visa issued at time of interview.

I don't see these thread, can you explain me? We were told that my husband (US citizen) will have to go back in US to find a job and establish domicile, for the domicile this is not a problem at all but for the job I'm not sure and you said

Are you saying that my husband doesn't have to move in US to find a job before the interview? This is not clear to me.

We have a similar journey... did he work in the USA in 2018 or 2019? If he did, you can submit that as the financial support.  I’m not sure he has to necessarily leave Canada. I’m Canadian and my husband is American... I can be in the USA 6 months less a day in a year.

I don’t think there’s a faster way... at this point we filed in Feb and they’re working on cases from Dec. We’re waiting patiently 😊

No he didn't work in US since 2014 because he moved here not long after our wedding. The US citizen need to return in US to establish domicile, find a job... So he need to leave Canada. When its time your husband will have to leave too, find a job and a place to live.

You can just post your question here and I'll do my best to answer.

I received the email yesterday for the next step, which is pay some fees, complete the IV and send financial and civil document.  If its not clear enough let me know and I'll put more details or explain better.

1- Does my husband really need to leave Canada, go back where we want to live to establish domicile, find a job and send me proof of that to even complete the IV form? Or could it somehow be left incomplete in the section about the job and for him to go at the last month before the interview so we can actually complete it?

Otherwise, without that job in the US, I don't think I can complete that IV form.

We already have a domicile in NC which is his family's home/land and since his father passed away in 2018 his mother put him on the deed as well, he still has his US bank account, US credit card and transfers money from CA to US every month to pay the CC.

2- Once I've paid and sent the required documents, approximately how much time does it take to have an appointment for the interview at Montreal? I read somewhere on the forum that cases were completed and took around 6-8 months to have the interview.

I don't understand how they can treat all cases the same way, there is a big difference between a couple that was together for 9 years and married for 6 and a couple that has only been together for a year.

That is unfair in my mind to require a couple to be separated for months when they built a life together for years with a kid involved (mine not his). Or asking the US citizen to leave Canada and his job than go back in US to establish domicile when nothing is 100% sure his spouse will be allowed to live in US.

3- Somewhere in the US immigration website it said we could have a sponsor, then we learned here that apparently it is not possible with Montreal but he can have a co-sponsor if he doesn't meet the financial requirement, there is no logic to that. link.

4- What are the options, if any? Is there anything we are not aware of that could make the things easier, faster...?

At first when we applied January 2019 we read that it to take around 8-10 months to complete the case and being able to move in US. Now its been a year a two months and we're apparently not even close to being finished.

  8. I have a few questions and one regarding that interview time in Montreal. I received this morning an email asking for fees, complete IV and submit financial civil documents. I'm Canadian my husband American living with me in Canada near Montreal, we are planing to go live in US in his house (we are together for almost 9 years and married for 6 years). I'd like to private chat with some of you that can give me the right information.

    Thanks

  9. So, I'M reading this and it stressed me a little, maybe I read it wrong.

We received today an email from National visa center asking to complete the next step, it ask to pay fees, complete the IV form DS-260 than submit require financial and civil documents (which I'd like some information about if someone has it). After we send that they will give us an appointment for interview ( I read we must have doctor appointment at least 2 weeks before that interview).

My question is, once I paid and send the require documents how much time it takes to have an appointment for the interview at Montreal? Of what I see here it can takes months? Like not only 2-3 months but a lot more?

I'm a bit confuse and it stress me. When my husband came here (Montreal, Canada) 5 years ago it took in total 8 months for him to have his residency, its already a year and 2 months we sent our papers for me to have my residency in US. A bit long for a couple that are together for 8-9 years and married for 6 years. Is that normal?

If you are competent in both English and French you can translate it yourself

I can make some spelling  mistake or weird sentences sometime since English is not my main language but I'M sure I can translate something pretty accurate. How I do that, you have any example? Also my husband is American and he's making sure to correct everything when I need it.

  11. We received a request for evidence. They want my son's (15 yo) birth certificate translated in English. I called the government to have an English copy but since the original was in French I will always receive it in French. They ask for a complete and accurate English translation, how and who do that? I called my notary and they don't do that kind of thing. And I wonder why they didn't ask for mine to be translated too because its in french.

Hope someone can help we clear instruction.

    thank you

Well it is a doctor. As mentioned above it seems to be done less and less.

I am not comfortable to have someone looking there, I have a hell of a hard time with my gynecologist and she's a woman. I don't see the point of doing that if you get blood test... Hope they wont ask for that when its my turn.

  13. Ehhhhh what, external genital exam. Nobody except my doctor is looking down there, wth is wrong with them. They didnt ask to see my husband private part when he saw the doctor coming from US to Canada.

Your receipt number will tell you which centre it has ended up at. If it starts with NSC, for example, you're in Nebraska.

Six months would be early to have heard anything back.

Thanks. Receipt start with LIN. Weird because I saw somewhere it take between 8-12 months before everything is done, I need to look where I saw that.

Edit; When I look at the receipt the bottom left corner it give the Nebraska service center address, so I guess that is the place.

People have done both ways  with success

We sent our IR 5 I 130 packs separately to ensure that one was not overlooked.

    Thanks

  16. Finally we're ready to send the papers I-130(for me and my son). The think I'm wondering is do I put my son's papers with mine in the same package? Or it need to be separately?

    Thanks

Just to add, it likely would not be a couple months, more like 2-4 weeks.

Ah, thats better. Because living separately was very hard for me but more for my son and I can't imagine going through that again. Few weeks seem fine.

    Hi all,

I hope this is in the correct place.

At the end of March I'm moving back into the US (without my Canadian husband) to solidify my domicile and to just get things prepared for my  immigrant hubby.

I'm driving a Uhaul and towing my car behind.  I've been in Canada for almost 5 years and 99% of my belongings I've owned for over a year.   I've itemized every box I've packed, gotten the EPA letter for my vehicle.  I'm still feeling incredibly anxious about the move though so I'm wondering if anyone else has any tips or pointers that has been in the same boat?

    Thanks!

How did that goes? I'm Canadian and my husband American. We are planing to move in US but looks like its not that simple with immigration....
