  1. Hello,

    My husband(from UK) and I got approved in December for his green card. I recently just received a massive pay cut (thankfully after being approved..) and my boss is not really giving me hours anymore. All in all, we're facing some pretty hard financial times especially since he is still unable to find a job hiring. Due to this, I applied for food stamps on my behalf; it asked for the total people in the house so I did have to list him, but I put him as "no" on receiving benefits since I realize that would be very bad.

    However, I just received mail stating it wants his alien status (Passport/immigration documents/entry date/SSN) etc. Why on earth would they need these if he's not going to be receiving benefits in the first place? I'm now very scared that this could somehow effect his green card. I'm having a hard time with the amount of hours my boss has given me so food stamps would be a great help at the moment, but I can't risk his immigration on it.. Has anyone experienced this before? Is it okay to provide the information without altering our long journey to get him here?

  2. They want to see them to make sure you're a good citizen and filing you tax returns every year.

    They might want an explanation why you haven't filed 2010 (not required to file because of low income) but I'm sure will judge your ability to support your fiancee based on your current employer's statements, not previous years tax filings.

    Good to know. I'll type out a explanation for the 2010. Since 2011 taxes have already passed, should I try to get a hard copy of it and send it to my fiance? My hopes were that it would be redundant anyway due to the letter.

    I have a question regarding tax returns and hoping this is the right forum to post it in, as I believe every country does it a bit differently. I started working in late 2010 which made my income only about ~$3000, to which I didn't file a tax return as it wasn't required. Last year I didn't work for 2 months as I was in the UK, and moved jobs around quite a bit and my total income unfortunately was around $10,000. My tax return was barely $400 for 2011. Now obviously this is a concern because it nowhere near shows a good stable income. I'm wondering if the UK embassy is very hard on tax returns and actually requires them, even if I have a letter from my current employer stating my income and eventual raises? I'm at the $21000 at the moment, by July it'll be $24600. The interview will be coming up soon and I do not have a hard copy of my taxes this year, as I had thought my employer letter would be sufficient, but I'd definitely appreciate a second opinion. A co-sponsor is also not a option regardless of any of these circumstances.

    Oh, another quick question too:

    How soon is everyone getting interviews after the medical? My fiance just went for his and they had said everyone was getting their interview within 2 weeks, and I wanted to see if anyone has found that accurate or not.

  4. They photocopy your police certificate at the medical and give it back to you to copy and take to your interview. I dont know why the DS156K tells us this info. Its kinda confusing.

    Yes, you dont need to post the I134, letter of intent or birth cert. Take them with you to your interview. I posted my packet 3 out the day before my medical and I put my medical date on my cover letter. Id wait until you have your police cetficate until you book your medical. Sometimes it can take a few weeks. Mine only took a week though. You can usually get a medical date within a week of calling them so the wait isnt too long.

    Thank you for the information! It does seem odd the DS-156k specifically says "The following documents must be attached in order to apply for the fiance visa." but apparently they really do only want the forms. The only next step we can take is to go ahead and get the police certification sorted and then file for medical then. Thank you for clearing that up. Since we will need to wait a bit for the police certificate, will that hinder us at all for the visa? "The failure to return the forms promptly will delay the processing of your application." I assume is just them waiting on us to do it, it doesn't actually delay anything once we do send it in? From what it looks like we kind of delayed our process by 2-3 weeks because the packet 3 kind of snuck up on us.

  5. You take the police cert to your medical aswell as your interview. You need a photocopy of it for your interview aswell. Only take your birth cert to the interview. Dont post it with the forms. You take the I134 to your interview. Do not post it with your forms.

    DS-230-Part 1, Form DS-156 x 2 copies, and DS-157 x 2 copies, DS 156K, DS2001 and your cover letter. Thats all you need to send for packet 3. All documents need to be taken to the interview with you.

    Does that mean I need two copies or do they not need to have the police certificate with them on file for the medical? I'm glad to know this information as we would've sent out the I-134 and and birth certificate in mail. Just to clear up my confusion towards this, why does the DS-156k specifically request these things if they don't actually require it until the interview?

    So just for final clarification, I don't need any of the documents such as proof of evidence of letter of intent or I-134 or birth certificate. They're taken to the interview and not sent in the mail. So we can go ahead and send out the DS-230-Part 1, Form DS-156 x 2 copies, and DS-157 x 2 copies, DS 156K, DS-2001 and cover letter tomorrow with nothing else and then schedule the medical? Or schedule it beforehand to include the date in the cover letter? If we don't already have the police certificate, would it be wise to go ahead and schedule the medical since it may take a bit to schedule it and then receive the police certificate within that time?

    Apologies for so many questions, just want to be sure we're getting this right.

    Send these forms back to the embassy ok DS-230 ParI, 2 x DS-156, DS-156k, 2 x DS157, then book yourself for a medical either at Knightsbridge or Bentnick Manisons. You will need your vaccinations records for your medical exam so book an appointment with your GP to have them ready. Have your Police certificate ready as well a passport photo size and your passport to take with when you attend the medical exam. Then you write a cover letter to the embassy informing them that you are ready for an interview, state when you have had your medical exam or when is booked for plus incude when you plan to marry your fiancé and add your address and contact info with da DS 2001 ok Hope this helps good luck and plus if you need help always ask becoz there are great people on this site who have more knowledge and are ready to help ok

    So if I go ahead and send those, for the DS-156k, I do send the i-134 even though they didn't specifically request it and the birth certificates? As well as the police certificate since it also requests that? Or is the police certificate only for the medical, and if so why is it wanting it in the form DS-156k?

    Normally when it comes to copies of birth certificates, I believe notarised or certified copies are preferred but I may be wrong

    I took a look at it but there wasn't really any information directly answering my questions. It does help for the photos though. Do I sent in the birth certificate with the other forms as well since it asks for it in the DS-156k or just the form and then bring it in with me to the interview?

  7. You wont send the medical results. Knightsbridge will send them to the embassy for you. it usually takes a few days. you dont send any documents with the forms. just send the forms themselves and take the originals to the interview.

    The evidence of financial support is the I134 and any supporting evidence like tax returns, employment letter of the sponsor etc.

    For the interview, you need your birth cert and a copy, same as your police certificate.

    I cant answer about your financial amounts but Im sure someone will.

    Do we go ahead and schedule a medical then? Or wait until they receive the forms? If we do go ahead and send in the forms, do we also then send in the DS-2001 or wait until we have a scheduled date for the medical since that's required?

    Pertaining the question of documents, it is required to send additional ones besides the one they require then such as I-134? The DS-156K (http://www.state.gov/documents/organization/82063.pdf) states that we do need additional documents besides the forms they requested. Part of that is the birth certificate, 'evidence', etc. So back to my former questions, do they require originals of these additional documents or to send copies and bring originals to the interview?

    Wasn't aware this was specific to any embassy, more so that it was just general question in regards to clarification of what they're asking for as it's unclear to me.

    Preparing to send out the packet 3 but have a few questions first.

    • The packet 3 letter we received says, "An appointment for your visa interview will not be scheduled unless we are in receipt of forms, DS-230 ParI, 2 x DS-156, DS-156k, 2 x DS157, checklist DS-2001, and received the results of your medical examination." From our understanding, they want us to send in these forms and also get the medical to them. However on their site they linked us to (http://london.usembassy.gov/iv_15.html) the steps 1 & 2, does that mean we don't send the forms out until we already do the medical?
      I'm very confused as when I had used the K-1 Flowchart as a reference, for the packet 3 it says,
      "This will be sent out within a week (typically less) from when the embassy processes the received petition. This package will include a checklist of items and paperwork that must be collected. Some will be sent back asap, and others will be sent back later or brought to the interview."
      "Attend medical appointment. Some embassies require the medical the same day as the interview. Most require the interview to be done ahead of time and have the results sent to the embassy directly from the doctor."
      So does that mean we don't send the medical examination with the packet 3? Or we send out the forms and then the medical exam can be send out later, and then we send the form DS-2001?
    • DS-156k: "Evidence of Finacial Support," does this mean the i-134 or a letter from my employer? Or both?
    • DS-156k: "Evidence of Engagement to your Fiance," does this mean the letter of intent that we also sent for i-129f?
    • Do they require a original birth certificate or a copy? A copy was sent in of the petitioners for i-129f, is a copy okay for packet 3 of the beneficiary?
    • Do they require originals to be sent in with the packet 3 for documents, or do we send copies and bring originals to the interview?
    • In a previous thread, someone mentioned that tax returns are not required if you have a letter from your employer. Is this accurate?
    • As far as tax returns go, I did not work enough in 2010 and made under $3000. I filed my 2011 taxes but I only made $10000 last year, so it'll show up low. Will a letter stating why be enough or will this hinder me? My current annual income is $21840 and I have around $8000 in assets. A co-sponsor is not a option.

    I've got a few questions regarding annual income, tax returns and assets. For the annual income part, the amount they're looking for that's 125% above poverty line is before tax correct? So if the minimum is 18,333 for 2 people, that's before taxes and what not? Secondly-- My current job I work is 40 hours a week, at the minimum wage of $9.04 an hour-- this adds up to be 18,803 or did I do my math wrong? Before I used a online calculator I wound up with 17,357 before tax. Do I meet the requirements with my income?

    The next question is about assets and what they cover. I'm currently going to invest with Russell Investments of about $8,000, will I be able to somehow show this as a asset? If so, what paperwork would I need to show for it? I'm very new when it comes to handling assets/investments.

    Lastly, tax returns. I never filed for the year of 2010 as I had made under $3,000 which from I researched, meant it wasn't required for me to file. I'm going to be doing my tax return for 2011 as soon as I get all the documents since it will have been my first full year of working. Do I need to write a reason for why I never filed for 2010 as I had just turned 18 and started working, or would my 2011 taxes be enough? Another thing to consider as well though is I might not get my tax return before his interview. I'm expecting if all goes well the visa will be approved by the beginning of February, since we filed late September. If he got his interview before I received my tax return, what would I do in that case?

    I'm currently going through the visa process right now and my finances are looking pretty tight in terms of meeting that 125% poverty level. Right now with my current job I wouldn't be meeting it by $1053 annually. I've read that if you have assets equal to x5 what you're missing ($5265) that it can be used. However I don't have nearly anywhere near that money except for my trust fund. This trust fund was set up by my grandmother and is approximately $10,000. Half of it is currently invested and the rest is just sitting in the trust fund account, or so I assume.

    My question is this, if my grandmother currently has ownership of the trust fund but it might also be in my name and will get full access at the age of 21, am I somehow able to provide this to the USCIS? Is a trust fund even considered a asset since it's not in a savings/checkings account? Would it have to be entirely in my name or is her name on it but saying it's entitled to me with her permission enough? I unfortunately don't have any family members that are willing to co-sponsor and my income isn't sufficient, so I'm looking at all the options right now. ):

    Another note is the tax return-- I only started working late November 2010 and thus never was required to file a tax return because I made under $3,000. At least, this is what I've come up from research. Seeing as how I never filed and I didn't work in the past, I don't have any tax returns to provide. If I wrote out the reason to this is it enough even though I did technically work a very short duration in 2010? I don't have my W2 and they were both short-term part-time jobs.

  11. Hi all! :)

    Just joined after stalking the website for quite a few weeks! I sent my 129-f package on the 21st and just now noticed 3 things. Figures after I sent it 2-3 days ago! Hah. ):

    Firstly, I only included boarding passes and pictures of us together with dates on the back. I did include a passport photo but it unfortunately didn't dawn on me I should scan all of the pages, is this something that could be a issue given the evidence I've already submitted?

    Another is with the G-325a form, I made a mistake that I just caught by looking at the scanned version. I misunderstood what it said with, "City and Country of Residence" for my parents and had put "N/A" (thinking it meant the current residence) for my father and somehow that's all I managed to put. So for that entire box it just says "N/A"! Can't believe I missed that..! I think I kept checking so many times over it that when I saw a box filled out I instantly looked elsewhere..

    The last matter is with my birth certificate. It doesn't have my fathers signature as he wasn't there, and there was no back to it at all so I said so in the cover letter and.. put a sticky note on it just in case. My mothers signature has also faded a bit.

    Would be grateful for any opinions on this matter, I wasn't sure of the seriousness for the things that I described that would cause a RFE.
