  1. It's a long way away. You cannot petition for the brother. Hubby must do it.

    Once your husband becomes a citizen he can petition for his brother. The wait for siblings is currently around 11 years after petition approval.

    In your case he's got to have 3 years of GC status to get to citizenship eligibility. Assume he gets citizenship as soon as possible, that's late 2015. Then he petitions for the brother. Who knows what the immigration policies or the wait will be then.

    Oh WOW!!! Definitely NOT what I wanted to hear... A couple of follow up questions if you please...

    1) So there is no way that once he receives his green card we can start the process to bring him over?

    2) Is there any other way we could bring him over and then assist him in getting the right to stay...say for instance like a student visa?

    3) Can you point me in the right direction where I may be able to find the guides which will walk me through the process or give me advice on how to further proceed?

  2. Hello All!

    I brought my fiance over from Nigeria on a K-1 visa. After he arrived we married and immediately started the AP/EAD/AOS process. He has since been approved and received his EAD/AP card. We are still waiting for the AOS decision. According to my calculations we should have an answer around August sometime...

    This is my question... How can we (My husband & I) petition to bring his older brother from Nigeria to the states. Any advice or guidance in the right direction of info is greatly appreciated.

  3. My now husband entered the US on a K-1 Fiance visa December 31, 2011. After marrying Feb. 11, 2012 we filed for AOS/EAD/AP on Feb. 28, 2012. He has just received his EAD card which states he has I-512 AP status at the bottom of the card.

    After calling USCIS the other day, I was informed by the customer service rep that he has the ability to FREELY travel back to his home country of Nigeria for a short stay as long as he takes this card with him and the card is ALL he will need to be able to go and then "Re-enter" the US after his trip.

    We are still awaiting approval of the AOS application and he needs to travel back to Nigeria to take care of some family business. This is my question... Is it safe for him to travel there KNOWING that he will be able to RE-ENTER the US 4 weeks after his departure with NO PROBLEMS. I am extremly worried that something will happen once he gets back to Nigeria and they will not allow him back in the US or to leave Nigeria once he leaves since we are still in the "Awaiting a Decision Phase" of AOS.

    Any and all assistance with this would be greatly appreciated as he already has his ticket and is planning to leave on Tuesday THIS WEEK... Sorry in advance for the late post but it was only till now when I started worrying about getting the wrong information from USCIS that I thought I better seek further advice :wacko:

  4. Thanks so much for the quick reply. I just got a text message from USICS few mins ago telling me that my AOS application has been sent to local office for processing. I also called the UPS and was told that i do have a mail waiting for pickup. I'm hoping it is my Biometrics appointment. Will go and get the mail tonight. I'm crossing my fingers.

    By the way, do you have any idea where they're sending my docs for processing? I am based in Orlando, FL. Thanks a lot again! yes.gif

    Hmmm... Not really sure to tell you the truth... Just looking at the USCIS District offices here on VJ under Processing times it says they have local offices in Florida in Hialeah, Jacksonville, Kendall, Miami, Oakland Park, Orlando, Tampa & West Palm Beach... So I would think they will send it to the one that is the closest for you to get to... Is simple for me... My state is smaller so really not too many to choose from... Just be patient and you will soon know... We are having to travel 2 hours to Charleston, SC for Biometrics but as I said there are only 2 here in our state so is pretty simple for me... Hope this helps and you soon get your appointment ;)

  5. hello there! i just want to ask you exactly how many days did it take for usics to mail u ur biometrics appt from the date you submitted ur aos application? they received my application 29th feb, received 3 noa1 two weeks later and until now i still haven't received biometrics appointment yet. i've called uscis customer service numerous times but kept telling me the same thing - wait til it's 30 days after submission before i call them. i'm starting to worry. i don't want to miss my biometrics appointment. any advice?

    I mailed my AOS Feb 28th and did not receive my 3 NOA's till March 12th However the NOA date was March 3rd... After receiving my 3 NOA's it was about a week later that I did receive my Bio appt... I dont think USCIS can really give you an idea of when you will receive it as it really depends on your local office, how busy they are and when it the first available appointment they have... Try and be patient... I know is hard but surely it will come soon :thumbs:

The only time any sponsor answers "no" to this question is if there's a principal immigrant and one or more derivatives, and there's two joint sponsors splitting the immigrants between them. One joint sponsor would be sponsoring the principal immigrant, and would answer "yes". The other joint sponsor would not be sponsoring the principal immigrant, and would answer "no".

    Part 6 of this same form #24 asks about

    B: "Income I am using from any other person who was counted in your household size"

    **Since I live with my Joint sponor... I counted them in my household size

    1) Do I list them here since I rely on them in whole for my income since there income is what supports me as well?

    And if that is the case then...

    2) Do I check D since I am including their I-864 as well?

    I am starting the AOS process and need a bit of clarification...

    When I originally filed my K-1 visa application I had to use a co-sponsor... As such, I filled out an Affidavit of Support on behalf of myself (even though I am not working and was relying SOLELY on my co-sponsor)... In addition to filling out an Affidavit of Support using my co-sponsor's info...

    This is my question... Do I need to AGAIN submit 2 Affidavits of Support... 1 with MY info & 1 with my CO-SPONSOR'S info?

  9. They can file an I-129F petition without meeting withing the last 2 years under 2 conditions

    1: The requirement to meet your fiance'(e) in person would violate strict and long-established customs of you or your fiance'(e)'s foreign culture or social practice. OR

    2: It is established that the requirement to personally meet your fiance'(e) would result in extreme hardship to you.

    Hmmm... thank you but now wondering HOW they can prove one of the above circumstances OR if they would even be REQUIRED to prove this?

    So I am seeking advice for a friend that is in the process of doing a K1-Fiance Visa. She is still in the inital USCIS stage so that is why I am trying to verify what she needs to do in preparing for the Naija Consulate.

    I know from personal experience that she will need proof that the relationship is genuine. I also know that typically evidence consists of phone records, photos taken together and with family and friends while visiting in Nigeria and messenger chat logs. This is my question... What can a person do to stregthen their case if they have phone records & chat logs but no photos as they have not met face to face yet?

    The reason I ask is cos I KNOW that Nigeria is one hard Consulate to go through and I want to help prepare her as best I can considering she is already got "A Strike" as I would say against her for never visiting him in his home country yet.

    ANY advice or guidance is greatly appreciated... Thank you in advance :)

Dont worry yourself about any denial follow the AOS guide here on VJ and u will be fine...there is a possibility you wont have to have an interview during AOS (we didnt) Also wait until he is here for at least 2 weeks before you attempt to get him a SSN. There is also a link on here on getting SSN...Good luck to you and stop worrying the hard part of being approved is over :)

    One more thing if you please... I notice in your AOS timeline you make reference to a csc... What is that? Thanks again Patient :)

  13. You got your steps correct.

    As to answer your second question, yes it could be denied. So you have to proof that your are in legit relationship. You have to start collecting evidence again that will proof you are living together like: lease in both names, bills, joint bank account, health insurance, driver license to the same address, joint live insurance, car insurance, joint car loan, etc... in this matter. All those evidence would need to be presented during the AOS interview.

    So for clarification... IF denied does that mean he will be required to return to his country or are there OTHER things we can do to appeal the decision IF it is a denial?

    So I am new to THIS forum as I have spent MOST of my time in the K-1 Fiance Visa forum, but we have passed that stage now. I am trying to wrap my head around the AOS process and ANY & ALL info is greatly appreciated.

    At this point, My fiance has been approved and just arrived in the U.S. I have been looking over the VJ Guides and see that according to them we will next get him a SS card, get the marriage license, marry and then start the AOS process... Is this correct?

    I was also wondering after reading the guide IF when we go through the AOS process is there a POSSIBILITY that he could be denied or rejected? Meaning... is there a possibility that at the end of the AOS process he could be denied and made to return to his country? OR is the AOS process just a formality that we need to go through to complete him arriving and getting ready to work and stay permanently?

    Am just wondering and trying to set my mind at ease and free to know that the "Hard Part" is over... If there is such a thing...lol

    ANY ADVICE OR GUIDANCE ANYONE CAN GIVE IS GREATLY APPRECIATED

  15. hello everyone.For those out there who have received packet 3 and 4, pls did u get ur email from SMARTcore. i was a bit confused cos i sent an email about 2 days ago requesting for a date and got this email from SMARTcore with attachment that refused to open and has a virus. even the email said that my interview is rescheduled( i have not even gone for a 1st interview!)

    pls are there people out there who can help with more info. I was approved nov 25th. NVC received on nov 17th. or am i being too eager. PLS HELP !!!

  16. Good Morning VJ family! My husband went for his interview today in Lagos, Nigeria and All Glory Be to God...he was approved. My journey is not ending as we still have to get visa IN HAND and my hubby still wont be here for a few months then the real journey will begin. I just want to say thank you to all the VJ family as I have learned a lot from each of you. I want to thank everyone for sending up their prayers for my husband and me. I especially want to give a "shout out" and special recognition to my Nigerian sister...LAGOSLOVE. She is an angel that reached out to me. We corresponded via VJ messages as well as via phone. She gave me a lot of guidance and sent up a lot of prayers. She is kind and caring and immediately took me under her wing. Tisa (LAGOSLOVE) thank you so much. Words cannot express the appreciation and respect that I have for you. You are a beautiful woman and I can only pray that one day soon, we can meet in person.

  17. please, i dont know how to print my conversation history from yahoo messenger. Another problem is a lot of this messages as to do with us talking about sex. Can i still present them at the embassy. thank you all

    When I did my Yahoo Messenger chat logs I copied and pasted them to a document so I didnt have to go in and print every page individually...That way when I was finish I had 1 document I had to print of...it was a LONG one mind you but I found that to be much easier...It also allowed me an ability to have my document looking much more organized.

    As far as the sex talk... in my opinion and personally, I left some of mine there. I mean after all that is a "Normal Part" of a relationship so I feel why should it be aby different when we are in just seperate locations. But then again that is just my opinion...Good Luck

    So with that being said... Do you feel it is even necessary for me to submit my tax documents since I will have a Co-Sponor that will submit PLENTY of supporting documentation.

    This is the problem... I am not able to get a letter of where I was living and the fact that it was in exchange for room & board in hopes of helping to EXPLAIN why my income on my taxes is so low. So at this point if I can't get a letter I am worried of how I will be able to prove ONCE I DO submit my taxes with I-134.

    So now I am thinking maybe is better for me just to fill the I-134 and send NO supporting documents like taxes of my own. That way they never see and there is never a question as to why income for the year was so low, but I am not UNDERSTANDING what the Naija embassy will ask for from the petitioner if you are unemployed and using a co-sponsor...

    Please am so confused on what to do...Any feedback will be greatly appreciated

    Docs show strong on-going relationship.i am sure u know the basics.

    Y the ? Abt who footed the air bill is related to a vj member,who the C0 questioned the petioners various trips,even when she wasnt earning much for such trips.

    Yes, I remember the post for the Petitioner toook multiple trips to visit. And my Co-Sponsor makes MORE than enough to show he will NOT become a gvt. liability. Not really worried about the proof either of a strong relationship as I have hundreds of pages of chat logs and phone bills with thousands of dollars in phone calls.

    I visited Ghana 1 time as my fiance was working there when I visited. When I visited I stayed there with my fiance for 3months...Feb2011-May2011... I graduated from college and before moving to South Carolina, which is where I live now, I visited my fiance there in GH for 3months then returned to the states living in South Carolina.

    The money I used to travel there to meet my fiance and live there for 3months was from money I had saved over my years in attending college,working and saving money... why does that matter?

    I know I need a co-sponsor to even make it happen I am only wondering WHAT ALL I NEED to send to my fiance so he will have EVERYTHING he needs to take care of businees the first time and not be REQUIRED to bring back more info at another time unnecessarily
