My husband sent out for both his EAD and AOS over two months ago. His biometrics appointment was on July 11th and his EAD was approved without any further inquiry on August 15th. My question now is how do we know if he will have an AOS interview or not? I know we will receive a letter if he has an interview but does he get a letter if he won't have an interview. If so when should I assume we would receive either letter. Thank you.
I got approved without interview Sometimes it happens. I M K1 Visa holder.

I would say put your constant address on the mail. When me and my husband filed for my visa or AOS we put his families address, because we are renting and we could move from one place to another.

I applied in August and still pending. they just are not fast. it is been more than 7 months and it is really tiring. Just hang in there and wait, but you can call them to make sure they didnt forget it.lol
Hey guys! We sent in our AOS paperwork in the beginning of January, have our NOA1 date January 7, and haven't heard back so far. Moreover, my status on USCIS website is still "Acceptance". Do you think this is okay, or something needs to be done here?
Thanks,
N

It should be on her/his visa and it is different from case no. the A number is given when you approved for a visa.
Is the alien number defferent from the case number and if so where can i find it? who has assigned it? And how many numbers does it register?

Thanks!!!

USCIS should have sent you interview letter, and on the letter would be a list things to bring.

Hey Guys:)

Would you guys help me prepare for interview? I have no idea what to bring on the interview day.

You can because your I-94 is not expired. And i was working on my driver licence too but my I-94 was expired and they said not until i change my status. SO you are 100% safe.
Thanks for your reply!
So I called the DMV back (a third time) and spoke to somebody else, and they said that all they need is the I-797 and they can extend it.
So - to all you Minnesotans on AOS - an I-797 is enough to keep you driving.
Damn! Guess my dh and I have to renegotiate "designated driver" responsibilities!

Thanks. I have joint sponsor who meet the poverty line, but since we have to send affidavit from petitioner also and he doesn't meet the poverty line and that means we don't need to fill asset part?
Only if you're under the 125% or you just want to make your case stronger. Otherwise there's no need to complete it.

do we need fill the part asks about assets on affidavit support?

Related to tax return, can we send only the recent only 2011 tax return or we have to have 3 years tax return?
Thanks
If your spouse makes enough money, why bother putting your income on there? I say, simplify whenever possible.
Have you looked at the I-864ez form? If you qualify to use it, you might find it easier. And you only have to send the most recent tax return with that one, the others are optional. We used the I-864ez and had no issues. Just a thought...

What evidences i have to send with the package?
I just filled my previous last Name, that means they can't change my last Name for my Green card?
Just fill out the AOS paperwork in the married name.

Last Name
What type of name change? Maiden to married name or a totally different name?
-
How can we apply for name change while we are sending AOS forms?
-
Can I send the same affidavit support i used for my k-1 visa or i have to have a new one to send with AOS?

Yes. Send a copy though, NOT the original.

WHAT IF MY NOA2 IS EXPIRED ,so i can still send it with my AOS forms?
No, but I urge you to do so. Why? Because it is 1) free, and 2) you may never know when you would need it. There are too many stories on this board of the immigrant's parent or relative becoming deathly ill back home, and had they applied for AP, it would be approved and they could visit. But, since they did not apply for AP, they cannot go.

Do i need to fill out the I-131 form for AOS?
Thanks,-Kidist

Thank you for the response, but how much it costs to file AOS?
Just so you know, you are out of status with an expired I-94. What that means is you are accruing over-staty days and should you reach 180 days before filing for AOS/AP/EAD the AP will not be of much use. Also, if you find youself near our southern boarder and get pulled over by a CBP SUV doing random checks (I've been told that you do not have to stop for them but how will you know it is CBP or State Trooper unless you passed them and see the side of the SUV?) and they run your immigration status, you can be detained for the expired I-94 which will be an unpleasant experience. So I would file the I-485, I-765, and I-131 together in a single packet and pay the filing fee for the I-485 (which was $1070 but you should check on that).
Good luck,
Dave
