I would like to bring my nephew to the USA. I am a permanent resident. His parents who are not married are giving him up for adoption since they cannot take care of him.

Yes, we paid the additional biometrics fee.
Thanks, for the info. I will send it back.

Our I-751 was returned along with our check with the comment that my wife's (K-1) dependent child (K-2) must file a separate I-751 since she acquired conditional status prior to her mother.
This seems to be clearly not the case. My wife's Green Card was dated 08/22/12 and her daughter's was dated 08/31/12.
Am I missing something here?
Thanks for your comments.

I paid CGFNS extra money for expedited service. This was 5 months ago and my daughters credentials have still not been approved. She graduated from Cebu Normal University in Cebu, Philippines. Seems CGFNS has asked Cebu Normal University for a breakdown of her Gynecology education between Gyne and midwifery. Each time Cebu Normal responds CGFNS determines their response to be inadequate and they send another request for the same information. (They ask the same question and expect to get a different answer-DUH!!! This has gone on three times now. We call CGFS to get clarification on what is a proper response by the University and they are no help at all. All we want is to be able to help Cebu Normal with their response. I am willing to pay for my daughter to fly to Cebu to help Cebu Normal with their response. I envision my daughter being ready for retirement before she is approved by CGFNS to sit for the NCLEX.
Does anyone have any suggestions???
Thanks for your help.

My wife's daughter arrived in the USA on April 17, 2012 on a K-2 VISA. We applied for her AOS on April 25th and the application was received at the USCIS Chicago Lockbox on April 27th. It is now May 7th (11 days later) and our check has still not been presented to the bank nor have we received an RFE.
We are concerned that she may "age out" since she will be 21 on July 24, 2012. My question is do we need to be concerned that the packet is being returned or rejected for some reason?
Thank you.

As long as her daughter entered the US before 21, she will be ok. That is the key point. She can apply for her AOS. She will no longer "age out". That issue was put to bed last year with a ruling from the immigration board. I am assuming she entered as a K2 ?
Yes, she came in as a K-2.
Thanks for the information.

I married my K-1 when her daughter was 20 years old. The daughter will file her AOS three months before she is 21 years old. Am I correct in believing that she will "age out" if USCIS does not approve her AOS prior to the date she turns 21?
If she "ages out" does she have to return to the Philippines right away?

Am I correct that a K-2 who files for AOS prior to reaching the age of 21 will not "age out" even if USCIS does not approve her application before she turns 21 years of age? It seems to me that her age freezes on the date she files for AOS.

*** Moving from AOS from Work, Tourist... to AOS from Family visa as OP's question is about a K2 *****
OP, what is your definition of "right away"? Keep in mind you need to get married to mom, then file for AOS before any AP, even emergency, can be approved...
Mom is here, married to me and her AOS has been filed.
Thanks

My wifes daughter will need to return to the Philippines ASAP after her arrival here in the U.S. under a K-2 VISA. The reason for her return is to continue her studies for a Nursing License. She will graduate from college as a Nurse in March 2012, come to the US right away, file for AOS and hopefully return to the Philippines right away to complete a coaching course to prepare for the license examination in July 2012. She cannot wait until July 2012 to arrive in the U.S. because she will "age out" in June 2012. My question is, is the need to return to the Philippines to complete a course to become a licensed nurse a valid reason for an emergency advance parole?

We went to the Social Security Administration today (December 28, 2011) to apply for my K-1 Wife's Social Security Number. We had all the necessary documents including the marriage certificate. We were told that the Social Security card would have to be issued in her name as shown on the VISA unless we first changed her name to her married name by recording our marriage certificate with the Department of Homeland Security. My questions are these. One, is this correct and two, how do I record our marriage certificate with the Department of Homeland Security?
Thanks for any help provided.

My fiancee completed her interview with no obvious problems or requests for additional information. The CO told her all her documents were inorder. He did not say she was approved or denied. She was sent to the last window and was told that her case would be administratively processed and if there were no problems the visa would be mailed to her. It has been four weeks now and no visa or requests for additional information. Anyone have this experience? It seems there must be a problem but I cannot figure out what it is. We have a well documented two year history with many visits to RP. Neither of us have any background problems or bad history. I have more than adequate income to support her. Is there anyway to find out what the problem is?
Thanks for any help.

When my fiancee made her interview appointment online she received an e-mail notice saying to bring the CEAC Confirmation Letter with her to the interview. We don't know what that is. We have never received the packet from the embassy so I suspect it is in there. My question is: Will there be a problem if she does not have it? Her interview is tomorrow.
Thanks

We have received the NOA 2 and the letter from the state department with the case number. I called the state department and was told the file had arrived at the embassy in Manila and packet 3 had been sent out. This was 10 days ago. My fiancee is having her medical next week. My question is can she schedule the interview online or by telephone now or does she just wait for packet 3?
Thanks to all.

Uh, I hate to act stupid, but.... How do we schedule the interview?

I just noticed that St Lukes medical exam rules says that women of child bearing age cannot undergo their examination until one week after the last day of their period. Does anyone know if this applies to a K-2 applicant 20 years of age?
Thanks to all.

My fiancee lives in a province where there is no BPI or Bancnet to pay the interview fee. My question is can she fly to Manila and pay the interview fee and take the medical examination the same day without an interview appointment letter?

how old is the beneficiary? Are they married?
She is 49 and we are not married until she arrives in the USA. Also, the daughter is not married and has no children.
-
Does anyone know of any reason why a 20 year old daughter of a K-1 beneficiary would be denied a K-2 visa? I have heard that older children could be denied because they are too close to the maximum age of 21.
Any information would be helpful.
Thank you.

My wife, a green card holder who came here on a K-1 VISA 4 years ago would like to bring her unmarried 29 year old son to the U.S. He has three children by a Filipina in the Philippines who has possession of the children. My question is will his children prevent him from immigrating?
