    you should be fine. but its highly recommended to stay in the us till you receive the gc.

     

    what is your dq date and when did you receive your Interview letter? I am waiting on my wife’s interview letter.

    Presently she is in India. She should get her Green Card stamped on her Indian passport in about few days from consulate office.

    1) We need to pay the Green Card Fee upon entering into the U.S or in advance before she takes her flight. I can pay it ahead.

    2) She is making a trip to U.S in the month of June 1st week 2021. Let us say after she entered into the U.S, I can submit the Reentry permit along with the fee with in few days.

    3) My understanding is that she can even leave next day or whenever she decides leave is fine.

    4) Everyone said she will get a letter to take the biometric test as part of her reentry application submission. (She just now completed her biometric in India to get the Green-card in the month of  March 3rd week of 2021), why should she has to get her biometric test again to get the reentry permit, is that the norm?

     

    5) Example: Today is April 7th, 2021. Let us say, She enters U.S on June 10th 2021, apply for reentry permit on June 15th,2021. Leaves U.S on June 30th, 2021.

     

    Can you guys explain a scenario, if they did not call her to get a biometric test for reentry with in 6months while she is in India ( Let us say she stays in India from June 30th, 2021 until January 2nd, 2022). I am trying understand the consequences? 

  2. Hi !, U.S Consulate in Mumbai approved my Spouse Greencard on April 5th, 2021.  I am an U.S Citizen) . She is planning on coming to the U.S in about 2 months, sometime in June 1st week of 2021. She wanted to stay with me for few months and need to get back to India due to her extended family situation. The question is can he apply reentry only after she entered into the U.S? Once the reentry process started in the U.S, does she have to wait until her reentry permit gets approved? What happens when she leaves and reentry approved while is India? Is it acceptable is it valid only after it is approved she has to leave?

     

    Please shed some light on this

  3. 1. Can we apply for removal of the condition on the green card while she is outside U.S?

    2. She is unable to make her residence as U.S due to her family situation. She stays in U.S few months in a year and rest of the time she had to be there in her country to support her daughter and family.

    3. She wanted to give back the Green card and get a multiple entry visa to come to U.S to stay with me for those few months. Is it possible to exchange multiple entry visa for green card. She has no desire to work here in the U.S

    Any help would be appreciated.

  4. She went to India on Advanced Parole on April, 2012. She came back to US on August 2012. With in few weeks she got her green-card on August 29th, 2012 (K1-AOS-greencard) .

    Here is the deal. She will be leaving to India on Nov 15th, 2012 until September 2012 to be with her teenage daughter helping her to graduate from her High School and send her to the college. Lots of preparation, support, be there to see her heads to the college. Right now her parents taking care of the kid. Her question was, does need to come back in between 1 1/2 months in April, or can she come back in Sep for good to U.S once her daughter settled down in the College? Or does she need to apply for reentry permit? What is the deal?

    Please advise us.

  5. My wife's I-131 approved on March 30th, 2012. Today it is April 5th, 2012. She has not received the paper work till today. She is going to her home country for a visit and leaving on April 7th, 2012. What happens if the physical approval letter did reach before she leaves?

    I have the following questions.

    1. Do they ask her I-131 APPROVAL notice at the port of exit (New York)?

    2. Do they ask her I-131 APPROVAL notice at the port of entry when she comes back to USA on June/July?

    3. How does it work? Please explain in detail.

  6. Hi I came on a K1 visa and married my fiancee within 90 days and filed I-495, EAD and parole. I received EAD and parole. Few days back USCIS has sent me a letter initially that my Application to register permanent residence has been transferred to California service center. Now they have updated Case status again on USCIS website saying that :The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now being processed at a USCIS office.

    What does this mean! Interview coming up

    I heard recently that anyone who comes on a K1 visa, and files I-485 according to guidelines and whose file is transferred to California service center is waived off interview in most cases right.

    Well suggest me if I will have interview or no Interview?

    I have a similar situation. Did anybody have any updates on what happened to their transfer? How long did it take to get the greencard or interview? Did it get transferred again? Please get back to me.

    We should not have applied K2 visa. Anyways, If we apply I-130, how long would that take?

    Also, I was told to apply for Emergency Advanced Parole at the same time we Apply for AOS for K2. This allows K2 to go back to mother country to continue with her education. When we send the AOS paper work to USCIS for K2, how ong do they take to respond back to us? Do we apply for Emergency Advanced parole at the same we the AOS paper or separately? I was told Advanced Parole should be applied at the same time you AOS. Then get InfoPass to expedite the parole.

    Can this (Emergency Advance Parole) happen with in 1 month while she is in the U.S ? When would they ask K2 to come for BioMetrics?

    You mentioned re-petitioning, how does it work? Are you saying, do we need to apply for K2 again? What form is that? Once we get married I will apply for AOS for my fiance(e). My fiance daughter (k2) wanted to come to U.S any time after June 2013. We are in a major confusion now. Also, you mentioned that we contact consulate/embassy in December or April 26th (last of the visa expiration), in what method we contact them? There has to be a formal method to contact them, right? Write a letter or fill up a form? I am bit lost, can you please go in detail?

  9. She is a 11th grade student. She wanted to come back after the 12th grade. She has changed her mind to come later. Now that she (k2) got the visa stamped on the passport? What are the steps to to go back to consulate and tell them that she can not come to U.S until 2013 May. If they not are going to agree for this, then how about she comes over to the U.S for 1 month and now until April 26th, 2012 and while she is here in the U.S, immediately apply for AOS and get emergency visa to go back to U.S continue her studies. Any suggestion, ideas.

  10. My fiance(e) and her daughter went to the consulate and Consulate issued k1 and k2 visa on OCT 25, 2011 and expires on APR 26TH, 2012. My fiance(e) daughter could not come before May 2nd week. I was told k2 visa is valid for 1 year. If the end date is April 26th, 2012, how can they say, she can follow to join in one year, I am confused.

    We specified in the forms that k2 will follow later and wont travel at the same.When my fiance(e) went for the interview she took her daughter too. How does the follow to join works?

    How do we handle this. I wanted to apply for emergency advanced parole, anybody knows the procedure for this

    Not simple advance parole but emergency parole.

  11. My fiance(e) and her daughter will be going to the consulate in about 10 days for their interview. I clearly state that K2 will follow later to the United States in petition. Can we start the K1 and K2 adjustment after my fiance arrived US and get married while K2 is in Overseas? Can it be done? See, I-129F is approved on Sep 2011, Interview is on 4th week of Oct, 2011 and Fiance(e) is coming to U.S on January 2012 upon visa is approved. Where does the K2's 1 year starts, from the time I-129F Petition approved or from the time K1 gets the Visa or from the time K1 arrives US? I am confused of this 1 Year start from when?

    My fiance has 1 child. Her daughter is 16 and studying at a school overseas and she won't graduate till March 2013. I estimate she arriving in the US first half of 2012 for 1 1/2 to two months and she is listed as K2's. I've been trying to find out what the process will be for the K2 and the time line, but can't see anything. I'm not sure if it will fit my fiance© daughter's circumstances, as she will need to return to study and the max time she could come over prior to the end of college would be 1 1/2-2 months. Wouldn't be enough time for the AOS / Advance Parole ?

    My fiance(e) interview 3rd week of October and her I-129F was approved in Sep 2011. She will be moving to US on January 2012. Soon after she arrived we will get married and we will start the adjustment status process with in few days for my fiance(e). The question is can I start the K2 adjustment process or not at the same while her daughter is in Overseas. Her daughter is not moving with her as she can get leave until 2012 for about 1 1/2 to 2 months. Some where I read that once we get married both K1 and K2 can start the adjustment process, it did not tell whether K2 needed to be in US or not. It did say K1 must be in U.S, K2 will follow later with in 1 Year. So we are trying to see whether can use this buffer to get the adjustment process get going for the K2

    Please shed some light on this

  14. The website says (http://chennai.usconsulate.gov/immigrantstous/fiance/fiancee-k-visas.html#KTWO) bring two completed DS-156 (non-immigrant visa application) forms. In order to complete the forms you need to go to https://evisaforms.state.gov/ds156.asp . I went to the website, entered the information and pressed 'continue', it took me to the next page which contained completed DS-156 with a barcode information. When I did it for the second set, it gave me different barcode number. I am confused, not sure I should do it twice with different barcode on it or first set to be replicated so that barcode is same for both DS-156. Do I need to do it twice or just photo copy the first completed set and second DS-156.

    As the interview is so close I need some answer.

  15. Does My U.S. Citizen Fiancé(e) Need to File Separate Petitions for My Children?

    No. Your eligible children may apply for K-2 visas based on the approval of Form I-129F, Petition for Alien Fiancé(e), that your U.S. citizen fiancé(e) filed on your behalf, but your U.S. citizen fiancé(e) must list the children on the petition. "Separate visa applications" must be submitted for each K-2 visa applicant, and each applicant must pay the K visa application fee.

    Here is my Question:

    I included the Child's info in the Form I-129F.

    What is the name or # of the Visa Application form which needed to be submitted for k-2 visa applicant?

  16. Please provide some information, what is the next step. In addition are there any Indian petitioner who is at my stage who can also give me any additional information about the next step.

    My Fiance visa is approved and I am waiting for the NOA2 to arrive in the next few days.

    Who will be getting packet 3 and packet 4? Me or my fiance?

    She is from India. where can I find what fees she has to pay to U.S Consulate/Embassy?

    Police verification forms/letter format?
