  1. I'm currently at the fingerprinting stage of my citizenship process. Unfortunately, my marriage is going downhill fast. I've been avoiding taking the plunge to file for a separation and divorce for emotional/logistical reasons but at this point, I think it's worth postponing since I read on the USCIS page that the separation process will render me ineligible for citizenship, with some exceptions. BTW, I'm at the 3-year mark, not 5. Anyway, these are the basic particulars and I wanted to know if anybody has been in a similar situation...on the verge of separating or divorcing AND in the middle of the citizenship process. Did you wait? When did you file for separation? Basically, when is it "safe"? Any opinion appreciated! thanks!!!

  2. Hello, everyone

    I'm working for a hotel on a J1 visa and the official end date of the program is Oct. 24. However, I've applied for an AOS (I got married to an US citizen) and I've just received my I-797 Notice of Action letters...As I can't stand that job any more, I want to hand my notice in now that I have my first I-797 (Receipt)....in your opinion, would that be rushed since it's not an "approval notice" yet or it won't matter since the approval notice will take a long time anyway and I'm already legal to stay past my end date (because the case is pending) even though I'm dropping my job 2 weeks before the end???

    I guess my question is related to the fact that my status is changing now and I was told by my agency that once I've applied to adjust status that I needed to stop my J1 job - in the end, that's what I wanted to do anyway!!!

    Just need a final insight before I hand in my notice!!!

    I'm a little ahead of you as I already got married to an US citizen and I sent my Adjustment of Status packet last week, having already received my first Notice of Action. What our fellow member said is true, you need to Adjust your status (I-130, I-485, etc) and don't forget to send the Advance Parole form so you can travel whilst the green card is pending. The Advance Parole takes about 60 days (or more) to be approved. Let me know if you have any questions...don't be long as you will need to do a medical exam (I-693) and that may be a little while too!

    When you receive the official receipt notice by mail (with my case number), does it mean that USCIS has reviewed, accepted the forms and therefore the green card is now pending? How about the initial txt/email notification...is that only to tell me they received everything but the forms can still be rejected?

    My questions are related to one of the supporting documents of the petition (I-130), the affidavit affirmed by third parties to help you "establish a legitimate relationship"!!!

    My husband and I asked for one affidavit from a good friend of his, who I've met and hung out with quite a few times, but apart from him, there's no one else we could ask affidavits from, except his parents, since we have only been together for the last 8 months and we have really kept to ourselves and haven't been out with friends that much. So...

    1. Is one friend affidavit enough?

    2. If not, would an affidavit from his parents help at all? (I also have photos with his parents I'm going to print, so maybe their affidavit wouldn't be that relevant)
