Hi VJ community,
I'm in the process of applying to have conditions removed from my temporary GC. The 10 second version is that we were completely in love, got married, I got my temporary GC, she got depressed and distant, cheated on me and decided that she didn't want to be married anymore and we got divorced. Since this occurred 9 months into the marriage, I'm applying to have conditions removed even though we are now divorced.
I just got a letter from USCIS saying that my evidence does not cover the entire period of our marriage up until the divorce application. The reason for this is that I waited about 10 months to file for divorce after we had broken-up. Partially due to a trial separation, and after that, getting paperwork in order and not having the money. The lawyer that I consulted before doing this said that it could be done at any time before the application to remove conditions (as long as it was before temp GC expired). But now I'm wondering if they won't accept this.
TIMELINE:
May 2012 - Sept 2012: Trial SeparationSeptember 2012: Decision to break-up
April 2013: Filed for divorce
Any thoughts? Can we both write affidavits just explaining this, or is the very fact that we were not together during that period a problem? Thought I did everything right by checking with a lawyer first, but alas!

Thanks for your reply. I'm planning on doing the application without an attorney. I did the Green Card application myself and did a good job. I don't have the $2K for a lawyer.

I am currently working on my application for the i-751 waiver after my divorce. The 10 second version is that we were completely in love, got married, I got my GC, she got depressed and distant, cheated on me and decided that she didn't want to be married anymore and we just recently got divorced. Since this occurred 9 months into the marriage, I'm applying to have conditions removed even though we are now divorced.
We had very little commingling of finances, basically still living like we were dating, so my evidence is going to rely mostly on affidavits, photos, copies of letters, etc. I've asked my ex-spouse for a personal declaration based on the description in the instructions...
A “personal declaration” in which you describe, in great detail, how you met your spouse, why you got married, and the feelings that you had or still have towards him or her, and why.
In the case of divorce, should we both do a Personal Declaration in which we not only talk about how we met and got married, but also a few details about the reasons for the divorce? Seems important but just thought I'd put forward the question.

Hello VJ community,
I am a Canadian living in the US with a Green Card that I received 3 months ago. In filling out a form, realized that my Canadian passport expired in February. Oops. So here are my questions:
1- I renew my Canadian passport right, not apply for a US passport?
2- With a Green Card, my citizenship is still Canadian right?
I did some snooping online but wasn't able to find the answer, so I turn to VJ with these questions that I should already know

I think I've given up on the idea of going on this trip. Even if I went in for Bio tomorrow, the departure date is 3 weeks away (which is the earliest I would receive AP). My work will need time to get someone else in the company to go. Just cruel and ironic timing. There will be other trips.

Thanks for taking the time to reply to my questions. Even though it wasn't what I wanted to hear, it is what I suspected. Dang! So traveling while AP is still pending is no bueno hugh?

In applying for AOS, I also filed for a I-131 (I got confirmation of receipt email 9/29) for an important 2 week overseas work trip (depart 11/21). I just received my notice to go in for Biometrics which happens to be the day I'm supposed to leave for the work trip. Funny right? I can postpone the trip a day, but no more really.
So I have a few questions. If they seem obvious, I apologize, but I did do a fair amount of research online beforehand and read the I-131 instructions, but am still unsure:
1- Are Biometrics directly related to I-131, or just my AOS application in general? And as a result, maybe there is still a chance I could get the Advance Parole in time for the Nov 21 flight?
2- If biometrics are directly related to AP, is it safe to assume that it would still take a while after biometrics collection to receive AP? Therefore, making this trip impossible?
3- I'm also assuming that I cannot leave the country before I receive AP and while it is processing, but I read a post on a different site that said it was possible. Any thoughts on this?
I am really grateful for any help you can offer. This site was a huge help to me when I was filling out AOS forms.

Hello,
I'm a TN-1 status applying for AOS. My question, regarding the i-864 form, is do I really need a sponsor? My wife does not earn enough to be the sponsor, but I make enough at my job. Can it go by household income?
I've done some research, but it's still unclear to me.
Greatly appreciate your thoughts.

Damn, you pretty much confirmed what I feared. Thanks so much for taking the time to answer my questions so thoroughly. I guess the complication would arise when I'm applying for my AOS and there is a funky order between my date of marriage, The stamp of India in my passport and the departure date on my TN.
I guess I'm trying to convince myself that there is something that is going to make this work, but it might just be one more cruel side-effect of non-immigrant status.

I am a canadian citizen in the US on a TN visa. In July my girlfriend (US citizen) and I got married. I was going to apply for my Green Card right away, but today I was given the opportunity to travel to India for work (just for a couple weeks)in 2 weeks and the again in November. I know that once I apply for the green card I am not supposed to leave the country.
So my questions are:
1- Can I delay applying for my Green Card until I get back from the trip?
2- Can I leave the country with TN status after marriage?
3- Can I leave the country on a TN visa while I am waiting for my EAD?
4- My TN expires start of January. It seems like there is not enough time after the trip to get my Work Authorization (EAD) before my TN expires. If my TN expires a month or so before I get my EAD, Is it that I can stay in the US, but cannot work?
Ugh! I really want to go on this trip. Is there a way?
I appreciate any help you can offer.
