  1. Oh my! You just had to update your N-400 form during the interview with your new marital status via informing the interviewing officer and everything would be OK. By stating that you are single during the interview you created a big big mess since you were married BEFORE the interview. I would actually consult an immigration attorney about this. You need to understand that your citizenship can be revoked if it is determined that you lied on your N-400 form or during the interview.

    thanks. Unfortunately someone on this forum was in a similar situation at his interview and the IO said it didn't matter since his wife wasn't documented in the US and until she immigrates to the US he s single. I went off that info.

  2. Who the heck advised you to do such a stupid thing? You misrepresented yourself. It doesn't matter if you got "married out of state and she is not 'documented' in the US yet." You are married. If it is recognized where it occurred and it is not against US public policy (no polygamy, etc.), then it is recognized by the US.

    How does filing the I-130 magically make you married????

    Presenting a marriage certificate is not a requirement during the oath ceremony. That's why you haven't heard anyone having to do it.

    You need to correct your misrepresentation. You accept any delays. If you proceed and file for your wife, you will dig yourself a bigger hole.

    Please, please, go see an immigration attorney. You've made a mistake. Don't keep making it by ignoring it or doing something that makes it worse. While you may think you are doing something wise, you may actually be making a big immigration mistake. Get an experienced attorney to help you.

    I appreciate your suggestions. But at no time have I presented a married certificate or elected 'married 'on any form. For all I care, she's my fiancée! !!. I was obviously Miss informed but I have to move on. So as things stand,we're looking at filing a k1 visa. .none of us enjoys the wait.

    On the other hand, if marriage certificate is not presented at oath and I answer yes to Q1,am I in the clear? Am not big on attorney. I think there's enough information or instructions to guide your petitions.

    What exactly is the problem?

    The problem bob,is I don't want to answer yes and then present our marriage certificate on oath ceremony and have the whole process put on hold. I just thought that since she's not here in the US yet,am technically single till I file i-130. Also, I haven't heard of anyone presenting their marriage certificate during oath ceremony on this forum.

    You are legally married in the USA's eyes. However, did you not already include your wife's details in the N-400?

    No I didn't since we were not married at the time I applied for citizenship. We got married a few weeks before my interview and was advised to say yes to"are you single"

    at the interview because we married out of state and she is not 'documented' in the US yet.

  5. I Applied for naturalization FEB 2011 and married my sweetheart of five years in April. I am now a US citizen as at October 2011. I intend to file form I-130 to immigrate my wife who lives in the UK. My concern is that I married wife when I was a Lawful permanent resident (6 yrs). Can anyone say if it's legal or OK to NOW file for her as a US citizen? Or should I have waited to become a US citizen first before marrying?

  6. Done deal folks - I am officially a US citizen.

    Arrived at 1 pm at Fairfax office - waited until my name was called - I handed in my GC, my old 2 yr GC (I didn't have the old EAD or AP) The guy at the wicket said it was no big deal. Had me sign something that looks similar to the citizenship cert (probably their copy).

    Waited 10 minutes until they herded us up to the Oath ceremony room. After 20 minutes of speeches, the Oath ,the Pledge of Allegiance and the handing out of the certificates, we were done.

    Passed by the SSN office on the way home and changed my citizenship status there, tomorrow I'll take my certificate to work so they can change my status in the HR system and then I'll go get a passport

    PS: Lots of people brought too many relatives/friends - please take heed and DO NOT BRING EVERYBODY YOU KNOW - they really should limit it to 2 guests per person. My husband noted that there were at least a few families who brought very small children who did not know how to behave (or maybe it was the parents)and they really should have been left at home - they were honestly a disturbance to the proceedings which are important to those receiving citizenship.

    So while people's children ran wild the ceremony tried to continue (don't give me grief - I have 3 of my own and when they were small, I left them at home ;) )

    I am scheduled for oath within the month.

    I didnt know i will have to update my status at the SSn office and at work with HR...!
