  1. I recently applied (January) to remove the conditions of my 2 year green card as it expires in March 2014. I have already received my letter extending it for a year and completed my biometrics. My husband's work is transferring him overseas and we will be leaving in April (probably before I will receive my 10 year green card). Since we may be out of the country for more than 12 months, can I file for a re-entry permit so I won't have any issues coming back?

  2. My conditional 2 year greencard is due to expire in March 2013, however my husband and I have the opportunity to work overseas for about a year when I am due to file to remove the conditions.

    Is there a way I can apply from overseas, or is there a way I can add an extension on to my existing conditional greencard? Or, am I able to apply from overseas and fly back for the fingerprinting/interview?

    Any tips or advice is much appreciated!!!

  3. I'm on a J1 Visa and I applied for an EAD, primarily because my J1 expires at the end of this month. I am currently employed but I didn't have to start a new contract with my employer, I just showed them my EAD to show I can still work after the expiry of my J1.

    I'm still trying to clarify my situation with income tax, as under the J1 there was some tax exemptions, so i'm not sure when I'm liable to start paying certain income taxes from when I got my EAD or from when my J1 expires.

  4. I know this discussion is a little old, but I just want everyone to know that the US Department of Justice has a hotline that you can call where you can speak with a lawyer for free.

    I had an experience whilst I was on a J1 visa. The company hired me but when found out I was on a visa did not want to keep me employed (which is illegal). The lawyer I spoke to called and spoke to the company and the problem was sorterd out.

    He also said if I had any further problems I could issue a claim against the company.

    Know your rights, don't let any employer push you around if you have the legal right to work here!

  5. Just wondering if ther are any Aussies living in the Augusta GA area at all? Who would like to make friends and have coffee some time or just a chat.

    There's a good chance my husband and I might be moving to Augusta to work at the power plant there, but at the moment we are working in Toledo, Ohio and then moving down to Florida for work next month.

  6. I am currently working on a J1 visa which expires November 30, and expect to receive my EAD card any day now in the mail. Currently under the J1, I am exempt from paying social security tax so my employer doesn't take it out of my pay. a few questions I have:

    When working under an EAD are you subject to all types of income tax, and if so, would my employer start taking that out of my pay from when my J1 expires on November 30, or on the day I receive my EAD?

    Does anyone know a webiste or source I can clarify all this??

  7. Ok so I sent a letter and called my congressman on monday 24th requesting an expedite of my EAD. He called back on Tuesday saying that my EAD & AP had been approved on the 25th (the same day he called), and I should get it in the mail in 2-3 weeks. He also said USCIS never says they approve it beacuse congress called, but it seems like his call brings the application to the top of their pile.

    So i guess since there were no major problems with my application, his call made them approve it faster.

    My status online still says inital review, but i'm hoping he is right and my EAD will turn up in the post any day now...

  8. I am currently in the US on J1 and adjusting to permanent as I married my USC husband. We would like to buy a house in a few months but I am confused whether I can put my name on the mortgage and on the house if I am not yet a permanent resident.

    Are there any extra taxes or things I should know about for a 'not-yet a resident' to purchase a house??

    I tried googling this but all i can find is junk and un trust worthy websites!

  9. I would wait it out. You still have 2 months, and generally EADs don't take longer than 90 days. Have you already submitted everything and are now just waiting?

    If you get to the point where your EAD has not arrived, I would ask your employer if you can take a short leave until it arrives again. I've had employers do this for co-workers who had to renew work visas. I know some employers are probably more flexible on this than others but if they like you and you let them know it should be longer than 2-4 weeks, that's still faster and easier than finding someone to replace you!!

    my application was received last week so there might be a chance I will receive it before November 30, but i'm going to try and expedite it after my biometrics i guess I might as well try

  10. Working without authorization will not be made an issue of at AOS, so if you thought about quitting your job, that would be just silly.

    thanks for your reply. so are you saying I am legally able to work after my J1 expires and before I receive my EAD? what paper work do I show to my employer to prove this? I think they might let me go because they may not believe I am legally able to work

  11. I'm currently in the states on a J1 visa and applying for change of status and EAD because I'm now married to a US citizen. I'm currently working and my J1 expires on 30 November. I'm a little worried my EAD wont arrive before 30 November so that means I will have to quite my job until I receive it.

    Is having an existing job grounds to expedite an EAD? does anyone have any experience with this?

  12. I'm currently in the US on a J1 and getting ready the forms for a To change status because I married my US citizen husband

    I am confused about the medical exam. Do I need to do this before I submit all the forms? How long does the exam take, do you need to make several visits or is it just a one off?

    I also read I need evidence of my vaccinations. I have no idea where any of them are, probably back in my hone country australia an long lost, is this going to be an issue??

  13. I am currently in the US on a J1 Visa (2 year residency rule does not apply) and will be marrying my US Citizen boyfriend shortly. My J1 Visa expires in 3 months.

    I have been trying to work out how to apply to stay longer and am very confused about what forms and what type of visas i apply for.

    Should I:

    A) Apply for a Change of Non immigrant status to a K3 whilst also submitting the I 130 form

    or

    B) Apply for Permanent residence with the I 485 whilst also submitting the I 130 form.

    Which of these is the best option and which we allow me to stay in the US after my J1 visa expires in 3 months? I am very confused so any help is much appreciated!!
