Thank you so much KayDeeCee. Do you happen to know the importance of joint bank account docs? We have a joint lease, lots of mail delivered to our house with both names, etc, but no joint bank account.

Hi,
Was hoping someone might be able to shed some light. We got a letter stating that we were a potential interview waiver case. However, several months later, we've received a letter stating we will have an interview soon. Why the change, any ideas?
Second question - I am the USC and my spouse is the one applying for AOS - when my spouse first arrived, a job was offered to him and he took it. He worked for a couple months and then we discovered he needed a separate work card (not just a SSN card, as his employer instructed), and he immediately quit. He received his work authorization card a couple months later and worked again. I want to be totally honest at the interview if they ask about date of employment - is this going to be a big deal? Like a denial issue? Anyone have any experience with that? He has since held a job and worked (legally) - and is still doing so.
Need your expertise.
Thanks.

Husband! Not "house and"

Hi,
my house and apply for his green card nearly 1 year ago. We received a letter stating that are green card would be delayed in processing due to reasons not related to our case, and then if we did not receive anything within 6 months to call office. The 6 months have now passed. Does anybody know how I can reach an actual person? Has anybody received a letter like this? The automated system gives the same information as the website obviously and is no additional help.
Pardon my typos. Sent from my phone.

Hi!
Anyone have any previous experience that might be able to shed some light?
My fiance moved here last year and we were married in the spring. He has his work authorization and a SSN card, and has been working for several months. However he does not yet have his greencard (in process).
I have been trying to research the pros/cons of filing jointly vs separately, but answering those questions has raised new questions!
Since he doesn't have his greencard yet, will he be assessed the fee for not having medical insurance yet due to the Affordable Care Act? Its not offered through his work and is very expensive to be covered through mine...so we haven't found anything we can afford as of yet.
Are there any other things to consider when filing with a spouse that is not yet a citizen? Any other references you'd recommend? It's like a rabbit hole once you start asking questions!
Thanks so much.

If my spouses biometrics is still good (done within the last year) - do we still include the biometrics fee? Or would we just pay the filing fee of $985?

The things that are holding us up are the tax forms, as I mentioned earlier, and our I-797. We did not receive an I-797! Once we saw the status change from "Administrative Processing" to "issued," my then-fiance went to the embassy and they just gave him his paperwork for his entrance in the USA. No approval form! Trying to figure out where to get an additional copy.
My spouse (the beneficiary) just started working - will delaying our application for AOS affect his work approval?
This all seems more involved (and confusing, sometimes!) than the K-1 process was. Help!

Hello,
Question - how long after marriage do we have to file for AOS? We married within the 90 days (the 90 days are not yet up). My husband has his SSN and I-94 but we are trying to gather other documents (tax stuff etc). Is there a limit? How much time do we have?
Thanks!

Hi,
Does anyone have experience with a request for documents during AP? I spoke with someone who said this means the processing is almost over. Anyone have any tips?
Thanks.
-
Have any of the USCs visited the foreign embassy during AP? Will they grant an appt to talk about the case? Would it help?
-
Hi all - is there an average timeline for processing (including AP) by country/embassy? Or is it just personal timelines?
Sorry - maybe i am missing the link?
My fiance & I have been in AP For 6 months now & was hoping we were almost at the end of our wait.
Thanks!
-
Yes, it already has taken 6 months. We have had senatorial inquiry. Does anyone know if there is anything additional I can do? Anything that I can supply or how I can figure out where they are at in the process??
-
My fiance had his interview over six months ago - they requested an additional PCC which he retrieved & returned the same day. They have kept his passport all this time. Each time I check our status, the website says "AP can take up to 60 days" (I wish!). We have had congressional inquiries done....but they also come back with the same "administrative processing" response.
What else can we do? I never dreamed it would take this long. Is this normal for New Delhi? Is there anywhere we can check to see where they are at in the process??
Would it help to visit my local USCIS office? I have been calling DOS as well...
-
Thank you.

My “self-induced” delay was actually not self-induced….they requested a form that was not on the website or required for Packet 4…don’t get snarky.
-
Been waiting on AP for around a month now - does anyone know how long it usually lasts? i realize it's just a guess, but any ideas? We just had a document they wanted & we hadn't submitted....
-
Makes sense. Thank you.
-
I am used to calling to check the status & doing the press 1, press 0 thing...everytime I try, it disconnects me. Has the menu changed? does anyone know?
-
Yes he already has the form (PCC) & has submitted it...now just waiting...

Here I am again, seeking all of you VJers' expertise...
My fiance had his interview earlier this month & the CO kept his passport (good sign!) but gave him a 221g slip for a document from the passport office giving his passport clearance (?). This was not on the embassy website to bring to the interview, but my fiance went & got it & deposited the form the same day as his interview.
anyone have experience with this particular document? Does the fact that he kept the passport mean my fiance is approved? The status is still in AP but we're thinking it's a positive sign.

Hi,
My fiance (India) has his interview soon - does he need DS-157 for this? It does not state so on the embassy website (New Delhi) but in other areas it states this is a "new" form to be submitted with the rest of the documents. anyone know?

Ok. So after our RFE request, I'm sure learning a lot about IMBRA. Theres a lifetime limit on K-1 visa apps, which is two. This is our second time applying.
God willing, we wont be denied again, but IF WE ARE, can we still get married & apply for a K-3? Or are we shut out of that too? Does anyone know? I'm really freaking out. I have no idea what I'd do if we were totally banned from living together (in this country at least..)

We got an RFE today stating that we need to submit a "waiver" because we have filed previously in the past 2 years and been declined. The explanation/waiver is to address why a waiver would be appropriate as well as to add any additional evidence I feel would support my request. We have remedied the reason for which we were 1st declined and are now reapplying. Does anyone have any experience with this or can offer tips? Really want to get this submitted ASAP.
Thanks.

We filed for a K-1 previously, and the wait time listed was about 3 months. Now if I search the CA service center, it lists 5 months!! Is this accurate, does anyone know? Has anyone filed recently? What was your experience?
