  1. Did you and your co-sponsor both filed an I-864?

    Yes, both of us did. My wife filed the I-864a and the sponsor I-864. I believe he must have had a typo in the application. That is what I am assuming. But nonetheless, now focusing on moving forward. Just wanted to know would it be better for a i290 or filing i485 all over again.

  2. Hi vj members,

    Really need your help again. You guys have done so before. I entered US on k1 visa on feb 4th. Applied for the AOS on March 6th. Had the fingerprint done and then got denied because of incomplete I-864. The I-864 was filed by the Joint sponsor. It was my mistake to not look at how he filled them because of the trust level. Obviously that messed it all up as I had recently received a very good job offer. It was cancelled as of yesterday. Now that the I-485 is denied, I have the ability to motion within 30 days.

    The question is:

    Do I file the I-290 b and wait for 6 months or do I file the I-485 all over again (considering my k1 expires on may 4th)?

    Have you guys heard of any success of filing a I-290b?

    Would appreciate any help from you guys.

  3. Great, thank you both for your replies. Not sure how long we intend to stay down here. Now that we have received our K-1 visa (9 months), would it be fairly take a similar time period to get the IR-1, CR-1 visa as well? I mean, would there be any chances of it being not approved. I am only worried that for a country like UAE, being a male, its not easier to get an approval from the US gov :)

  4. Hi all,

    Just got a bit of good news yesterday that the visa was issued at the Abu Dhabi consulate. Was not expecting it that soon but it did come through. Now prior to this, my fiance was down here for a week, and both of had agreed that comparing the economic situations of the two countries, UAE was the best option for at least a while. Now, being an Asian, the family comes into the picture. Her family wants to have a grand wedding in NYC which I am fine with.

    For me the question is, can I go there, get married, go to the courts, get our legal marriage certificates done and then come back. I do realize that when I leave, my K-1 will be void and all I will have with me is the legal US marriage certificates. So does this mean, when both of us move back here (to UAE), say a month after we get married, we have to apply all over again as K-3 say after few years?

    Are there any other options here?

    Would appreciate any sort of advice/help.

  5. That was an option I was considering. Guys, thank you all for your replies. This will definitely help when I make my decision of whether to move or apply again from a spousal point of view. It's just that I have been hearing a lot about the jobs situation out there and related. Now, I do realize that if its meant to be it will happen.

    The reason that I have to do the K1 visa is because my to be Mrs :), according to recent UAE law, is not able to come down to Dubai and get married (Both husband and wife need to have residential visa in UAE). If we decide to go the other route, we would probably have to get married in a third country or something :(.

    I would not even in mind applying anew again as the financial and mental drag of the process is not an issue as long as she is here with me. Damn it decisions :).

    Was wondering if you could help me out on this one. Well, my interview is scheduled for K1 Visa is scheduled on the 2nd of Oct. If all goes well, I expect to fly to US sometime around December. Now my question was, is it possible for us to get married while I am there within 10 days and then come back to Dubai for work?

    The reason I ask this because I have heard that to apply for AOS it takes 30 - 90 days, etc etc. I was wondering if that process could be completed while I come back in Dubai. Currently have an awesome job here and local laws stipulate that she (fiance US citizen) cannot come down here and get married due to not having a Dubai residential visa.

    What do you guys think? Any help/advice would be appreciated.
