Different instructions apply to some cases so follow the instructions provided by the National Visa Center for your particular case. The instructions on when and where to submit Form I-864 are included in the information packet that is mailed to you with Form I-864.

he came here first in 1996 and was deported in 1998 then came back to the US in 1999. In Dec. 2005 he had to leave to mexico but was only there for 1 month then came back it was then that was caugt , he said immigration only kept him for couple hours then released him. but he is not sure how long he was banned from US

Actually Hot Mama is half right:
Here are the words directly from the I-864 instructions--very straightforward--and NOT a problem that you are receiving Medi-Cal, or other means tested benefits--you just can't count them as income !! So if you have enough income otherwise, you don't need an additional sponsor.
Does Receipt of Means-Tested Public Benefits Disqualify me From being a Sponsor?
No. Receipt of means-tested public benefits does not disqualify anyone from being a sponsor. However, means-tested public benefits cannot be accepted as income for the purposes of meeting the income requirement.
oh ok. thank you . and i have another question.. do you think it will affect his process that deportation he had in 2006?
-
now our application is at the NVC, DS-3230 been sent out and AOS fee has been paid, my question is will it affect that fact that my husband was deported back from the border to mexio back in 2006?
-
yes that would be it only medi-cal. So i would not need another persont to sponcer for my husband besides me?
What do you mean EXACTLY by receiving medical ??
only medical assistance.
