    Hi Luv,

    Just curious, when you put your case number at the lookup on the USCIS for case status, does it show any updated information there? Congrats also, when and where is your Interview? My folks did their biometrics on the 28th of OCT and we still haven't heard or recieved anything.

    Why not stay in the Philippines? What is so great about the US that you want your entire family here?

    Yeah my sis got a tourist visa, if she comes here after college (3yrs from now) and decides to stay. thats up to her.

    Visa fraud is when the folks from the region gets a tourist visa to enter the us with the intention of killing 100's of peeps in the name of your gods.. Let's go to a strip bar then you know how the story goes.. stock market crash, 2 recessions. high unemployment, y not you stay in iran, wear the burka, etc , etc , etc

    That's the ultimate visa fraud.

  4. Hey my parent got their tourist visa months and months before I got my citizenship. So their intent was to visit the good old US of A and have some apple pie. They happen to change their minds and stay here on a permanent basis.. Like the 1000's of others in the similar situation.

    They spent 10s of thousand of dollars here already on touristy stuff, and shopping.. Inputting into the economy. They got screened like everyone else at the embassy. Lots of people dont get the visa because they are poor.

    To each their own..

    on a tourist visa your parents have not had a medical inspection. if they are old and infirm they would have not passed it for immigration purposes, anyway. the assumption is that they will end up in public health assistance, a drain on the US taxpayer. look at me with a straight face and tell me you're gonna pay for their health care till they croak.

    makes no difference how much money they spend here. they bought chinese ####### anyway, right?

    you can do all the medical stuff here in the USA..

    People should really consult a professional immigration attorney that has balls, and knows the law.. THere are way too many amatuers in this site that want to take the long way.

    The public drain is what the affidavit of support is for.

  7. Rdan from reading your other posts it is obvious you are using the illegal coming on a tourist visa with the intent to immigrate route for your parents. Good luck to you and it might be possible for them to adjust status

    Yes it does work for some people and it does not work for some people but the consequences of failure are severe. The fact that they are engaged and/or married at the time he enters the country is a sign of intent to immigrate. If he cannot prove ties that he intends to return to India such as a home, lease, job, school, these are all signs of intent to immigrate.

    How do you prove you did not intend to immigrate if you have in your home country no job, no home or apartment, no school, you have closed your bank accounts or have little money in them, you have suitcases, etc.

    I waited more than two years for my fiance to obtain his visa and I personally am upset that you think all a person has to do is get a tourist visa and immigrate bypassing all the paperwork, security checks, waiting, etc to come here.

    It is people like you and the ones who do as you suggest that clog the system and make it so much more difficult to obtain tourist visas for legitimate visitors.

    EVERYONE is assumed when given a visa to have the intent to immigrate to the US. It is the duty of the person applying for the visa to prove they do not/did not intend to immigrate.

  9. Advising the op to have her fiance come on a tourist visa with the intent to immigrate is a violation of the TOS. This is visa fraud since a tourist vise is a non-immigrant visa for a specific period of time and then the person would leave the US.

    Please do not advise people to do things that are illegal and could result in a life time ban from entry into the US.

    How do you prove intent? when he's coming here to take an exam? A bunch of baloney.. More than one way to skin a cat.

    You do not prove intent... you must disprove intent... because intent is presumed. The burden is on the applicant and not on the government.

    Ask any immigration atty.. this senario is allowable

He can come on a tourist visa if one is granted to him (unlikely since you folks will be married and that alone is a red flag for tourist visa); then go back to India and process the immigrant visa from there. If he comes and goes in the allotted time for his tourist visa, you should not have any problems. :)

    People do this all the time, they come here on tourist. meet the love of their lives, adjust.. alls well that ends wells.

  14. Just got home and checked the case status online. The good thing is that it works now and I can get some info :thumbs: But, there is also bad news, they sent RFE on October 27th. Now I'm nervous and trying to think what they want. Oh well, I guess we just have to wait for the actual document to arrive and see. Hope it's not too bad and easy to fix :wacko:

    I just checked our status online and all 4 forms say 'last updated 10/29/2009' whereas before they were all 10/26/2009. Does this mean they were 'touched'? I never quite understood that term... :lol:

    Yes when my parents were touched a few weeks ago, they received their biometrics a few days later, dated the same day their files were touched..

  17. Hello folks,

    I petitioned my parents who were here on a tourist visa. I filed an I130 for them and they filed the rest last Sept. I see that on the USCIS website that the cases were touched.

    They are in the process of getting their biometrics done for the I765 and the I485 soon. What happens next? Does the I130 need to be approved before the I485 starts to process? There was no biometrics for the travel document?

    Will they get their PR by the end of the year?

    Any feedback is appreciated.

  18. Hi My parents are here in visitor visa and have 3 1/2 months left before they have to return, if we decided not to extend the stay. If I file for AOS, can they get green card within 3 1/2 months? I don't think the processing time posted by USCIS is accurate. What is the timeline?

    Are you a US Citizen? If not, I believe that you cannot petition for parents.

    Yes I am a US Citizen and thinking about petitioning for my parents.

    My main concern is that if the AOS doesn't go thru in time before there stay time expires, do they have to return or do I have to file for extension.

    You can file an I130 and I485 at the same time for your parents. As long as you file the I130 prior to the date of expire on the I94, they'll be ok and legal in the USA

    I got an email from state that they mailed my passport and i should receive it by the 14th. It's less than a month ago when I applied.
