  1. If your fiance is in India then you should get married in India with all religious rites and ceremonies. Make sure the event is documented properly (as in paperwork and photographs/ videos). Getting married in India along with friends and family proves that this is a real deal instead a marriage in thailand where no family members/ 100s of people are absent. You can always go to honeymoon to thailand (this may actually help you).

  2. Good news:

    Visa approved today. I accompanied my wife to the interview and was allowed inside.

    I was asked to complete another I-864 as I had completed ez version but was missing W2. I quickly filed it and returned it to the window.

    The questions asked were:

    1. Who is your sponsor?

    2. Who did you meet?

    3. What does he (points at me) do?

    Then he said visa approved and told us that we will get passport in mail.

  3. You need to get a lawyer in your spouse's town who can help you guys. Since you both are hindu's you can get married in a temple/ religious wedding and register it under hindu marriage act. I did it the same way where I got married and then later registered my marriage (the second day I went to court). The key here is good lawyer. UP is notorious for these kind of things.

    I am a US Citizen and I will be getting married to my Indian Citizen wife in Calcutta in Febraury. However, I can't find any information about registering for a Special Marriage Act wedding in Kolkatta. I found the Delhi information, but nothing on Kolkatta. Also, we live in Delhi, but are getting married in Kolkata. We are happy to file 30 days in advance, but don't know if getting married in another city/state will be a problem.

    I'll stick with the registering the marriage at the local courts. It will be a good idea to find a lawyer who can help you with navigating the administrative paperwork.

  5. Medical for wife completed in Delhi. It took almost 7 days to get the report.

    we are planning to visit VFS on Tuesday 10/11 for submitting courier fees and any other documents they need. She will be taking all the paper work including proof of relationship and medical reports just in case they accept it.

    My interview is scheduled for 10/17 and I am going to accompanying my wife to the interview ( at New delhi embassy they let you come in if you are USC with valid passport).

  6. Hi guys, this is a fantastic community with great information. The I-130 guide has been immensely helpful in starting out but I have a few questions. I got married earlier this month in India. I'm a US Citizen and am filing for my wife.

    1) regarding the G325A form, will a scanned copy work or does it have to be the original? What I mean is, can she fill it out, sign it and scan it and send it to me? Or is it best if she sends the original signed form via international courier?

    2) While filing the petition, should we have to send the photographs with the package or the photographs are just required during the Visa Interview? Should we also include phone bills and email logs?

    3) We have been recently married. What proof can we give of an ongoing maratial relation as we do not possess any joint property and have not co-mingled our financial resources.

    4) Can we handle the whole process ourselves (forms, NVC requirements and interview) or would people recommend that we should hire an attorney?

    I am USC who got married in India in Feb. We are scheduled for interview next month in New Delhi

    1. I submitted scanned copy of the form. They accepted it but I'll advise against it.

    2. Photographs can be submitted as other evidence. I didn't submitted then but I did submitted 4 Affidavit letters from my family stating that I was married in XXX date at XXX location and they were present there.

    3. You will not be able to submit any proof. The evidence in #2 will be sufficient along with copy of Marriage certificate.

    4. If you pay close attention to all instructions and keep an eye out for RFE threads here then you will not need an attorney. There is lot of support available here and the process is fairly simple (in case of regular marriage) just requires close attention to paperwork.

  7. Congrats on the interview :) , Unfortunately, I won't be able to attend the interview with my fiance :(. We haven't even made wedding plans yet just because we want to start once he receives his visa, we just have the date picked out :)

    How do you think we should why we are planning to marry in the US instead of India? With a letter from me? Or do you mean he should explain at the interview?

    A letter (you can get it notarized) that states that you are planning to marry in US because of personal reasons (it could be your family is here etc). Additionally, if you are planning to get married in church or temple then maybe a priest/ pastor can provide letter stating that you have started the "getting married" conversations. You will have to get married within 90 days so they will want to see some sort of wedding preparations as soon as he/she gets to US. Guest list should be fairly easy thing to do. Just my 2 cents.

    My fiance has his interview in about 2 weeks in New Delhi, India. We are in the process of getting all of the evidence together so he could submit them to VFS ahead of time.

    Evidence we have already submitted with I-129F package:

    *Pictures (of ring ceremony we had, places we went to around the city, pictures from my birthday party we had)

    *My family's and my boarding passes for our trip for the engagement party

    *copies of our entry stamps page of our passport

    *letter from me explaining how we were arranged

    *Engagement Ceremony invitations (from both sides) Guests= 300+

    Then we received an RFE:

    Evidence I submitted with the RFE:

    *More pictures (I think I may have sent about 25+ pics, could have been repetitive from what I sent with the I-129F package initally)

    *Call Logs from February 2011 to end of May 2011

    *Receipts for a gift I sent him on Valentines day and on another occasion

    *Parent consent statements from his parents and my parents

    *Letter from my fiance stating how we were arranged

    *Intent to marry within 90 days of his arrival (from him and me)

    Evidence we are thinking about submitting to VFS:

    *More pictures (25+ pics, could be repetitive from what I sent with the I-129F package/RFE)

    *Call Logs from June 2011 to Current

    *Copies of cards I sent him and birthday card envelope that my parents sent him on his bday

    *Letter from venue where we had our engagement stating we had a ring ceremony there on the particular date

    *2 chat transcripts (we only talk on the phone, but I have 2 chat transcripts, I crossed out what we talked about and just left user Id's visible, date, and time)

    He doesn't have receipts for when he sent me my valentines day gift and retarded me through out the address portion, and he just recently sent me a card, I have the envelope should I scan a copy of it and send it to him?

    Any other suggestions greatly appreciated. Thank you!

    I've read somewhere that you submit guest list (with contact information), wedding plans, any contracts for vendor and reason why you are planning to US instead of India.

    My wife's interview is on 10/17 and I'll be going with her. I think if it is possible for you to travel then you should accompany beneficiary (make sure you take your US passport to consulate).

  9. A Question (New Delhi Consulate specific but please feel free to provide input):

    1. All my documents were accepted at NVC. The Passport Clearance Form was submitted as copy to NVC and I know that I need to provide original at VFS. Do I need to complete any other forms other than paying the courier fee and providing copies of passport + photos. Should I be submitting proof of ongoing relationship documents to VFS?

    Another thing:

    My friend recently was in same boat as us. He was IR/ CR1 petitioner. He told me that at New Delhi embassy the guy asked his wife about his (her husband) favorite meal. LOL.. please make sure your spouse knows what you like to eat. Also, he said that being present either in the consulate or outside is considered as major plus point.

  10. Please take copies of I-130, DS-3032, I-864 and DS-230 packets along with all the evidence of continuing relationship. I don't think you should be concerned about not going on honeymoon, given the circumstances. I am planning to reach Chennai a day before wife's interview on 10/25 and to return together. Please make sure that your wife tell the CO that you are outside waiting - it is a big plus for continuing relationship. And all the very best with your interview at Delhi.

    Thanks!! I'm sending these copies to my wife even before i get there so that she has them for her VFS office trip. I'll be reaching India right before her interview date and will try to go in with her to the consulate (I'll have my US passport ready to claim my right ;).

    I agree with Magical's statement: Since you only missed one letter it should not be a big deal. I suggest you do this:

    1. Call NVC and update the address with them. Also, ask them if you can make changes at the consulate during the day of your interview or do you need to submit a request to VFS/ US consulate.

    2. Email VFS since they handle the most of process. Also, call Dept. of State.

    Again, I think the bigger problems occur when your name does not matches name on your passport. I don't think address is big deal. I moved and changed my address just by calling NVC. No documents required.

  12. Is any of the petitioners planning to go to their interview in India? I got married in Feb but it happened in very difficult circumstances. One the morning of my wedding my dad suffered heart attack and was taken to hospital in critical condition. Naturally, I spent my whole day in hospital and at the evening went to my wedding (Dad wanted me to get married regardless). We made the event very close family friends/ family affair however proper ceremonies did occur and it was photographed and video was done. However, I did not plan to go on honeymoon coz my concern was making sure that my dad received the best care possible. After my dad came home, I came back to US and filed for paperwork.

    My interview is scheduled for 10/17 and I am going to attend it with my wife to make sure I can answer any concerns the CO may have. I am planning to take the following documents as our evidence for relationship:

    Phone records

    Skype records

    Facebook chat/ message record

    Affidavit from witness stating that they attended my wedding (these were also submitted withthe USCIS I-130 application)

    Photographs from wedding ceremony and some other photographs

    Stamps on my passport for entering India (before wedding) and leaving India (post wedding)

    Do you think I should take anything else?

    It is quite possible that the consulate may not let me enter but I am going to try. Best of luck to everyone! And thanks for your input.
