as of 7pm tonight my fiance will be in the usa.. what is our next step to get him employment authorization?? we dont have the money to file AOS at this time..Also when will he receive his social security card, and yes i know we have to get married first before the employment authorization.. he is eager to work!!!

I was reading through the IRS website and found the following link that covers Social Security Income, it maybe helpful in your case:
http://www.irs.gov/pub/irs-pdf/i1040.pdf pg 8 has a chart that stipulates who has to file tax returns this along with the sponsor's 1099 form from SSA and a copy of the Retiree Account Statement should be enough to prove she is exempt from filing taxes. Now you will have to get your fiance to be able to understand all this and how it relates to his visa request. He will be the only one talking to the CO or you could send the embassy a detailed email with the chart and and supporting documents.

$25,000 ($32,000 if married filing jointly). If (a) or (b) applies, see the instructions for lines 20a and 20b to figure the taxable part of
social security benefits you must include in gross income.
***If you did not live with your spouse at the end of 2010 (or on the date your spouse died) and your gross income was at least
$3,650, you must file a return regardless of your age.
The taxable amount of the benefits can be figured on a worksheet in the Form 1040 Instructions or Form 1040A Instructions , or in Publication 915, Social Security and Equivalent Railroad Retirement Benefits.

her total income from both is 22,000 and she has documents from irs stating she is tax exempt but i could not file 2010 taxes for her.. it all came put to 0. I spoke with the IRS and they stated to me there is no point for her to file being tax exempt and her SS is exempt as well cause she only makes close to 9,000.. it is way under the 25,000 requirement.. just realized as well dec20th is the cut off for our case with the consulate..his next interview is the 19th!!!im really freakin out over this..its so stressful.

It sounds like the CO is trying to work with your husband, keeping the passport is a good sign they did the same with my husband and he got the visa.
The entire purpose of the Affidavit of Support is to show that someone is taking responsibility for his immediate financial needs when he arrives and that your spouse does not become a financial charge to the state (medicaid, welfare, food stamps). Does the sponsor make enough to meet these needs according to the wages required to sponsor him? If she is solely basing it on social security I am not sure this qualifies as the amount she is entitled to can change as did my mothers if her situation changes (divorce, moving locations, change in medical conditions). Her social security can be viewed as an unstable income.
The only recommendation I can give is make sure whoever you use as a sponsor has a guaranteed income (pension, stable job). I know it is late in the process but it the financial threshold is not met the CO's hands are locked, they can only make a decision based on what they are provided by the petitioner.
Best of luck and hope the sponsor's social security income fits the bill.

she has a retirement pension as well as social security...she makes 22,000 a year and has no dependents.. so she meets the needs...thank u

They asked him some questions about our relationship.. how we meet and that traveled to morocco 1 time .. they also asked if he know i was disabled.. they kept all his papers.. our pictures EVERYTHING..the consulate stated he need the I-864 instead of i-134..also sponors birth certificate. they also asked for the sponsors W2/tax papers.. we have one problem.. the sponsor is exempt for filing taxes and doesnt have a W2.. she is retired and has social security..i filled out the 1040 tax form anyway and it all added up to 0..Also sent the consular letters from social security and an old 1099 form the states she is exempt...can u give more insight now?? thank uuuuuuuuuuuuuuu

my fiance had his interview and didnt have the correct sponsor papers so they put our case on hold until he can bring them the correct papers.. they gave him another interview date for dec 19th.. is this a bad sign that he will fail??? they kept his passport too.. what does this mean?? plzz help me once again.. thank u for your time..

i still do not understand all of this...his interview is on tuesday and i feel he will be placed in the same as ur fiance..i have faith in him,that he will pass but all the same it depends on the person giving him the interview.. thank u for your time

Generally speaking Bank Notes as a phrase means money. Bank statements don't count, they are just documents.

thank u i am soooo worried.. i hope he passes.. he is exhausted from all the paperwork and running around he has had to do.. he really wants to be here for Christmas.. we are praying to god every day for him to be successful..i have a 7yr old daughter and she tells me ever day, mommy he will pass he loves us.. bless her.. thanks again

Bank notes are paper money. Bank statements are just reports.
If the sponsor qualifies on income then the bank statements are typically not needed. Also, are you sure that you do not need a form I-864? Casa has been asking for the I-864 with K1 petitions in place of the I-134 over the past year or so.
the consulate in morocco sent me an email of all the documents he had to fill out and a list of papers that will be in his packet.. the I-134 was on the list.. there was nothing about a I-864

hello..i hope someone can help me.. i made out my fiances paper work i-134..I just read that you can not send bank notes to morocco..the I-134 requires these papers for sponsor with original signature.. I mailed them on the 4th of november and it is now the 16th..i was told it may take up to 12 days for him to recieve the papers.. CAN U SEND THESE BANK STATEMENTS IN THE MAIL?? i did and am now VERY WORRIED that customs will not give him the papers before his interview.. we have less then 1 week before his interview.. PLZZZZZZZZZZZZ HELP !!! thank u..Jaime

i had someone offer to sponsor my fiance.. she is retired and on social security.. she is way above the required poverty requirement for 2 people.. She does not have a tax return but all bank statements to prove her income along with letters from social security.. Can she sponsor without a tax return???

Can my uncle who has a military background and now retired from his job sponsor my fiance?? my uncle will not be able to provide job information cause he is retired but his bank account will show his deposits from retirement.. im thinking of every possible way to get my fiance a sponsor.. I am having a very hard time finding a sponsor..i have contacted the consulate but it takes a long time for a response from them.. thank u for ur time..

you cannot combine your assets with her's to reach the poverty level. Your mother, as a joint sponsor has to make the guideline herself.
thanks.. so now i am stuck.. it looks like he will not be able to come here.. my family is against supporting us due to his religion among other things.. My heart is broken badly because of this...i just dont know what to do anymore...I miss him so much and we are so close to the finish line in this process...

I am still very confused.. i was on the consulate website they gave me and it said i can to 2 joint sponsors with me!!! my mom doesnt live with me..i make 9,000 from my disability and she makes about 12,00 from her job.. together we make the 19,000 they ask for..Will i need to find another sponsor and not use my mom?? im sooooo worried i have no one that is willing to help me other then her...

plzz help?? i am at the stage of I-134 for support...I am the petitioner, i know i cant sponsor cause i am disabled and my income is low..Can my mother sponsor my fiance without my father's approval?? Also can i have 2 co-sponsors? i read you can but im not sure..Im at a dead end and the interview is soon...

It has been almost 6 moths for me and my fiance that our application has been submitted.. I have learned that if you marry you do need to to file other applications..As far as the drugs go..I feel you should not talk about yourself doing drugs, no matter which drugs you are using..The USCIS will not take that lightly.. So my fiance and I got engaged in Scotland (where he lives) mid-April and filed the paperwork which USCIS received May 16th. We received the NOA1 very soon after that but are STILL stuck in the preliminary (background check) stage of the process. Our wedding is November 5th of this year and I'm terrified we aren't going to have this visa in time. I've spoken to USCIS and they said we could still get married but then we'd have to start the process all over again to file for a spouse visa and there's no guarantee he'd be able to stay. We've spent way too much time apart and I don't want to wait any longer! Anyone have any advice? Does it really only 5 months for this (in which case we'd be fine) or is it much longer?

I have submitted the initial evidence they asked for.. Now we wait for the decision..If we get a yes, what happens next??
If we get a no, what do we do then?? I was just reading other topics and it seems very difficult to get an approved K-1..
It has been almost 6 months now that the application has been submitted.. If the we are approved, what should my fiance bring to his interview(pics, conversations)?? Thank you, I hope to get some well explained answer!!!

i am so sorry to here this.. i am engaged to a man from Morocco. Our application is in reveiw.. i hope and pray we do not have this problem.. If u feel going back and marring him will be the best option, then GET ON THE PLAIN!!!! best of luck to you!! plzz keep me posted thank you!!!

my question is khalids visa states it is good until march 2012..we will be marring very soon in the USA.. what do we do after marriage? do we need to send our marriage certificate somewhere so they know we are married?? we have to wait a little longer to collect the AOS application money.. I am worried.. will they send him back even if we are married by march?? very confused.. plzzz help!! thank u..
