    If you leave the US for an extended period of time it will be harder to prove hardship. The point of the waiver is to show that you CANNOT move and that it would be a hardship on YOU as a USC to move there. If they see that you can travel for long periods of times or often, they will not consider that a hardship.

I'm not sure how they handle it at other consulates, but after my wife's waiver was approved, which happened to be over one year from the time of her first interview, she had to return for what they called an "IV interview". Turned out to just be a formality, turning in a new DS-230 and most recent tax return info for the I-864, but no questions asked, so it wasn't really a new interview. Hopefully your husband's AP will be over by Sept 4, and they will just ask him for his passport and verify that no info has changed, such as addresses or the like.   4. If her senator is not doing their job... i would try and contact the next closes senator. Find our which one most likely deals with immigration. Don't stop until you get an answer. Some people thing involving senators does nothing, but i truly believe it does do SOMETHING. Only a few weeks after having a senator help us check on our 601 it was approved. And just two weeks ago, (because we've been in AP since then) I had them do another check. Got a call yesterday for my hubby to come to the embassy next tuesday to speek to an officer. Keeping our fingers crossed that this is the FINAL step. I wish you the best of luck. Dont give up hope!

    I am new to this forum. I live in the US and my husband is in Jamaica. We filed all the forms needed and he had his interview July 23, 2012. He was told at the interview in Kingston, Jamaica, that he needed to file for I-601/I-212. The form was overnighted to the Lockbox July 24, 2012, and received July 25, 2012. We still haven't heard anything. We tried calling the Kingston Embassy and they gave us the 202 number which we call then was directed to 603 number. It has been a month but it still show that it is in review process. Can someone tell me how long does this usually takes. I spoke with a lawyer who stated about 2 to 3 months. Can anyone inform me. Thanks! :)

    We filed our wavier in Kingston May 16th and got the approval notice July 17. Hope that helps :)

  6. Interview May 14th- Denied, but eligible for i-601 waiver.

    May 16th- waiver submitted ( we had it already prepared as we knew we would need it- hubby had EWI and was unlawfully present in the US for more than 1 year).

    July 16th- Notice of waiver approval.

    Sent into AP :blink:

    August 27th- Phone message: Asked to come in to speak with an officer on September 4th.

    NOW.....is anyone familiar with this procedure? Or know anyone that has had to do a follow-up appointment after the waiver was approved?? We're not really sure what to expect. Any insight would be appreciated.

  7. Hello, I have my interview in Cd. Juarez Sept. 10th 2012. I might need to apply for either one of i601 or i212 forms. Does anyone know what are normal processing times/ wait times for either of these applications assuming they are filed and paid for right away?

    These above have not been updated reciently, however, I filed a waiver in May 2012 in Kingston, and July 17th we got an approval notice. (We are now in the black hole of AP though) They always say it can vary, and they wont give you an actual answer as to how long it will take. I've noticed most people get them resolved in about 6 months time. Hope you get a speedy process!

  8. Applicants should apply for a Certificate of No-Impediment to Marriage at any office of the Registrar General's Department...prepare to WAIT and go early. Dress approparatly or they wont let you in. They take cash. I think it was about $100 USD. It takes a couple weeks to recieve it. You're going to need a copy of fiancees birth certificate with you and their ID. Hope this info helps.

  9. For the OP, there's nothing to do but wait and see what happens but you'll probably be wise to ignore the K3 and follow the CR1 path.

    should i file for a CR1? Or does this automatically change to a CR1 at the NVC?

    thanks for the quick reply...i guess it's just a waiting game at this point :/
