  1. Hello fellow VisaJourney members,

    I just have a question regarding food stamp and I-864.

    I am married to a USC wife and I have received my permanent resident card through marriage.

    My wife didn't make enough income to sponsor me and sign I-864 so we asked a family friend to do it for us.

    I understand from the contract outlined on the I-864 that if I use any means tested public benefits (such as Medicaid and food stamps), my family friend (the sponsor) will be held liable for that.

    However, the question is, what if my wife applies for food stamp since she may qualify due to her income?

    Would the family friend who sponsored us still be held liable for my wife applying for food stamp?

    I have no intention of getting food stamp as it would make my friend held liable and she would have to pay back to the government.

    And I do not want to do that to her.

    (I know this may looks similar to other posts regarding food stamp but my case is different because the sponsor who signed I-864 is not my wife but my family friend.)

  2. Oh yeah, I meant NOA 1 lol. Wow, I can't believe I typed AOS all the way through without realizing it.

    And are you sure the United States Postal Service registers all the names to an address? I thought it didn't matter according to some friends who told me.

    And I can write a letter to them saying that she didn't have to fill out the tax return just bc she was a full time student? Will that be sufficient?

    I want to first thank you in advance for taking a look at my case and considering to help.

    Well, without too much introduction I will explain my case.

    My wife and I have sent the AOS Package on July 19th and they received it on July 22nd. My wife is a U.S. Citizen and I'm on an F visa.

    The National Benefits Center (I'm assuming) sent my wife three e-notifications on July 26th on her cell phone AND her email saying that they have received my AOS package.

    I think it was August 3rd or 4th that I received AOS 1 for I-485 AND I-765. But since there was no AOS 1 for I-130, I was wondering if something went wrong.

    I was waiting for I-130 AOS 1 until now and I still haven't received it yet. I know that they send out AOS 1 to my wife's address but my wife filled out my address on I-130 for the mailing purpose since we are going to move in together to an apartment in 2 weeks.

    Also, I got an RFE today and I'm praying to God that nothing went wrong.

    They ask me for the joint sponsor's U.S. Citizen status, my wife's tax return form, and my birth certificate.

    Proof of my joint sponsor's U.S. Citizen status and my birth certificate are not a problem since I can send them easily

    However, my major concern is the federal income tax return form. My wife has been a full time student all her life and has not had to fill out a tax return form. She JUST got a part time job and she's been woring there for nearly a month now.

    What am I supposed to mail them if my wife has never filed a tax return form? When she filled out I-864, she wrote no income and 0's for all of those.

    Is this going to be a major problem?

    Also, I'm wondering if the National Benefits Center know that my wife doesn't live with me right now and that's why they didn't send the AOS 1 for I-130?

    Is my wife's address specifically registered to USPS?

  4. Hello fellow VisaJourney users.

    I am about to send in my application for AOS.

    However, before I send in I have some questions to ask.

    I'm getting mixed information about which copy to submit to the USCIS.

    A book I am reading says I should send in the copies of the original documents, and some websites tell me that I should make 2 copies of the original documents and send the original to the USCIS.

    Which one, the original or the copy, am I sending to the USCIS?

    My wife and I got married a week ago and we are currently working on my AOS forms.

    We both reside in the U.S. so I'm hoping that AOS process will be much more smooth and easy.

    I've used internet resources and books to find out what forms I need to send to USCIS, and the basic procedure of AOS.

    The book explains really well on what I should do, but it doesn't have the answers that I want.

    I have some problems with filling out the addresses on the forms G-325A and I-130.

    When my wife and I got our marriage license, we both put my parents' residence address because that's where I live and we didn't want to complicate things.

    So now we're assuming that we have to fill out G-325A and I-130 using the address that we put on our marriage license.

    However, we're not really living together yet but when I move out in a month, we will be living together.

    On the G-325A form where it asks to give the residence within the last 5 years, she put my address on the top and her current address on the bottom of that, basically saying that she is living with me right now.

    So on I-130 I'm wondering what address my wife supposed to put for question #2 (the address section), question #18 (I already live in the U.S.), and question #21 which asks the last address we lived together.

    I feel like writing down separate addresses on the forms, sending it off, get the NOA, and move to the new place and filing the change of address form is going to make things more complicated.

    So I feel like we should put one address for the whole forms.

    What should I do?

    Also, to which address does the USCIS send the NOA of I-130 approval, NOA of I-485 approval and stuff like that?

    If my wife were to use her current address, would NOAs be sent to her?

    So to summarize (within the context of my situation)

    1. Which address should I use?

    2. What should my wife put for question #2 (part b), #18 (part c), and #21 (part c) on I-130?

    3. Which address is the one that USCIS sends the NOA and notices?

    4. How long does it usually take to get NOAs approval of I-130, I-485, etc?
