  1. will I need an affidavit if I have the following:

    1. Boarding passes and air tickets of when my fiance came home with me to South Africa

    2. A rental lease with both our names on it

    3. A joint bank account statement

    4. Photos of the two of us over a 2 year span

    5. The marriage certificate

    Is that enough evidence?

    She is a new grad and will be starting work in 3 weeeks or so but I want to file before that because I want to allow enough time for my AP to be approved before I go home in December to see my family. So I wont have been on her 401k life insurance by the time we file, and we done own any assets together.

  2. When filing the I130 and I485 concurrently do I have to repeat all the the necessary forms for both forms? Like do I have to have multiple g325a's etc?

    Also does every single page of the passport have to copied or just those with stamps, visas, and info on them etc? And then lastly how exactly should the affidavits sworn to have knowledge of the marriage be written? BY Hand, typed and signed and can I one template be used and signed by two people?

  3. weird because in Georgia, where I have my DL, they gave me my DL when all I had was a F1 visa, an international drivers license, proof of residency and a ssn denial letter. It was not straight forward but I made it clear that I needed one for school etc. maybe I lucked out but I had a lot of persistence.

  4. hey,

    I need some help with reference to filing the I864 and I864a forms.

    My wife is a new grad out of college and has a job lined up as soon as she passes state boards etc. Therefore right now she has no income and her mom has agreed to be a sponsor for us so that I can go ahead and file my forms. Now does my wife fill out I864 and then her mom fills out I864a? Or do they both fill out a I 864? And then on I 864 part 1 does my wife check box "A"saying she is the petitioner or does she check box "D" saying she is the only joint sponsor or does she check box "e" saying that she is the first or second joint sponsor?

    I would appreciate any help because I need to file these forms soon.

    also her mom is married and files jointly so do we need to claim 3 people as the household, me, my wife and her mom or do we need to file for 4 and include her dad?

  5. I have another question:

    When filing form I 864, my fiance (soon to be wife) has just graduated and is in the process of finding a job so her mother is going to help us out with meeting the poverty requirements. in part 1 of the form we have to check boxes, my question is which ones to check? Do we check "a" I am the petitioner. I filed or am filing for the immigration of my relative, and then "d" or "e" which is joint sponsorship? Is my fiance the only joint sponsor, or what? I am confused.

  6. My ISO would not do anything for me and I am not sure where I have lied here? My family has been going through a tough financial time back home and I needed to work immediately so that I could support myself this summer and actually eat food. It wasnt about me trying to beat any kind of system etc. And as previously stated an F1 student is only supposed to work on campus and I have been trying to get such a job for more than 6 months and I have no luck in gettibg one as they are all taken. Anyway, all I have wanted to know now is how easy it is to get AP because I want to visit my family in December, and will that be enough grounds to receive an AP?

  7. I would go to your local health clinic and speak to them about vaccines. It may be possible to just have blood tests done instead of some vaccines, such as the titer test (spelling?) which tests for chicken pox and measles immunity, and this may be enough proof that you have been vaccinated before. I know my titer test cost me about $18 which is alot cheaper than the Varicella immunization which would have costed $132. This might be a good way to get around the high costs of immunizatioons. I would just check that this is sufficient evidence etc.

  8. 1) Yes you should file taxes and if possible file jointly with your wife after you get married, then it can be used as an evidence of bona-fide marriage. Working illegally is usually forgiven in such cases

    2) I'm not sure about this one.

    3) You need to meet the poverty limit posted on the USCIS site, which means its not just the amount of raw funds but also income.

    ok so how long does it usually take for the AP to be approved?

    With the work situation, I get paid by check and then I cash it showing my Georgia State Drivers License as ID. Does this get logged on some kind of record under my drivers license? Like can the USCIS or IRS actually track that I am being paid?

    Does my work need to take taxes out my check or can I just file for them?

    I came to the USA on an F1 student visa in August 2009 and shortly after I met my now fiance. We plan on getting married in South Africa in Dec 2012 but we also plan on getting civilly married in the US within the next month in order to get the AOS process started. I have a few questions:

    1.) I have worked a little bit during the summer illegally due to financial hardship with my parents and I needed to be able to support myself, I have been paid my a check made out in my name. Will this be an issue? Do I need to file for taxes?

    2.)I will need to file for I 131 Advanced Parole because I am going to visit my family in December 2011, will this be easily approved on the condition of wanting to see my family?

    3.) Also my fiance is about to graduate nursing school and does not have a job as of yet, if her parents co sponsor and show enough funds will I be fine?

    I have downloaded most of the forms that I need and I have partially filled them out as much as I can thus far. I would appreciate all the advice I can receive seeing as though immmigration attorneys are very expensive :(
