  1. When was your case number assigned?

    And that error message is actually a good sign. Please refer to the FAQ I made in post 1, there's a question/answer about this ;)

    I saw that, but I was thinking that it would let me pay today maybe since it started yesterday. Is it normal to get that message for a couple days?

    I also just received the DS-3032 email a few minutes ago to the beneficiary email. They CC'd me but my email has a typo.

    I received the case number by phone on July 9th.

  2. I can finally fill this out. I didn't receive an email, but I logged into the USCIS website today and it showed approval yesterday.

    1. Country USC resides in: Brazil

    2. Is there a USCIS field office in this country / Is DCF still possible? No

    3. When did you file the I-130: May 2012

    4. How long had you been living abroad: 5+ years on and off

    5. Do you reside in the country legally? Yes

    6. What is the reason for your residence: Living with spouse

    7. Did you list your foreign address on all forms in I-130 package? Yes. I-130 and G-325A.

    8. Did you send I-130 package from abroad? Yes

    9. Did you include evidence of your residence abroad in the I-130 package? Yes. Copies of utility bills, health insurance information, and copy of a protocol for my Brazilian permanent visa request.

    10. Did you mention the fact you reside abroad in the cover letter or write a letter describing your current situation and the evolution of your relationship with your spouse (mentioning your residence abroad)? Yes. Explained in cover letter and submitted as part of my evidence of bonafide marriage.

    11. Has your case been "auto-expedited"? How long between NOA1 and NOA2? Yes. 10 days.

  3. I guess that you get the NOAs in your address abroad. Plz you guys correct me if Im wrong.

    The US address its only for where you intent to live, your address its the one they gonna use for replies. You should put the e-notification form in your package too. So you gonna get the replies by email too.

    I guess Laurie got her NOAs in France, normally.

    BTW, are you applying from Brazil? Me too =)

  4. Well, if you read the answers to the survey, you'll see that ALL members who got expedited listed their foreign address on all forms in the I-130 package. So far, it seems to be the key to be expedited.

    If you do not include your foreign address, there's just no way you will be expedited.

    The only box in the I-130 form where you have to give a US address is "Address where the alien intends to live". We gave my in-laws address and I think others proceded the same way.

    Is that the address they would use to send replies? I was told by USCIS that if I didn't put a US address, I wouldn't receive replies.

  5. Based on what you wrote above, you are visiting Brazil, not "residing there". Let that be your guide to answering your questions. There's a place on the I-130 to indicate where you last lived together. Put the Brazil address there with the corresponding dates.

    The thing is, I have actually spent more time in Brazil in the last 5 years so my residence history on the G-325A has about half the addresses in Brazil. I believe they consider someone a resident after 6 months. I have several stays over this time even though I was on a tourist visa. I just had to pay fines for overstaying the tourist visa. The first address listed in the 5 year history is the current one in Brazil which is also what I put for the foreign address we last lived together. Section B on the I-130 doesn't state "residence" so I was wondering if I could only change that to a US address. If I don't consider myself a resident here then I'd have to change all the addresses on the G-325A for the 5 year history to the US address but it would look like we didn't live together for an extended amount of time since she has never had a US visa.

  6. I'm submitting a petition for my spouse and am not sure what is best to put for my address on the I-130 and G-325A. I am currently residing in Brazil and have applied for a permanent visa so I can stay past the 6 months that the tourist visa allows. Since the process takes so long here all I have is a piece of paper with a protocol number that states that I applied. I also have an address in the US that I use for correspondence and a valid driver's license with that address listed.

    I called the USCIS and they could only tell me that they don't reply to foreign addresses (I didn't see anything in the instructions that explains this). I don't see any area for a mailing address so I am not sure what they would use to send the reply if I put a foreign address on the two forms. The only space that would have the US address is the place where I intend to live. I remember that when the consulate was accepting applications that a proof of residency was required and the protocol number would suffice. I am not sure if the same proof is required to send the application from out of the country because there is nothing stated in the I-130 instructions about this.

    My questions are;

    Would there be a problem using the US address on both forms and have the foreign address for my wife?

    Could I put the US address on the I-130 and the foreign address on the G-325A so they mail back to the US address and see that I am currently residing with my wife outside the US?

    If I use the foreign address, do I need to send proof of residency in Brazil as well? How would they handle the mailing address?

    I'd appreciate any help you could provide. Thanks.

I recently wrote the Rio de Janeiro consulate by email about a question regarding the residency requirement for an immigrant visa petition and in their reply they also stated that they are no longer accepting petitions starting August 14, 2011. Has anyone else heard about this? I don't not see anything about this anywhere else and no announcements on their website. They wrote that it would need to be done at the USCIS, but I do not see an international office in Brazil.
