  1. So I just married my us citizen husband. He is filling out the affidavit of support. He graduated school in may 2012 with bachelors. Therefore his income in 2012 was 30k and in 2013 was 50k. We have w2 and returns for both 2012 and 2013. Besides that, what else should we include? He says he got rid of all the pay stubs. Should he ask for a letter from employer or show bank statements with direct deposit?

    Please let us know what to include

  2. You really have no influence on this process - not much you can do... Are you aware that cap limit for H-1B has been reached just recently ?

    my mployer is cap exempt- higher ed research place- medical related. we have no limit on visas

    My employer is sponsoring me an H1B visa. I am currently on OPT. My employer sent the check already to the attorney for all the processing, and my employer and I sent all the required docs. The attorney now told me to wait so that he makes the file. I was wondering if I should request him to show me the file, or will he show it to me? Will I have to sign it? I feel I do not communicate to much with the attorney, and he does everything for me. I was never used for someone to tell me to relax, because it is in their hands. I freak out, this is how the attorneys handle this, or is it that they do not tell me every single step that they do because I was not the one who paid him, but my company? also, he is a reputable attorney, rated by AILA and I must say he knows what he is doing, he is only an immigration lawyer, not generalist. Can you tell me more about the process? Is it straig forward He says he is, becuse it is just a change of status from OPT to H1B but I still freak out.

  4. are there any risks with applying to DV lottery? I am supposed o have an H1b visa petitioned for me by another company in February 2012. If I apply now for DV lottery might it be that the H1b will be denied because this way I show the immigration intent? Is it safe for people that know that are applying for visas to apply fr DV?

  5. does anyone know how is the prevailing wage calculated? is only the dollar ammount per hour/ annually or it also adds up with the benefits offered such as health insurance, dental insurance , PTO? I saw there is online a calculator from DOL for the wage but wasn't sure if that is the definitive wage in dollars or the insuramce can add up. Now I make on OPT less a dollar than I the prevailling wage. In other words, I make 25 dollars and the prevailling wage is 26. But I am not on H1, I am just on OPT but my employer wants to sponspr me before the end of the OPT. Will they have to increase the salary or my health insurance could offset?

  6. Are you quite sure, they have offered you the job ? There are many skilled US candiadates for a med-tech. The US army trains for med-tech, med-tech's are usually employed by the fire-dept for our ambulance services.

    So, I am a little confuse by why you feel, thus company would sponsor a HB1 and GC for a med-tech.

  7. well, i don't really know why you say that not for profit do not sponsor. my employer does many h1's per year because of the big demand of the job and they can't find good us candidates...so h1 is not the issue. is the issue of wheter they will do the GC later. I checked the myvisajobs website and it shows they did GC in the past for 3 other people. that might seem very little, but it is not. fisrt, how many do they have with h1 first place? probably is a single digit for this particlar position title. and then like somebody else said, they do go home, trasfer to other compnaies or may get married in the meantime. so GC though employment is not the only way for a GC.... I was a F1 student in this country

  8. when would be good to ask for the green card sponsorship? once I am on H1 for a few years? what is the fate of all the people on h1b visas in us? do their employee mostly apply for the green card visa or it is usually that they leave US at the end of 6 years on H1? I am honestly scared because staying here for 6 years is quite long and you make a living, a situation in this country. it would be so brutal to leave the country after 6 years when you have som many things linked to this country.

    also why a post says that they would put you on a F1 visa? that is a student visa..what does that has to do with the green card petition?

    I was offered a position as a med tech- where the entry requirment is a Bachelor degree in america. What are my options now to the green card petition? Would I have to ask my employer if they are willing to do it later for me and if they are not to look for other employer? The job is in demand as is anything in med field. Please advise if it is hard for the employer to get me a green card. they are a large prestigious not for profit hospital

    would maybe getting an advanced degree give me more chances to a green card through employment? like a phd because i would fall in eb2?

  10. I was hired by a presigious hospital and I am surprised I was told that the H1b visa will be handled using an external attorney- they do not have one on site. Also they will have no problem in paying the fraud fee and the petition fee but I might have to support the legal fee. Is that legal? Can I pay the attorney myself?

  11. does anyone have the phone number for VT service center? I need to confirm that they get my change of adress and that is all fine to be delivered. I just send in today a letter overnight to VT explaining that I changed my adress and what is the new one.

    I applied for OPT and it was received by Vermount Center on May 10th, that is 60 days ago. I never received the receipt notice with the receipt number but I called 30 days ago and they gave me the receipt number over the phone. The adress where I was supposed to receive the ntice of receipt as well as the card is at my college c/o my international student advisor. Bevacuse I never received it, I decided to ask for an adress change for my petition with a po box adress t make sure I will get it. I also asked for a no receipt service to be told if further requirments are needed of why is still under initial rewiev. My question is: IS IT NORMAL FOR THE OPT APPLICATION TO BE UNDER INITIAL REVIEW AFTER 60 DAYS? I NEVER RECEIVED A NOTICE FOR BIOMETRIC TEST OR FINGERPRINTS! aRE THEY POSSIBLY REQUIRED AND THAT IS WHY I DID NOT RECEIVED THE DECISION YET?

    WHAT SHOULD I DO? GO FOR AN INFOPASS MEETING?
