  1. I think you should be fine. I did exactly what you're looking to do. I sent off my husband's AOS forms and put my maiden name on the forms (since legally that was still my identity). I've since gone through the process of changing my name on my driver's license, passport, credit cards, etc. Although I think he's going to be in the "interview waiver" group, if we do have an interview, the marriage certificate will show clearly the legal right to change the name. At this point, it's all about him, and little do with you. They can tie your maiden and married name together with your SSN.

    Thanks! That is what I was thinking. I was referring to the SSN, license etc. I know its more about him so I figured I would be alright but I wanted to see if anyone had personal expierence with this. Thanks I appreciate the help and I will begin the process!

  2. Does anyone know if it will affect my Husband's AOS pettition if I change my last name while pending. I want to take his last name, we didn't have time after the wedding to do so and now that the pettition is submitted (a week or so ago). I would like to take this time to change my last name to his although cleary in all the pettiton papers my current madien last name is there. Should I just wait till he recieves his Greencard? Any advice is greatly appreciated!

    I apologize if this is a repetitive question. My Fiance had his Port of Entry on Sunday November 3, 2013 and we literally just moved, so the address has changed since his POE. Which form should and do I use to let USCIS know of the address change until we file for AOS after we get married in early December. Any and all advice is appreciated! Thanks in advance!

  4. I am a returned Peace Corps volunteer who has been working part time and recently began a full time job while waiting for my NOA2. With only my full time position, I make over $26,000 with the hourly wage I earn. In addition, I earn nearly $9,000 with my part time position. As a result I will earn a little over $35,000 with both positions combined. My tax returns have been below the poverty line because I was in Peace Corps but I will be able to show pay stubs and my current income. Will my past tax returns hurt me? I know the embassy is clearly familiar with the Peace Corps Volunteers and know that I am reentering into work. Although I want to make sure that I make the requirements. I don't want a co-sponsor so I am trying to make sure I can be the sole sponsor.

  5. It depends. Current income is the most important thing, however, if your current income is close to the minimum 125% amount needed for your household size, then they may want to see a co-sponsor(if your consulate accepts them). If your current income is well above the 125% mark, then you could probably be accepted without a co-sponsor. It is always up the sole discretion of the CO interviewing you. You need to prove to them that the foreign fiance(e) will not become a public charge.

  6. I would seriously consider a co-sponsor. USCIS won't care about a job that you 'hope to have soon'.

    Well, I realize that there needs to be actual job with actual income coming in, my question is whether having the job six months prior to the interview is not enough time to show that is a concrete job (because I won't have a tax return with the income showing..etc). Will only having the job for six months hurt my chances? I appreciate your co-sponsor advice.

  7. Hi everyone!

    Now, that I have joined the NOA 1 crowd, I am getting a little worried about the minimum income requirement. I was a Peace Corps Volunteer for the past 2 years and didn't file taxes because I was below the poverty line. While I am still on the job hunt, do you think I should file this year even though I am below the poverty line? Or just write the letter explaining why I didn't file and show my W-2 etc?

    Also, I am hoping to have full time employment soon with a salary above (although maybe not greatly above) the 125% line. If I only have the job lets say 5-6 mths before the interview (and the filling out of the I-134) will that be a possible denying in the making? because I haven't held the position long enough? Or is the letter from the employer and stubs enough? I am trying to be the sole sponsor for my fiance, I am just concerned as to whether that is possible to do given my situation.

  8. I am unsure as what to do about the addresses for my boyfriend. He lives in a rural part of Paraguay where there are no real addresses...So I am wondering how should I fill out the residence on the G325A? Should I put the community name as the number and street name, and explain in an attachment how there is no actual address?! Also for the I-129f, the Q2 part B about address & Q 15 about the address abroad. Could I put a P.O. Box mailing address for Q2 Part B and then again the community type address for Q15? I don't want there to be an issue because the addresses are not the same on the forms :unsure: Any help and/or advice is greatly appreciated!!

  9. Ok thats a relief because we want to try to spend as much time together as possible. The good thing is I will be going with him through the point of entry so I will be there as to help explain our story lol. thanks for the advice!

    I noticed that your bf is from Jupiter FL?! That is where I am from! haha I met my boyfriend during my Peace Corps service that ends in December.

  10. So, My boyfriend and I are considering going to the U.S. together in Jan. He would be able to go on a tourista visa and be able to spend more time with my family while I look for a job. Can we apply for the K-1 while he is in the U.S????? Also he would like to stay for at least 2 months out of the three months alotted time...do you think at the point of entry they will give him a hard time?

    So I am struggling to figure out what to do about this Affidavit of Support. I currently live overseas and make basically nothing. I am considering returning to the States in December to obtain a job and start the K1 visa process. This past year I was making below the poverty line.

    I am hoping to making at least 30-35,000 annually this coming year. I have a car and some life insurance, little money in the bank but I don't think it will meet the requirements. How long should I need work before filing for the visa?? Is say 4 months of working (with the letter from the boss, pay stubs etc.) good enough to show that I can support my boyfriend? Or does the money need to actually be in the account? I guess I am just confused about the poverty level 125% requirement ($18,912) and exactlt what combinations of things I can do to show it?
