  1. No need to mention any specific agenda items for the visit, even if one of them is your own wedding.

Awesome. That is basically what I wanted him to do. He rides BMX and is a pro BMX rider, and that is how we met here to begin with. He has always said that he is here to visit friends and ride BMX and never gets hassled... even tho he is completely covered in tattoos haha.

Thank you so much for your advice.

  2. I know "the truth" is what we are supposed to say.. but what exactly. I am paranoid I have planned our wedding [family flying from out of state, food, venue, reception venue etc] to the last detail and that upon POE he will be denied for saying he's getting married.

I know it's perfectly legal for him to come here on the visa waiver program to get married with the intent of leaving then for us to apply for the CR1 [our plan] ... but what should he say exactly and what supporting proof is strong enough to not be denied to show the POE person who will be approving him.

I live in Texas, his normal POE is in Houston.. and he's never had a problem.. but are there any POE's that you guys suggest that are way more laid back?

I am getting so nervous about him being denied entry and then this entire wedding we have planned won't be able to happen, I won't get to marry the love of my life, and I'll be so sad.

Thank you guys for your help and words of encouragement.

  3. I just need a super clear answer of if this is going to work and there wont be any penalties going this route.

We are engaged, wanting to get married. We were going to go the Fiancee visa route until I realized the CR1 is the better option.

I have been told that my UK Fiancee can enter US [Texas] under the visa waiver program and us have a wedding and get married... then him leave back to the UK, and then me file a CR1.

Is this for real or is this too good to be true.

  4. be careful with just getting married and him leaving, my friends wife is from Germany and she came over and they married... she had to go back to Germany and when she came back the next time they arrested her and denied her entry saying that she didn't have the right visa when she married a US citizen... (at least thats the story I was told, don't hold me to it)

That's scary. I don't know enough about it but assuming that we have proof of the CR1 in progress when he comes to visit again I don't see how it would be an issue. We don't want to do the K1 visa route anymore and I don't want to get married in England anymore because of the extra expense.

  5. Yep, that's what we did! We came to America and had documents showing that we were returning to the UK (return ticket being the most obvious one!) but my husband wasn't even asked a single question about it and his entry to the US was no different than any other time. Still, better to be prepared and have evidence of ties to the UK. Just check with your home state, or where ever you decide to get married, about any requirements before applying for a marriage license. We got married in Vermont and applied for the license the day before the wedding, but I'm not sure all states are the same. Good luck! And have fun!

I wonder where I can look to find that out. The requirements dont say he has to be a resident of Texas. And just says to show proof of identity.. the only thing that worries me is it says "and social security number" which he doesn't have.

I want to book our venue and be done with this stress. But I am scared now that they won't let us marry? Or do you think im fine

  6. Oh my goodness I did not know we could have married here if he left and then filed the CR1

I am crushed!! We would have done that over a year ago!!

    :,(

He doesn't need anything to enter here except using the waiver program?? Doesn't need to speak of it at the gates? What do we do in order to marry here? That may be the easiest if England proves to be an extra £600

  7. Howdy all! Thanks in advance for taking the time to help me.

I have done tons of research over the past year on the k1 fiancée visa and marrying my UK citizen fiancée here in the US.

It wasn't until tonight I realized the CR1 was a favored option here on visa journey and so I looked more into it.

    1) is this cr1 the best option

    2) can my UK fiancée actually visit here during the process after marrying in the UK (its been iffy across message boards I don't have an exact answer)

    3) any tips as to not be denied

    4) the most important, what do I need to do to be able to enter the UK legally to marry there and return shortly after to process the cR1. Any tips on that?

Thank you very much. I am so lost with a head full of brand new knowledge and a new game plan

  8. Ideally, he should stay out of the US at least as long as he's been inside, so 3 months. That doesn't mean he'll definitely be denied if he comes back after a week, but chances are greater. He can still visit during the K1 process, and even if he does end up getting denied at the border, it won;t have a negative effect on the K1 unless he lies (like, says he doesn't have a fiancee or something).

I have read on here that there is a certain time he shouldnt visit... is that after the NOA2? Up until then he is okay to visit?

Basically... I'd love to know what are the exact things to NOT do so we can just follow those rules. It seems so iffy and confusing. I've been researching this stuff for 2 years now and I still feel scared to go forth with filing in fear of him being denied entry after going through the entire process.

  9. Hey!

First and foremost, thank you in advance for taking the time to help me.

My fiancee and I have planned to file in March for our fiancee visa. We were just talking the other day about him coming back to visit once more for 3 months [the maximum legal time he can stay] and THEN filing for the visa.

He is due to leave tomorrow back to England [where he is from]

He has been here for 3 months [90 days tomorrow]

My question is... how long does he have to stay out of America before being able to fly back and visit again just as a tourist for 3 more months?

    ALSO...

More importantly... is this frowned upon when filing for the fiancee visa AND can it hurt him [be denied entry] when he tries to go through the port of entry AFTER obtaining said fiancee visa

We would love to see eachother for 3 more months during the summer before going through the process of filing for the fiancee visa. We have been together for 2 1/2 years already and hes been here 3 times and me to england once.

    Thank you again everyone!
