  1. I would contact the Embassy in Santo Domingo. See what the status of your case is as it relates to the Follow-to-Join regulations. The negative thing affecting you is that so much time has passed.

    I'm sorry if I wasn't clear enough, but that post was just to try to figure out if people can "lock in" their follow to join benefits past the one year mark.

    We did it, we are currently in the US and we came on that follow to join from 1997.

  2. Hello everybody, I just wanted to share part of my journey here and also to sort of find an explanation to what happened then. Here it goes...

    My Grandmother (LPR) filed a petition for my Mom (F2B) back in the late 80's or early 90's I don't have the exact date. By 1997 my Mom's pd is current and she follows trough all the process. She's got her visa and my big sister got hers as derived. At the interview the CO tells my Mom to "go and find a job" so we the rest of the "gang" (4 more kids) could get our visas.

    She enters the US on April 1998, she worked for a while (about 2 years) and then returned back to DR, and inquired about our visas, at this time my big brother applied for a derived visa and was not issue because the AOS was missing.

    3 more years passed by (2003) another try with the same results as the previous intents. As the years go by my Mom seems to be forgetting about the idea of getting us here. My big brother is worry because he had heard about aging out and all that and he really wanted to come to the US.

    Early 2006 My big brother sends a letter to the US Embassy in Santo Domingo stating that we were ready to finish the case, this time all four of us apply for a visa, we did all of our medicals and everything related to the visa process.

    At the interview we are told that we are missing a couple of documents from the AOS. By the time we were done with the process of gathering papers and redoing medicals it was already 2007 almost 10 years from my Mom's arrival to the US.

    Bb: APR 1984

    LB: NOV 1987

    LS: AUG 1995

    I felt like I had to post this because after I had read through a lot of post here and done some research, I still don't know how was it possible for us to immigrate base on my Mom's petition. The only thing that comes to my mind is that probable there was a visa application for each of us at the time of my Mom's original interview and this locked the benefit for almost 10?

  3. hi, i arrived here in the usa 2wks ago as an immigrant and still waiting for my green card , i have a live in partner and 2 y.o. daughetr in the phils. what is the fastest way to bring my family here. thanks for those who will reply

    You could do a follow to join for your daughter, she could come in a couple of months, then go back to the Phils and marry your partner. You will need to file a petition (I-130) for your partner and will be place in the F2A category, the current waiting time is over 2 years.

  4. Listen up. You're a guest in the country I was born in, and you're actively campaigning to change the laws in a way that I don't agree with it. I have a vested interest in seeing that the laws benefit the whole country and not just a few individuals because if this country goes down the toilet I don't have another "home" country to return to. I don't frankly give a ####### if you want to hear my reasoning or not. If you want to exercise your right to voice your opinion then you have to accept that others are going to exercise their right to vocally disagree with you.

    I am a LPR and I have to totally agree with you, you cannot pretend you are going to come to a country and try to impose your will over what's already established there, I really like Jim proposal for a special visa that would allow F2A's to come to the US, without allowing them to work nor use any tax supported mean. I would have love to have my wife with me throughout this journey, just a thought.

  5. I am planning to file a I-130 for my 4 year old child, who now lives in Jamaica with her mother. However, I was initially thinking about filing for her to spend the holidays (summer & Christmas) with me here in the USA. My concern now is what do I need to file along with the I-130 knowing that she will not be living permanently until about 2 years from now. Please advise?

    Are you a USC? If so she will obtain US citizenship from you on arrival, then she could go back to JA without worrying about the time she's going to spend there.

    You need to follow the guides at the top of this page, they are very helpful.

    This is how it went:

    Our interview was schedule @ 9:30AM, we arrived at 7:50AM. A guy took our appointment letter at the entrance to the embassy and gave us a number, we were inside the embassy by 7:55AM.

    Around 8:10 they called our number (431) to window 21, there they asked for passports, medical, police certificate, and Dominican ID. Then we went back to the benches.

    Waited for about 10 minutes and our number was called again, this time to window #13, this window in to take the fingerprints. I noticed the guy had our file, and on top of it, the piece of paper they give out when you are approved, I commented this with my wife. Anyways we were told to go back to the waiting area and that next time they call us is going to be for the interview.

    It was 8:40AM when our number pop up on the screen, this time was window #22. It was a young guy in his low 30's, he greeted us and ask our names, and I pronounced my name with the "American accent" to let him know I spoke English. Then he asked me in English if I had any other children, then same question to my wife in Spanish, he also asked her if she's ever to the US and our baby's birthday. Then he looked at my passport and said: Congratulations your visas has been approved just pay the delivery. We were on our way out at 8:50AM.

    I'm very happy right now, just relax and tell the truth and you will be fine!!

  7. OH Gosh, I have paid both fee almost a month and half ago but I thought I have to wait for NVC to send me the paper work to complete. What a good I am. Please let me know what do I need to send them

    You'll have to fill out the form DS230 with all the civil documents, and the form i864 with all the supporting docs. There is a guide at the top of this page, read it, if you have any questions after that, post them.

    I am now confused bcoz I am getting a lot of information that i dont know already what will i follow...I am IR2 approved still in the Phils, traveling on december 10 since visa will expire on December 30,2011.I have a 7 yr old daughter, what should be the process so that i can get her?or can she travel with me?

    Do I need to asked something from the embassy to travel with my daughter or I have to wait when I have arrived US already.and process everything there?

    IR visas don't allow derivatives, you will have to wait until you get to the us to start the process.

    As soon as you get here you should file the form i130, it will be a F2A case and current waiting time is about 2.5-3 years.

  9. Greetings - Is there someone who can explain how the priority dates actually work? I have been reading as much as I can find on the topic but am really stumped. For instance, my Father-In_Law petitoned to have his three remaining unmarried adult children immigrate to the USA. This was in 2003. We have a priority date of October 14, 2003. When I checked the VISA bulleten for October 2011 it shows a date of 15JUL03 for the F2B catagory for China. But when I looked at VISA bulletens for 2010 the priority dates listed were, for example, 01JUL05. If the priority dates for F2B were indeed for 2005 back in 2010 then why wouldn't my Father-In-Laws three adult children have received a VISA since thier priority date was prior to 01JUN05?

    This whole priority dates mechanism is very confusing. Also, between the time my Father-In-Law petitioned the government to have his remaining three adult children immigrate to the USA back in 2003, he has become a US Citizen. WOuld that make a difference in the priority dates for his original petition? ANd idf so would anybody know how we should proceed to inform the government the change in my Father-In-Law's status?

    There is only a limited number of visas available each year for FB petitions. At the beginning of this year there was a retrogression, this means that the PD moved backwards, that is why you saw 2005 las year and 2003 this year.

    Now that he is a USC he can upgrade the petitions to FB1 and their priority date should be current. The PD for FB1 is in 2004 already.

    U.S. Citizenship and Immigration Services (USCIS) acknowledges the fact that your case is still pending processing and is currently beyond our normal processing times as reported on the website. Unfortunately, there are no Visas available for your relative's preference category at this time. Our office processes these cases as our resources and priorities allow. We closely monitor visa availability to ensure no undue delay occurs.

    Don't worry about how long it takes to get approved, your PD is still far from current, it is just as they told you, they will make sure to get it done before your PD is current, that's what matters. They took 605 days to approve mine.

    I don't know how to handle the taxes, so i don't know if your expenses got to do with your adjusted gross income, but as far as i know they only want to know how much you make a year period. They will then compare that number with the poverty guide line.

    Try consulting a tax accountant.

    then come back to use spend 6 months and go back home that is how i didnt pay the text but i want to pay all last three years tax but i still didnt get the answare of my question

    If is about the amount that you need to show, our dear friend EAbbas already answered that, you HAVE to pay taxes on everything you earn regardless of the purpose. So you should pay on the 30k.

    I was saying that if the next VB is gonna jump even a week.Then I should get an interview date in the next couple of days.

    It is just as Ricardo said, you are better off just waiting for the email than the disappointment from a negative respond.

    I just got about 4 extra days from calling, and to tell you the truth it wont make any difference, anyways you will have around a month to prepare tfor your interview.
