  1. I haven't seen the applications, affidavit of support or know the entire story. So I'm going to comment, not against you, but how an outsider might see it. So don't think it's an attack, it's just things to get you thinking so you can make a plan. You don't have to answer. They are just rhetorical questions to get you thinking what you showed or what more you could have shown.

    • Was your son's Affidavit of Support based on a job he no longer has?
    • Was it based on cash assets inconsistent with a student? Does it look like you pushed a lot of cash his way to gain immigration benefits?
    • There are inconsistencies with living and working in Louisiana, but driver's license and voter registration in Texas. By Louisiana law, he had 30 days to transfer his TX license to a LA license. His voter registration should be in the Louisiana parish (county) where he lives. Voting in Texas when he doesn't live there isn't the way to do it and is illegal for some local elections.
    • Can he provide documentation that the language course has a specific start and end date and is two months long? Can he show how learning Maltese is important to his course of study? Or even Italian which is spoken there? Is he really just being a playboy hanging out on the beach? Did he book a return ticket with a specific return date that coincides with the documented end of the language course.
    • Are you all born and raised British with no other ethnic background?

The lady didn't pick you out as somebody to be mean to. There is something that doesn't feel right that she needs to investigate. The people who do this job are actually very good at what they do and they have pretty good instincts. Look over everything with an objective eye and decide how you can best approach this. Right now it doesn't appear that your son has domicile in the US because he has no job or place to live and he's out of the country. Your case is different from a father going to live with his son, daughter-in-law, and the grandkids, who have lived in a home for 10 years with steady employment at the local WalMart. If you can't come up with a solid case of your son's domicile, then maybe you will need a new joint sponsor.

Edit to add: You are only eligible for DCF if your son had permanent residency in the United Kingdom, which he didn't.

Thanks for your reply and I wouldn't take in a offensive way especially from you that is always trying to help as much you can here on VJ!

My son had a job at FEDEX in Louisiana on part-time bases because he was Studying Law since he finished Aviation High School in Seattle.

so the Affidavit of support didn't really count that much his salary so we got a co-sponsor!

No cash pushed on his way!

I agreed with you regarding living and working in Louisiana and Voter Registration and Drives Licence in Texas (honestly not sure if he transferred or not)I need to find out that from him and I will get back to you!

Actually is not learning Maltese and Italian(Who needs to speak Maltese..Lol)he is learning Arabic/International Relations and yes he should be able to provide dates! He is looking to work with the American Intelligence Service ...Do you know that inside the CIA only 3 staff members speak fluent Arabic out of almost 3.000?Playboy my son? not at all...!

Yes!! We are no Brits!! We are from Galicia (Spain)...my kids mother Brazilian background already a American Citizen!

What called my attention from the minute I walked to the first window was the comment from the staff member" You are a rare IR-5 because of your age! We don't have that many 45 years old IR-5...Yes I'm only 45 and my son 22 years old!! So obviously he should be studying instead of working at some WalMart! Grand kids no way Jose!

My son have a Spanish(double nationality) passport so DCF could had worked for us.We are already looking for that co-sponsor he doesn't have any employment at this moment!

When he applied on my behalf he was living and working and studying in Louisiana...He always had this Malta course on his mind since 2010!

  2. Did you give your son's address as Malta? How did she know? She is correct that if you told her your son lives in Malta, then he does not qualify. If he still maintains a residence in the US then you need to document that, as well as other things like recent utility bills sent to him at that address, his valid US drivers license and voter registration with that address on it. His tax returns should show the same address.

All this time and you never posted that your son wasn't in the US. How long is he away?

Nich-Nick thanks for showing up!! No I never gave my son address in Malta! When my son filled the petition he was in the US living in the US working and studying in the US up to the time my case got completed at NVC(he lived in Louisiana, worked in Louisiana, voter registration in Texas and drives licence from Texas)...soon after that he decided to come and see me and take a language course in Malta related to his studies! So he is simply studying in Malta for a few months...When she asked were your son lives? I answer he is at the moment studying in Malta! Now what he needs to do to proof that when he doesn't have a lease signed in his name? can he show the old ones?he still have a bank account in the US in Texas with his mother's address on it...the same on the voter registration and drive's licence! I was under oat so no lies I guess!

He left Louisiana end of August, stay 2 weeks with his mother in Texas then 2 weeks here in London and got in Malta by the end of September and start studying first week of October!

  3. Does this woman have something against Brit males, I wonder? I've already told my fiancé about this and to be prepared if he gets sent to her next week.

She is nuts....she goes on and on and on...and BAMMMMMMM 221g form in YOUR FACE!

Yuck! I'm sorry you have to deal with all that ####### :( Hopefully everything will be approved quickly, though. As in Stu's case, just send them whatever they need, send a lot of it and you'll be approved soon! :)

I was not planning to fly until next year anyway...but to get a new co-sponsor is a pain in the artic!

  4. Expires Dec 28th 2012 (6 months after medical Jun 28th)

I had my interview yesterday got the same crazy woman grilled me to the bone (window 16 long hair, bad flu) that went crazy on me why my son was out of the US gave the 221g asking for a new co-sponsor when mine made enough money way above of the poverty line and proof of domicile from my son when I told her 100 times that he domicile in the US and he is just into a language course in Malta!

Ticked the first 2 boxes on the form! The fight goes on!!

  5. Benuk,

How did your interview go? I'd love to hear what the consul asked you and if you had to show documents that you already submitted to NVC.

Well it didn't go very well the CO was rude to a point of nonsense ! She asked me for a new co-sponsor since my son is out of the US for a few months into a language course! My co-sponsor earn above the poverty line! For god sake... :crying: plus she kept saying why my son is out of the country...why...why...why..why...and I saying that still he domicile in the US he is just out for a few months!

Got the blue form 221g after 20 minutes of hell...so now is find a new co-sponsor and send some proof that my son domicile in the US!

My son already sent a email to his Congressman to look into the case so is more waiting....  I'm trying to keep cool but!

  6. Fanbloodytastic. The docs are holding my results until I forward the results of my 24 hour blood pressure results (whenever that may be). I'll see about getting my first MMR jab when I get the blood pressure monitor fitted and see about getting a record faxed to the medical guys to be added to my record as mentioned earlier then. Worst case scenario, my father in law to be is a GP over there, so hopefully won't be a major issue. Really hacked off they've put this whole process on hold for me because my blood pressure was a bit high due to nerves. Now it seems they are giving out blatatenly wrong information!!!!!

Howdy, I had a BP issue on my exam and I was told that even if my GP would take for example 3 BP in a time frame of a day and would show a okay number would be okay for them at the clinic!so do you need to get a 24hour monitoring? this will take you sometime to get back to your GP once is done by the Hospital that you will be sent!

  7. We have the CR-1.

It's not that we couldn't give it up and get a tourist visa, it's just that it is most likely that we will return and can't imagine having to go through the process again. Plus, I believe Brazil no longer does the DCF processing, which only took us about 3/4 months.

Hello there, I do believe that you will only find out the outcome once you travel to the US and face the CBP and just explain what exactly happened regarding your work prospect in the US etc...etc...!Boa sorte pra voces!

  8. Sorry I meant to say that I would wait until you get a date!not actually the interview itself...I've seen people here jumping the horses and the Medical getting to the Embassy before the Embassy get anything from NVC and the Medical sometimes get lost! So get your date once you have a date just call them and book your app. 2 weeks before the interview is a good time frame!

  9. thanks .... I got confused by their instructions:

"All documents not written in English or in the official language of the country in which the interview takes place MUST be accompanied by a translation in English." So I assumed no translation was needed.

NOT written in English = Translation

OR in the language of the country= Spanish,Italian,German,Polish= NOT in English=Translation

Don't forget to send a photocopy of each document or translation you send!

  11. Hello everyone -

I have a question to all of you who just got throught the NVC stage. I am confused about whether civil documents sent to NVC need to be translated to English or not (in my case, mom is coming from Russia). I get mixed info about it. Could anyone kindly let me know for sure?

And How do I create a timeline? I mailed I-130 on August 30th. NOA1 is dated September 5th. Thank you!!!

All translated to English and original...!
