  1. I am wondering because we could use some more time to come up with the money for filing for his AOS. I am not sure about the I-94 card. Would that be included with his K-1 visa? We had up until December 4th to get married. Is that when his legal status will expire? It would be much easier to file for his AOS after I get my tax return in February but that is a while to wait. Is there anything else we need to do right now? Send a copy of our marriage certificate in? File for anything else? I have tried to look up this information on the immigration website and can't find the answers to my questions. This is the first I have heard about an I-94 card. Will we be in trouble if he doesn't have that?

  2. We finally completed the K-1 visa procedure and my fiance arrived on September 4th. We just got married on Friday. :) I have searched the immigration website and can't find an answer to my question. Now how long do we have to file for my husband's permanent resident card? Does it need to be immediately? What is his status now?

  3. Question 11 on the affidavit of support asks the sponsor to state that he or she intends or does not intend to make specific contributions to the person being sponsored. Am I correct in thinking that question would apply to someone coming here on a temporary visa? As shown on the example on this site, I wrote "N/A (K-1 Visa process for permanent residence.)" on my form and the form my brother filled out as our cosponsor. Is this correct? My fiance will be living with me, of course. Do I need to indicate that on the form?

  4. I am mailing documents to my fiance today and I want to make sure I am not forgetting anything. I have the affidavit of support that I filled out along with my W-2, recent pay stub, and letter from my employer. My brother is our cosponsor so I have his affidavit, birth certificate, W-2, 2 recent pay stubs, and letter from his employer. Is there anything I am forgetting? Do we have to submit proof of relationship for the interview or is that just assumed since our petition was approved?

  5. I can use Fedex. The problem is just that my brother is worried about his paperwork being intercepted and basically his life being ruined if someone steals his identity. I know people have to send paperwork to other countries all the time, but it is a legitimate concern. I want to find out what methods other people have used to send their documents because I want to send them in the most secure way I can.

  6. My brother is the cosponsor for my fiance and he is understandably concerned about all of his personal and financial information being sent through the mail. I am sending my documents too, but I feel responsible for making sure all of his information is protected. What is the best way to mail all of our documents for the visa interview? They are going to South Korea. Can they be sent by certified mail? Can I send them directly to the embassy? Can they be scanned and sent electronically? Thanks.

  7. My brother has agreed to be the co-sponsor for my fiance. I have a few questions about the form:

    Does my brother fill out the same form, I-134, that I do? Do we have to note on the form that he is our co-sponsor?

    Question 11 asks the sponsor to state that he intends or does not intend to make specific contributions to the support of the person being sponsored. I don't make enough to be my fiance's sole sponsor, but I will be providing his home and support. Does my brother have to state that he does intend to make specific monetary contributions to my fiance's support? If he states that he doesn't, will our petition be denied?

    The I-134 only specifically asks for the last income tax return if the sponsor is self-employed. Do we both have to submit copies of our tax return? Do we only have to submit a W-2?

    I know that my brother and I will both have to submit form I-134, copies of our birth certificates, and possibly copies of tax returns or W-2s. Is there anything else that we have to submit?

    Thanks for any help. The deadline for my fiance to apply is fast approaching. :)

  8. He is living in Korea and was already able to get a tourist visa from there. He came to visit for a little over a month when our son was born. His tourist visa is multiple entry and has time left on it, so he could come visit again. I would love for him just to come on a tourist visa and get married, but I don't think that's possible. I guess he could come visit, then leave again for his interview, but that would involve a lot more money.

  9. This may be a dumb question but I would like to know if my fiance's interview can be scheduled within the US if he is visiting on a tourist visa. We have our approval but are running out of time for our deadline. He still does not have his medical or fingerprints and I am working on our affidavit of support with our cosponsor. We also could use more time to come up with the money for his fees. He is ready to leave the country he is in and it would be great if he could come visit me and our son instead of having to go back to his home country while we take a little extra time to get everything done. Is it possible for him to interview at an embassy here or does this have to be done outside the country?

  10. Our petition has been approved and my fiance and I are working on gathering all of his documents and scheduling his medical and fingerprints. I think extending our interview date might be necessary because we only have 4 weeks to go to get everything together and we are low on money for fees at this point. A little extra time might be necessary. How do we extend the time we have to schedule his interview?

  11. Yes, I know we will have other fees. We have a child together and he is going to join me here in the US. We have no other options. I know everyone means well, but I don't need to be scolded like I'm a child. I'm in a very difficult and sad situation right now. I just wanted to know if we could get a waiver for the expensive visa fees and it appears that we can't. We will have to come up with the money somehow. Thanks for the replies.

  12. We have our petition approval and now my fiance is gathering all of his paperwork to apply for the visa. The problem is that we really don't have the money available to pay for all of his fees at the moment. He is a student and not working. I am supporting our baby on one income right now. I thought I read somewhere that some fees can be waived depending on the person's financial situation. Does anyone know if this is true and how we would request that?

  13. I would like to know if anyone has successfully filed to expedite a petition and how you did it. I know petitions are taken on a case by case basis so I am wondering if my case might meet the criteria and how I can go about pleading my case to immigration. My fiance was here for a month on a tourist visa for the birth of our son. He had to leave again on February 29th. We are due to hear something on our case by the middle of April according to the timeline. Our son has some medical issues and I would like to have our case expedited so his father can be here with me. Our son has some problems with his breathing which we are currently treating and trying to find out the cause of. He has acid reflux which may be causing all of his problems, but at our next pulmonology appointment they will decide if he needs to have a bronchoscopy to check his lungs to see if something is going on there. He has to have a sweat test for cystic fibrosis, which is very unlikely that he has, but they are doing it to rule it out. I took him to the doctor today and the doctor heard a heart murmur. He will have an echocardiogram to check his heart. Everyone tells me that he is going to be fine and I would never make his problems sound worse than they are. It is just extremely stressful to have our newborn going through so many tests and having these health problems. I can't do this alone. If anyone has any suggestions, it would be very helpful. Thanks.

  14. My brother is willing to be the cosponsor for my fiance but I am not sure how many people his income will have to cover. He is married with a stepson but he does not claim his stepson as a dependent. Does he have to make enough to cover his household size plus my fiance? Since his wife and stepson are not dependents, will he just have to make enough for himself and my fiance? Thanks for any help.
