  1. I cannot remember what ours stated. I believe it was just that he wanted to be treated as a US resident for the purpose of filing our taxes for that year. Included our names, SSNs signatures and dates, as far as I can recall.

    This is the advice I've had from two different tax advisors as part of their free advice. All have been certified and said that we MUST do it by paper and send a written notice. Admittedly one of those was a TurboTax tax advisor

    No, it won't have to be a paper file since you should have gotten his SSN by now.

    I again was under the impression we have to be paper filing because I have to make a written declaration in order to be treated as resident for tax purposes?

  3. Ok, trouble is we want to file jointly to get a bigger tax break. Based on your links we can do that.

    I cannot see where and on which form we would declare his forreign income. I assume we cannot use the 1040 EZ, and instead have to use a 1040, or 1040A, then attach the written declaration to say 'please treat as resident' and then include a 2555 or 2555 EZ. Again I assume we cannot use the 2555 EZ because the residency is split.

  4. So husband arrived on the 5th, and we're planning on filing joint married. I've never really done this before but I know we have to file a paper based return because he's never filed before (a 1040 yes?)

    The bit that's confusing me is that he doesn't classify as a resident alien and we've been told that we have to put some kind of declaration with our tax return that states he's a non resident alien but wishes to be treated as resident.

    Then there's the issue of what we do about the income he has received while he worked in the UK. I think it was Nich-Nick that said about a form 2555? but we really don't know what to do here.

    I'm utterly confused so if anyone could give me a step by step I'd really appreciate it!

  5. So, Photomile posted at '9pm' saying he couldn't sleep. I'm here at 2:30 in the morning, yippee! It's storming here in Dallas and the thunder won't stop long enough to let me drift to sleep. And of course, once you're awake for any long period of time...you get hungry, ah! Haha. Oh, and totally anxious about his interview, so that isn't helping either! Been waking up every so often going "*GASP* What time is it!? Has he had it yet!?" and nope...not even an hour has passed. :wacko:

  6. sounds like most of you here have gotten your NOA2 notices already. hoping i hear something soon.

    1-17-12- mailed I-129F to vermont service center

    1-19-12- check cashed

    1-24-12- notified of NOA1

    1-27-12- NOA1 received in mail

    2-9-12- last time "touched"

    8-13-12---still waiting for NOA2

    wondering why this is taking so long. my I-129F submission hasn't even been 'touched' for over 6 months now. the USCIS site says they try to process these applications in 5 months. i am into my 7th month now. i guess they aren't trying very hard.

    anyone out there know anything about this longer wait time?

    Definitely call USCIS and see if you can launch a service request. If they give you issues, try getting in contact with your local congressman, some have had luck with them, some haven't, but they have a bit of a pull when it comes to this. Good luck! I'm hoping this is your week!

    Oh we're both nervous, but he is understandably more than I am. I will probably be up at 3 in the morning anxiously waiting to hear from him while sipping on coffee to stay awake. Yeah. We're both nervous lol

  8. I think I'm turning blue in the face from holding my breath for this long. Come on Vermont, you're doing great, keep it up! Congrats to all who are approved, what a tremendous feat. May the next step in your journey be quick, easy, and uplifting. I'm reading this forum every day in work (which may or may not be a bad thing, I get so drawn up in it I lose track of time and the work that needs to be done, whoops). I hope the good news carries out through this week, next week and I'm crossing my fingers hoping those with RFE get record response times! (Positive thinking, positive thinking, haha)
