  1. Currently she is here on a tourist visa and He is a US citizen living in mexico. She plans to stay here for the 6 months that her tourist visa allows. He was going to come to the US and marry her and then go back to Mexico to prepare to move to the US. Does he need to be living in the US to file for the green card? What is the CR-1 ? Is that a better route to go in this situation? Would it be better for her to go to Mexico and for them to get married and then file for the green card from there ? Thanks for the help i appreciate any knowledge you can give me.

  2. Anyone out there know how tricky it is to get married on a tourist visa? I have a friend who is a US Citizen has lived most of his life in mexico and met his giflfriend there. She is in the US on a tourist visa but they want to get married and live in the US. Should they get married in the US or in Mexico? What happens if they get married while she is on a tourist visa? Does this present any problems since they have met before? He still currently lives in Mexico, can he come here and they get married and then file for her AOS or should they get married in Mexico? I need advice. Help!!!

  3. My fiance's K1 Visa finally got approved. It took 7 months for the consulate to give us access to their site http://mexico.usvisa-info.com/ to schedule an interview. We scheduled the interview for July and it got approved. We did the bio-metrics prior to the interview in a consulate closer to my girlfriend's home of address in Mexico and went to Juarez for the medical and consulate appointments. We did the medical tests 2 days prior to the consulate interview. Plan to stay there most of the day. Got there early before 6PM and the results were given out after 2PM. On the day of the consulate interview, she told me there were a lot of people unprepared thanks to their incompetent lawyers. A lot of people had paid hundreds of dollars to lawyers just to get denied there because they were missing things like photos, evidence or some document. Many of them showed up with an envelope given to them by the lawyer who had told them not to open it. However, they were soon showed their way to the door because they did not have all the docs. People please do your own homework. Read the USCIS page and this page for everything you need. Do not trust lawyers!!

    I'm just waiting now for my fiancee to immigrate to the US to live with me, get married and get on the I-485 waiting line :)

  4. I was wondering if anyone has ever requested an advisory opnion after the denial of a K-1 visa and how you go about requesting an advisory opinion. My fiance had his interview in Mexico and admitted to occasional marijuana use and I have been hearing that this is not by definition, drug abuse/addiction, but thats the reason it was denied for one year. I heard that there is a challenge process and you can request an advisory opnion. Anyone know about this??

I am wondering if anyone can offer some advice about this, I have seen some posts about people applying for K-1 visas and being denied at the consulate due to convictions or admissions of prior drug use or drug problems. Most of the posts I have seen were before the 2010 change to the drug abuse/addiction from a 3 year deferral to a 1 year deferral. In my case, my fiancé is from Mexico and went to Juarez June 2011 and admitted to “recreational” use or marijuana because he did not research the strict rules on this and we got screwed. So therefore he was deferred a year for that. I am wondering how likely it is that he will be approved in a year. What steps he needs to take to prove “remission”. What happens with our I-129F? Will we need to re-file? Can we get the time extended? Anything else we may need to know. I am completely devastated that we are losing a year of our life together over such stupidity and bad luck. If anyone can offer personal experience or any other knowledge I would SO appreciate it. PLEASE HELP!
