  1. now that you are a citizen, the I-864 on you filed by your aunt is no longer in effect.

    1. yes - GUZ IV needs to see YOUR I-134, even if it doesn't qualify fully.

    2. yup, parents count, you don't. Count on your I-134 is 2 - you and your lass - count on yer aunt's is her, your parents, your lass, plus (I THINK) anyone else they would have claimed as a dependent on the tax return (unsure about this last part)

    3. supposedly, but the math is tricky sometimes - Whilst the tax returns show both, her W-2s show hers. If it's not a complicated return with other schedules and forms and income types, can show the joint returns WITH her W-2s.

    But I'm no expert on the affadavit of support - hopefully someone else will chime in, and soon.

    One more question: Since my parents are counted as family member of my aunt, will it be a plus if my father (his taxed income is about 20k only) become a 2nd co-sponsor for my case? My aunt's annual income is about 45k per year and the HHS Poverty Guidelines for family size 6 is about 30k.

  2. On the I-134, I am not sure how would be best to answer this question:

    "9. I have previously submitted affidavit(s) of support for the following person(s). If none, state none."

    I am currently full-time student with no income. So I am asking for my aunt to be my co-sponsor ( my parents' income(taxed) is not qualified)

    1.Do my aunt and I need to file I-134 individually?

    2.My aunt submitted I-864 affidavit of support for my parents and I on 2005.Is it correct that my I-864 was terminated when I became a citizen(read from forum)? So we only need to write down my parents' name?

    3.I am confusing about the family size since my case is complicated...Not sure whether the family size for my aunt is 4+1 or 4+2(My aunt, her husband+my parents(I-864)+my fiancee+(myself)) ?

    3.My aunt files tax jointly with her husband. does I-134 only consider her income?

  3. What do you expect a notary's certification to say? They can't certify that a copy is authentic because they have no way of knowing if the original document is authentic. They can't certify that a translation is accurate because it's likely they don't speak both languages. Notaries in the US have very limited authority. In most states, they can only act as a legal witness to a signature or oath.

    :( I just read some articles about that...you are right, they cannot certify that...Maybe it is better to provide them a timeline of events.

  4. Did you book all of your tickets using a travel agency? Could you contact the travel agency and get them to send you the correct documents? Have you tried contacting the airline and asking them if they can verify which flights you were on?

    I have the correct documents for airlines. The receipt I mentioned is for hotel expense and tour guide expense that I spent on a short trip with my fiancée to another city in China. Sorry for confusing you...

  5. I received REF on June 17th,2011. They ask for evidence of meeting the beneficiary in person within the two years period. Probably, it is caused by lack of airline ticket stubs. I only save one stub out for two round trip. However, my fiancée and I had a short trip during my last visit. And I asked the travel agency to send me the receipt for travel expense. The travel agency did so but the date on that receipt is 09/25/2010. Our trip is from 09/03/2010 to 09/05/2010 and I returned to U.S on 09/21/2010). I intend to explain why the date on that receipt is not in the time period I visited my fiancée, but...it may also make my case more complicated...Probably, I am afraid that they treat the receipt as a fraud. Any suggestion? Do I need to include it? Thank you.

  6. This one confuses me, you entered China using a Chinese Passport. Is it standard for China Immigration Inspection personnel to stamp passports of Chinese citizens?

    Sorry for making you confused...I got my U.S. citizenship on Feb 15th 2011. What I mean is that I used the Chinese passport went back to China last year(2010). And they do stamp Chinese passports whenever you go in or out of Chinese border.

    By the way, I keep one airline ticket stub from my last trip. However, the flight is one-stop flight and the stub is used for travelling from Shanghai to Guangzhou. The flight number is exactly the same as the receipt I got from the travel agent.

  7. I hope you got the evidence to show them the proof. what you need do is to organize the documents to make clear that you were with your fiancee. They don't do investigation to check it. they want to get the documents and evidences up front. In some cases, you should have to explain in writings.

    Ye, I did make a checklist and use post-it sticker to indicate what is what...do not know what's wrong with my application...That's why I am really nervous.

  8. Just called uscis...and the representative asked me to find an attorney and she could not answer my questions ( i did not even ask the questions...)

    Andie, thank you for your reply. As long as the REF does not ask for notary, I think word-for-word translation for those documents are enough... actually, I have already submitted the things they ask for (except the translation and film-date photos). Sony's camera does not have the function to show date. I have to use the software to put the date on...

  9. Recently, I got the REF mail as following:

    "REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: It mus be established that the petitioner and beneficiary have met in person and/ or have been in each other's physical presence at any time during the two years immediately preceding the filing of this petition.

    Last Personal Meeting-Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition (3/32/2009 TO 3/23/2011). Primary evidence may include airline ticket stubs and receipts (that indicate month, day, and year), copies of passport pages that show the identification page and admission stamps, military order(s), letter from Commanding Officer, or any evidence that will help the USCIS to determine that the petitioner has met the beneficiary with the two years. Secondary evidence may include film-dated photographs of the petitioner and beneficiary together. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards. "

    I have several questions:

    1. I did submit the copies of passport pages which show the identification page and admission stamps. However, I got my citizenship on February 2011 and I used my Chinese passport for traveling. Do I need to do notary for it?

    2. I did not keep the airline tickets stubs and all my tickets were booked by travel agents. They sent me the receipts and e-tickets via emails. Can those receipts and e-tickets be counted as evidence?

    3. My fiancée and I did not take many photos together. In some of the pictures(took when we visited SHANGHAI EXPO last year), she was wearing sunglasses. Can those photos be counted as evidence?

    4. Last question... During the time I visited my fiancée, She and I had a 3-day trip in China. I saved the hotel and the airline ticket receipts. I did not do translation for those receipts and I am going to do word-for-word English translations. Do I need to do notary for the translations?

    I am kind of nervous and I keep calling uscis but do know which option shall I choose...

    sorry guys...I have so many questions...If you can help or give me some advice, I really appreciate it.
