  1. Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?

    No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

    They would still have to use I-864 for the AOS, which means they would still need that income to fall at 125% of the poverty guidelines, that is why it is highly recommended that the income meet that level from the start.

  2. I THOUGHT K APPLICANTS USE 100% AND 125% IS FOR I864 ONCE YOU ADJUST STATUS?? EITHER WAY MY DAD MEETS. SO U THINK HE SHOULD PUT THE REST OF THAT INFO ON THE 134??

    My understanding, and from reading the poverty guidelines itself, it states that only active military can use the 100% values when petitioning, all others 125%, Alaska and Hawaii both have their own seperate values as well. If he meets the 125% there is no need to put the rest of the info on their, unless you just want to. But to meet the guidelines, you don't need it from what you are saying. Best wishes.

    You have to use the poverty guidelines for the year in which you are filing... and you use the 125% values, not the 100%. http://www.uscis.gov/files/form/i-864p.pdf

So my wife has her interview for permanent residency on Thursday, and it says that I have to be there because I am the husband, but does anyone know if we are allowed to take our 9 month old baby with us? My sister lives about 35 minutes from where the interview is, so if we had to we could take him there even though it is pretty early in the morning, but it would be easier if we could just take him in with us. Any advice? Thanks!

    You should be able to bring the baby, if any doubts, just call them. I have not ever heard anyone say it was a problem before.

    Thank you for posting this! and Mz. Barracuda-- in the k1 visa instructions provided by the consulate it says that you must fill out a DS-260.

    only pay attention the directions in spanish-- in english it says you need to fill out a DS-160, it's a typo you do NOT need a DS-160 (i think lol)

  6. Medical must be done at one of the two approved clinics in Juarez...I belive (not positive) that you can ask for copies of your medical to be used in the USA at your AOS appointments...someone chime in on this???

    I will be going thru Juarez in two weeks so can comment farther on this in the future.

    I just found this: the DS 260 is for "family based" immigrant visas, not for fiance visas. Here's the link to explain that the DS 260 is for those who has filed I-130 petitions.

I am seeing some post by VJ members saying that the medical exam needs to be done in USA, but I am confused by that being that they don't have permission to enter yet........... for K-3, CR-1 visas. As far as having them done in Mexico, in Cuidad Juarez, I have heard there are only a couple of doctors that are "accepted" by the USA Immigratation Progress..... those who have gone through this, can you help clarify? Also, if your exam was done in Mexico, where did you go, was it costly, how long before you got your results back? I do know that a medical exam for AOS is needed and that one would take place in the USA, but isn't the one I am referring to.

    In response to the answer: SSN, STATE ID, MARRIED ... I am a little confused. I thought you couldn't just apply for a social security card while you are here on a K-1 Visa, I thought you couldn't get the social security until after your AOS. I could be wrong, but that is what I have heard.

  11. The USCIS says they mailed the petition to the NVC for processing. The NVC says they never got it, four weeks later.

    I was told to email them a scanned copy of the NOA2 to the NVC so they can investigate it. Still have heard nothing.

    Has this ever happened to anyone else before??? I'm getting a little frustrated I almost want to see if they'd let me mail them the extra copy of the petition that I have. How can they just lose it like that?? I want him here on time, not delayed!

    That is terrible. Hope they find it and are able to sort it out for you.

  13. Well, looks like I´m going to get a new FM3. Yes, I cancelled the old one, so I shouldnt have to worry about fees or grace periods. I´m getting all the paperwork together now because it seems like DCF is worth it. Can´t wait till all this is over!

    Hi ... what does "DCF" stand for? what is the difference of filing in Mexico or filing in the USA.
