  1. hello guys! i have something to share and i hope you guys can advise me, coz i'm a little bit confused for the next step. sigh

    i was married to a Dual citizen US-Filipina last march 2011. she brought me here via fiance visa. we have a 4 month old daughter born last june 2011 here in anaheim CA, USA. i already have 2yr GC (conditional) and EAD, SSN (received Green Card Sept 22, 2011). so were starting to gather information regarding removal condition for residency. i'm working temporary on a retail store. my wife is also working part time as a caregiver. but we can't afford the cost of living here. My aunt (co-sponsor) is helping us to pay our rent, utilities and sometimes for the food. so our plan is to send my wife and daughter to philippines for the mean time until i can save money. but i don't knonow if sending them back to philippines is a good idea now that we have to be together for 2 yrs to prove our marriage for ROC on sept. 2013. pls help me! thanks

    1. what are the needed documents for Removal of condition?

    2. do i need to notify USCIS if my wife goes back to philippines?

    Looks like you can apply for Medi-Cal but it's possible your sponsor will be required to repay.

    Which Public Benefits Will a Sponsor Need to Repay?

    Sponsors who sign "enforceable" affidavits of support (Form I-864) may need to

    repay "means-tested public benefits" used by the immigrant after he or she becomes

    a lawful permanent resident. The only federal benefits that are considered "meanstested"

    are: Supplemental Security Income (SSI), food stamps, CalWORKs, Medi-Cal

    (nonemergency), and Healthy Families. Most immigrants whose sponsors signed

    "enforceable" affidavits of support have not been eligible for these federally funded

    programs, due to a five-year bar (waiting period) on these services. California

    provides benefits to some of these immigrants using state funds. But California has

    not decided which state-funded benefits a sponsor may need to repay and cannot

    ask sponsors to repay benefits used before it makes this decision. States are not

    required to go after sponsors, and to our knowledge, no government agency in

    California has sought reimbursement from a sponsor up to now.

  3. Hello OP, first of all, congrats. you guys made it. i just want to ask if the Immig. Officer ask your copies of form I485, 1765 and 864? because when i submit mine, i did not make a copy of those. so i'm kinda scared now coz my interview is on sept 12 and i only have bills, marriage cert, photos, birth cert of our newborn, bank account together and other tax documents. wish me luck! ty

    the long wait is over, today i got an email notification for EAD card production (1st email was on aug. 3rd) and for my GC interview on September 12, 2011. what evidence i should bring? i still don't have SSN, i don't have bank account, no california i.d, no billing statements, no car insurance, no health insurance and our apartment is sponsored by my aunt. (her name is on the lease). my usc wife is currently unemployed.

    is this enough?

    - wedding pics

    - birth certificate of our newborn

    - can we bring our baby during the interview?

    - letters from relative

    pls help. thank y'all

  5. the biometrics was for your EAD as well. When you got the RFE it paused your EAD as well. You got RFE'd right after biometrics and it took around 2 weeks for you to reply so you're really at 2 1/2 weeks of EAD processing. I think it shouldn't be too far away.

    do you mean 2 1/2 from now? or from the date they got my response for RFE? thank you very much!

  6. Wow… wonders if it's not a record time considering that my case was not requested to be expedited. I send my AOS papers on June 15 by snail mail and today (August 2nd) USCSI website shows that my I-485 is in production. CSC was taking care of my case.

    Just can't believe it. I could only think that all the good advices that I got from this site had made the difference.

  7. As you did RFE and returned it and they got it 15th July I would say you should get your EAD card very soon like next week if not by then yes I would call and see whats happening. Your GC is still in the time frame of 4 months though.

    for the record, i haven't received ANY updates about my EAD case status. they only update my AOS. so i should call them first? thank ya

    here's my problem. i filed AOS/EAD last april 27, 2011. they received it by MAY 2, 2011. so today, AUGUST 2, 2011 it's the 3rd month of my application. my case is still process on NBC. i'm already done w/ biometrics (JUNE 29, 2011). they issued RFE on july 1, then submit my response on july 11. (they got it by july 15). my wife is USC. she's currently unemployed and we have a 6 weeks old baby. we're living in a apartment in anaheim, ca sponsored by my aunt. (w/c is also my wife's joint sponsor in this case). we don't have anything excepts $400 dollar coming from my grand mom's SSI. i need to work now! but this EAD application won't allow me to. it's exactly 3 months! can i call them to make an infopass?? and also i still don't have interview for my green card.

  9. Hi. i applied for AOS and i got biometrics taken 2weeks ago. and im waiting for some news but i hear nothing so far.

    is there anything that i have to do or should i just wait to get EAD ? anyone help please? :/

    hello there. well, at this point. all you have to do is to wait whenever they give you RFE. (w/c will delay your AOS/EAD application). if not, that's good. you may have your

    EAD 2 to 3 weeks after biometrics. (this is what i see to other people's timeline). in my case, i did my biometrics last june 29, 2011. got RFE after that, send my response last july 15 and right now i'm still waiting. it's almost a month since i had my biometrics appt. sigh! :wacko:

  10. I have my interview tomorrow am and I m already feeling butterflies in my stomach....lol but not the butterflies like when u r in love but that awful sensation when u have to go to a DR or something....

    I m nervous and scared and I just hope everything goes well, I m done with filling out papers, scanning documents, etc.

    I will let u guys know how the interview was tomorrow when i come back, I also know that they won t give me an answer straight away but i m sure my lawyer and I will have an idea...

  11. Hi Can anyone tell us what exactly the BIOMETRICs apointment is.....what exactly do they do. It says to bring ID....but should we also be bringing other past documents???

    My husband came here from Jamaica on a K1 fiance visa and we have applied for the Readjustment of Status, working papers, and traveling documents all at the same time.

    1. He arrived here in February 17th

    2. We were married April 23rd

    3. Readjustment of status, working papers, and traveling documents were ALL filed for in the end of May.

    4. This biometric apt was the next step and is tomorrow July 15th

    We just want to be prepared before going Any information would be appreciated.

    Also How long do you think it will take to be granted permission to travel outside the country

    all you have to do is show up, bring your I.D and appointment letter. (do not bring cellphone, cams or any gadgets). PAINLESS!!n :)

  12. Yes, just wait until it gets picked up. I did not call their office or the USPS. The day after the USPS website said it was "delivered", I got a case update on the USCIS website stating they received my response to the RFE.The blue dot on on the case status on USCIS website now says "request for evidence response review".
