I suggest you NOT take this approach, at all.

While you think is less documents NOW, it will be more documents after she's in the USA, to file the Adjustment of Status.

Plus you have to materially substantiate WHY you divorced her, and wish to file another I-129F petition after divorcing from her.

IMO, your temporary estrangement can be covered in a cover letter submitted with the I-130.

embassy in thailand went really smooth for the k-1 only hang up we had was the father of child wasn't helping us signing off on american passport even

though he had nothing to do with her,And a nice woman at the embassy helped us press him .thanks agian chris

Is she your fincee or wife? If you are married, you can petition her again but this time she will apply for CR1/IR1 visa.

thank you yes she is my wife we were married after she got here in 2009 .Only am worried about the boniafied stuff about marriage, it took about 15 months to get her here on the fiance visa and she was only here 7 months than went back home.I was in the process of selling my house so she has no record of living with me as far as joint accounts to little time here.And we were having a few problems so I didnt add her to checking or credit cards until we were to work out.i do have her on insurance and life insurance but thats it.Now she's back in thailand so only phone and email records to date.I will look at the cr1/1r1 visas.Thinking might be better of divorcing her and starting the fiance part all over less documents?thanks agian chris

Are you asking if the mother could follow the daughter?? I think no...

It may be possible for the Daughter to petition for her mother... how old is her daughter, and is she here in the states now??

well the daughter is only 5 yrs old and went back with mum in feb last year. But i am thinking could some how have her come with daughter to the u.s
