  1. What evidences did you submit specifically?

One medical record copy (Showing my payment for her medical expenses)

W-4 Form (Showing us both on tax records)

Medical Benefit form (showing her as the beneficiary)

Cell phone Bill Copies (Showing us both on the same cell phone plans)

Three Affidavit letters (From Myself, my Father, and my Mother)

Several family photos showing our time together during the marriage (with family members).

  2. Just got a Request for Information letter after submitting Form I-751.

The main reason listed for the RFI was, "You have not sent sufficient examples of shared assets and liabilities spanning the entire period of the marraige."

A little background: I am helping my divorced wife (who is still living with me in a relationship, yes we're working things out) fill out this I-751.

The I-751 application was jam packed with evidence and affidavits showing bona-fide marriage. But never once during the marriage did I expect my wife to contribute financially because instead of working right away after enring the US, she devoted her efforts to going to school and learning English. We never shared any assets (house or car) because she just didn't want to be on them - which is a common and very normal thing for many married couples. We have every kind of evidence that shows we entered the relationship on good terms, and even have evidence that shows I am still supporting her and living with her in a relationship. However when it came to finances, I was the sole bread-winner, paid for everything, and kept all of my assets under my name. At this point I'm not really sure how to proceed.

  3. * My wife and I are divorced. She is filing I-751 by herself (waiver as good faith divorcee).

Under Part 3 "Info about the petitioning spouse" - is this to be left blank because she is waiving joint-filing as a divorcee? Or is this section for me, the ex-husband (US Citizen)?

    * Since my ex-wife is waiving a joint-filing petition, does she still have to send in her I-751 during the 90-day period before her conditional residence expires? I thought this was just for regular applicants filing jointly?

    * At the end of the I-751 application, there is a section for "Information of Person Preparing Form." Technically I, the ex-spouse US Citizen, am filing out the form and submitting it to USCIS - so is there any harm in filling this out for myself? Will this guarantee that all vital information/mail is sent to the "preparer" rather than the petitioner?

    Thanks!

  4. Here's a quote that has confused me on the I-751:

Biometric Services Appointment - After receiving your petition and ensuring completeness, USCIS will inform you in

writing when to go to your local USCIS Application Support Center (ASC) for your biometrics services appointment.

Failure to attend the biometrics services appointment may result in denial of your petition.

Does this mean that my ex-wife has to physically show up to a "local ASC" center for biometrics?

Is this mandatory in all I-751 applications? Where are these "local Application Support Centers"?

    Thanks in advance!

  5. First, conditional GC is 2 years. Thats only given if you've been married less than 2 years at the time that first one is approved.

If you've been married more than 2 years, it's a 10 year card.

So, she already has the 2 year, and she'll ROC to remove the conditions and get the 10 year card. Every card thereafter will be 10 years (unless she gets citizenship).

Thanks so much for clearing that up for me!

  6. She should have no problem ROCing if she has good faith evidence (bills in same name etc). Even if you wrote an affidavit for her (if you're on good terms) you could do that too.

More often approved then denied honestly.

    Okay, that's good to hear.

However, she's asking (and I'd like to know) how they grant legal time in the U.S. after ROC.

Do they have two categories, like 10 years max, then 5 years?

Is there a minimum of years granted, as low as 1 years?

The more planning she can do, the better.

    Thank you!

  7. Depends on the amount of good faith marriage evidence.

Okay, so it can vary or be less than that - based on the amount of evidence?

In our case everything has been in good faith, we were happy, but it just wasn't working out culturally.

Her life goals turned out to be different than mine.

I'm also considering just waiting until her ROC comes up, then going through with a divorce.

Maybe there's no difference with the two.

  8. I'm in a similar situation - I think.

    1) Married my non-U.S. Mexican wife in Mexico

    2) Non-U.S. wife enters the U.S. with CR1 Spousal Visa - now has permanent resident card that expires 5/18/14.

    3) After living together for 1 year, we both happily agree that things aren't working out and want to peacefully separate. We are on good terms.

However, she still wants to stay in the U.S. and live/work with her brother in California.

Conditions: We have no kids, no joint assets. She doesn't want spousal support afterwards.

    Concerns:

    1) Do we file for devorce before or after the divorce waiver?

    2) Since we were legally married in Mexico (not the U.S) do we have to get a divorce in Mexico, or the U.S.?

    Thank you for the help!

  9. If she has not yet applied for a SSN, have her go to the SSA office with her passport and green card and do so, even if she opted that it be sent automatically as part of the CR process. It sometimes doesn't work that way.

Worst case scenario is that they may tell her 'it's in the mail'.

Gld all has worked out for you guys!! Vgood luck!

Ah good tip! I'll definitely try that.

So other than that, she doesn't have to do anything in particular like follow up with the government?

Its now on to the citizenship path after she lives here for 3 years...Right?

  10. I want to thank everyone who helps around these forums. Last May my wife successfully traveled to the United States through the CR-1 Spousal VISA program. Finally!

I do have a question though.

Since she's been here, she's had her green card sent to her in the mail. But that's it. No social security # yet.

Is there something she has to do now that she's in the United States? After she's her and has her Green Card, whats next?

  11. My wife's interview is coming up soon.

I'm gathering all of her required documents, but I'm confused about one thing:

    Her "Invitation Letter from Consulate."

Is this the same thing as the interview letter that was e-mailed to me by NVC? The e-mail was titled "P4 FOR NEOPOST DS-1200) and it has the appointment date and time, along with a barcode on the top.

Or do I actually need a letter from the consulate in Ciudad Juarez?

  12. No it’s a company. The driver did mention he was advertised, I say listed in the website for the airport. Here is the link.

    My link

There are some phones close to the exit to the airport on the right hand side towards the car rentals. The airport is small which makes it easy to get around. I recommend Paisano but there are others. I called a few some had a two hr. wait. After being apart from my husband for two years and seeing him every six months, two hours was too much for me

So call around. Let me know if there’s anything else I can help with.

    Awesome, thanks lovAton.

  13. $50 each way.

Paisanos Transportation 915-346-2655 I just went there in 4/17/2012. The driver was great and he is willing to schedule ahead of time. Safest and cheapes way From the airport to the door of your hotel! Safe driver and very nice.

Is this a bus service? I can't find them online

  14. We are going to fly to El Paso and take a Taxi from there to our hotel in Ciudad Juarez. Does anyoe know if you can take the taxi straight from El Paso airport into Ciudad Juarez to a hotel DIRECTLY? Without changing cabs at the border? thanks :help:

Actually, I called up Border Cab Taxi, a service that for about $60 will take you directly from the El Paso Airport to across the border, and to the Ciudad Juarez Airport. Apparently they have permission to do this. I'm sure if they'll take you to the Ciudad Juarez Airport, they'd be able to take you anywhere else in Juarez.

    Give them a call.

    (915) 533-4245

    3600 Frutas Ave

    El Paso, TX 79905

(By the way, haven't used them, was just told to google a taxi cab service in El Paso by the Juarez Consulate.)

P.S. Hey, Minicyni, did you schedule an appointment with a medical clinic? I know we're supposed to for ASC, but for Medical?

  15. They might not be able to tell you specifically what they have; they might only be able to tell you they received your package. There's phone numbers listed here: http://usvisa-info.com/en-MX/selfservice/us_service_options

Thanks Saylin, but I think they're only able to change my appointment with this number. It asked me to enter the petitioner's passport number and date of birth, but I held up because I didn't want to enter some kind of automated menu that would change her interview date.

  16. Okay, just a couple of weeks before we embark upon our Consulate journey in Ciudad Juarez.

Before I go I want to call up the consulate and double check to make sure everything NVC has forwarded them is correct.

Does anybody know of a number I can call to get a hold of a real person who can verify all the information NVC sent to the consulate?

(Just need to check if all the addresses are the same, all the employee info is correct, etc.)

Don't want ANY surprises if they have made a mistake forwarding my stuff over.

  17. I'm debating whether or not I should fly direct from San Antonio to Ciudad Juarez (for $300) or if I should cut the price down to $170 by just flying into El Paso and crossing into Mexico on foot.

Is it difficult/dangerous to take a cab directly after crossing the bridge into Juarez? I'll be taxi'ing to the Ciudad Juarez Airport.

Anybody have some first-hand experience of this?

  18. Don't worry about your interview date not showing up. It's the same for Canadian IR-1/CR-1 applicants (we use the Canadian version of that site). We have to sign up for a DHL location, and after it's all done, on the applicant summary page, it says there's no appointment currently scheduled either. But it's fine as your date was scheduled by NVC. That portion for the interview date applies to K1 applicants (for Canada anyways) as they schedule their own interview dates through the site.

    Super!

Now I gotta check with the Medical clinics. ASC phone operator said they were walk-ins, but to call and make sure.

    Thank you Sensei Saylin. =)

  19. I tend to distrust URLs with hyphens, and this one looked a little suspicious to me too. But it's legit.

I just created the account for my wife (as the beneficiary). No problems with doing that.

    Awesome.

However, I went in and created account, but in the section that read:

    If the applicant:

·Is starting the process and would like to read information about this visa category, please select "Immigrant Starting the Process- Family-sponsored"

.Received an appointment from the NVC, please select "Immigrant Schedule by NVC – Family-sponsored"

.Has been asked to schedule an appointment by the Consular Section, please select "Immigrant Consulate Has Asked You to Schedule - Family-sponsored"

I selected "Recieved an appointment from the NVC, please select "Immigrant Schedule by NVC - Family Sponsored."

I think I screwed up because on my account page, it says "You currently have no appointment scheduled."

Should I have done "Has been asked to schedule an appointment by the Consular Section?"

And if I go back in and do this, will it screw me up because I already selected the other option?

By the way, I did already select a DHL location, and it says "There is no information on the DHL Waybill Number at this time."

Need some help before I go onto the next step here, I don't want to screw up anything because they assigned a reference ID #

  20. I was reading on my consulate's website (http://ciudadjuarez.usconsulate.gov/iv_steps3.html) that I need to go to http://mexico.usvisa-info.com to create an account, schedule an ASC appointment for my Mexican Spouse, and then register a DHL pickup location.

However, when I go to create an account should I set this as myself (the US Citizen Petitioner) or should I create this account on behalf of my Mexican Spouse (beneficiary)?

Also, since I found this http://mexico.usvisa-info.com website on the consulate website, I'm assuming its not a scam and really necessary. Right?

    Thanks!
