  1. Hi,

I have a pending petition and I am under F1 visa. I want to visit USA and see my mom. I still have to wait 11 years for a visa to be available. Can you please tell me how could I visit USA and have 2 months vacation... I understand that it is very difficult to get a tourist visa here in the Philippines specially if you have a pending petition... :-(

Can anyone tell me if there is a possibility that I could get a tourist visa????

Thank you and God bless everyone!

  2. Hi,

My step dad filed a petition for me on July2008 I-130 unmarried children of U.S. citizens over age of 21. I'm from the philippines. He is a US citizen. The petition was already approved and was forwarded to NVC last year. My mom didn't file for citizenship yet. She's still a permanent resident of America. My question is, Can my stepdad or my mom file an affidavit to change my petitioner? Instead of my step dad petitioning me, she will be the one who will petition me. Correct me if I'm wrong, if my petitioner is my mom my waiting period will be decreased right? From F1 it will become F2B right? Please help me understand things.... Can we still change my petitioner without going back from the scratch?

I would highly appreciate your answers.. Godbless

  3. Hello,

I've posted my issue month ago about my petition. Below is my information and it has been posted here in VJ. I'm still confused about my petition and the visa application. I got a letter from the NVC last month saying that i fall under F1 visa. My step dad called and verify because he said that he didn't apply for that kind of visa. NVC said that they had a mistake then asked for 2 weeks to fix it. After 2 weeks my stepdad called to check then NVC said that they made a correction and a notice will be sent to us within 90 days. Can anyone please help me understand this. Does NVC really made a mistake in this case?

(note that was posted a month ago)

I am 27 (unmarried). My stepdad filed the petition for me June2007. He is an american guy. My mom and He got married year 2000. I was only 17 that time. My mom and my younger sister who is 8 years old that time entered US with a F-129 K1 visa. I didn't come with them that time because I want to finish my studies here in the philippines. After graduating college I started working and did enjoy it. Now I'm already 27 and wants to be with my family in the US. Stepdad filed a I-130 petition for me and got approved this year and he said that I'm a K2 visa coz that was he applied. Is that right? I'm wondering if I qualified for a K2 visa? i've read many articles and i found out that K2 visa is for under 21 years old.

I received a letter from NVC saying that visa is not available for my use. I fall to F1 visa category. My stepdad called NVC to verify. He said that he didn't applied for an F1 visa. Surprisingly, NVC admits that they made a mistake with my stepdad's visa application for me. NVC gave us 2 weeks so they can investigate and fix the error. Guys do you think that NVC really made a mistake? Do I really qualified for K2 visa? I'm so confused.

  5. "the first prerequisite for the step-father to be able to file any petition for the child is that he married the child's biological mother before the child was 18. Once that requirement has been satisfied then there are three options:

[*] If the child is over 21 and unmarried then they are eligible for an F1 visa. This is a family preference visa, which means there's an annual cap and a waiting time, currently about 7 years for most countries."

**is there an exception for this policy? my mom and my stepdad got married when I was only 17 and that was on the year 2000. However they didn't file my petition before I turned 21 (a letter of explanation made by my stepdad was forwarded to USCIS), petition was filed by my stepdad (USC) July 0f 2008. Luckily, petitioned was approved a month ago (May2011). Is it still under F1 Visa? Is there a fastest way to get a visa? Philippines has a long wait period for F1 visa. Please help.

  7. My mom got married to an american guy who is a US citizen. My step-dad (my petitioner) petitioned my mom and my younger brother who are now a Lawful Permanent Residence of US. I didn't come with them because I want to finish my school here in the Philippines. I was only 17 when both of them were petitioned by my step dad. I stayed with my grandparents here in the Phil. Fortunately I graduated and got a job. I enjoyed working for almost 4 years. In the year 2008 I realized that I wanna be with my family. My step dad filed a petition for me (I-130). I made a research about petitioning child over 21 years old and I found out that here in the Philippines it would take 5-10 years to get a visa available. I told my step dad about what I've found out. He told me that I am still included with my sisters and mom's petition therefor According to him I don't belong with F1 Visa. Here are my questions I hope some could help me understand things:

    1. Some says that the petition must be filed before I turned 21. Is that right? However my step dad just filed the I-130 petition just 2008 and it was approved by USCIS just this year (May 10, 2011).

    2. I heard about CSPA, is there an exception with my case? My stepdad send a letter to USCIS explaining the reason why they didn't filed the petition when I'm under 21 years old. (Before my petitioned got approved, USCIS asked for supporting documents (RFE) like the death certificate of my dad and certificate of non marriage.)

    3. Am I eligible for K2 visa then?

    4. USCIS sent the approval notice to my stepdad saying that they will send the approved petition to the NVC and gave us 90 days to wait for visa processing. It also stated that I will be receiving a paper as well coming from the consulate here in the Phil. If I may ask, All of the notice of approval sent to the petitioner has the same content just like what my step dad received?

Thanks for taking time reading my concern. I know that your reply will help me understand things.

  10. My step dad received the copy of the approval for petition I-130. It says there that NVC will process the VISA within 90 days and I will be receiving papers from the US embassy here in the Philippines. It also stated that if I didn't receive a notification from the Embassy here my stepdad must call NVC.

Is there anyone has the same case as me? The petition was approved May 5, 2011. Can anyone tell when will I receive a notice from the US embassy hir in the Philippines?
