Hello vjers!
I have been reading wether or not we need visa for our stop over in beijing, china and read about the stop over permit stamp that they will stamp in the passport that will let you go ouside the airport and see the city. Has anybody experience this or have information about this? For those from beijing, china what places can you recommend to visit for a day? We will arrive china 5am and our fligh leaves in 8pm.

There is a 72-hour visa-free transit policy for nationals of certain countries that allows you to visit Beijing. Nationals of the U.S. are included, but not Philippines.
http://www.airchina.us/en/aboutus/airchinanews/2012/20121225.html
thank you so much for this information.
By definition a transit visa is for those travelers that are entering the country with the sole purpose for changing planes (most common event). IF you plan to do any site-seeing then you are a tourist and will require a tourist visa. So for your plans you and your husband will need the proper tourist visa for someone from the US and PI. To remain in the airport may require a transit visa. You need to check the requirements for a USC and PI citizen traveling thru China to see if a transit visa is required.
Good luck,
Dave
thank you. i try to call the china embassy here in US to find out because in Airchina website they said that citizen of US is not required of transit visa.

hi vjers!
we will arrive 5AM in china on our way to visit Philippines so we are planning on going out of the airport to see a the beauty of beijing because our flight will depart in 8PM yet that gives us 14 hour layover. My question is, do we need a transit visa? My husband and kids are US passport holder and I am still a filipino passport holder with greencard. also, what can you recommend for us to see for few hours in beijing? TIA

there are states that allow you to obtain social security number using the I-94 as long as it is not yet expired and it is 14 days after his arrival in the US soil and you are not yet married. Since you are already married, i think it is best to wait for the EAD or GC to get him a social security card.

Nope they don't send confirmation for the immigrant but DO for the sponsor... in fact my husband got 2 :S
thank you vanessa&tony that gives me relieve now.

I dunno if I posted this in the right place but I would like to ask anybody who tried changing their address using USCIS AR-11 online. Do you receive any notification that your address change has been successful? I tried it last month somewhere in Feb 2012 and I did not get anything from USCIS. We sent the change of address for the petitioner which we got a NOA after 1 week. Im scared because my AOS is on going now and that would cause a problem. Thanks for those who will reply in advance and please move this post if this is not the right place. Thanks Vjers!

Better to have everything - just in case.. Thank you for your input
Couple people emailed me direct saying K-1 visa, Vaccinations are not required except for the TB test ?
I think vaccinations are part of the US embassy protocol for those who are coming to USA. You dont need to worry about that because all immunization that will be given to your fiance is already paid together with the medical fee there is no additional cost for that. It will also be for your fiance own good to get her needed vaccinations according to her age. The doctor at St Lukes is the only person who can determine if your fiance need the vaccinations or not. The cost of immunization is expensive here in US compare in the Philippines. As for the TB test yes that is required because US is very strict when it comes to communicable diseases.

Saint Luke Medical Center {K1-Visa}
1) Appointment Letter - 2 copes
2) Saint Luke Registration Letter - 2 copies {future wife}
3) Saint Luke Registration Letter - 2 copies {future step-daughter}
4) NOA2
5) PAID VISA Receipt from BPI
6) Email from NNV with their NEW Case number {Alien Case No.}MNL######## *WE HAVE NO HARD COPY YET ??
7) Passports for both of them
8) Extra Passport Pictures of both of them
Did I forget anything ??????
Also what Vaccination is a "MUST" requirement for K1-Visa - I know they will try to sell you everything. I rather have non-required vaccinations done in the United States.
As I can remember you dont need the BPI receipt because the medical fee will be done at st lukes in Philippine PEso.

Hi Vjers!
I am a K1 visa holder and will process my AOS by the second week of February. I know is that all K1 visa holder cannot take employment not unless the status has been adjusted and EAD is already on hand. Does it include any voluntary work? I applied for a voluntary job and just waiting for a call. I need your advises. TIA

He hasn't filed his 2012 taxes because it's still 2012. You're talking about his 2011 taxes. He still needs to send his 2010 return but the low income won't matter because the co-sponsor earns enough.
Thank you vanessa&tony
Yes, it won't be a problem. He could be unemployed and it wouldn't matter as long as your cosponsor had sufficient income.
Also, while you do need a cosponsor if current income is inadequate, tax returns for 2011 aren't due until April 15th so if you file before then you can include 2010 tax returns as most recent. Of course, if you have the 2011 year returns done, you can go ahead and send those but if you haven't completed them don't feel you have to rush.
Thank you very much for the info. Now I am relieved
-
As your sponsor he must include his tax return from the most recent year. If you have a cosponsor it's ok that your spouse doesn't meet the income requirement. They will look to what your cosponsor makes. He still fills out the I-864 and sends his last tax return.
Ok thanks ceadsearc even if that means that his ITR for 2012 is below the required income? having a co sponsor who is beyond the required poverty income you think would suffice the requirement?
-
Hi fellow VJers! I need your insight about this issue. I am here in the US under K1 visa and planning to adjust my status soonest but our problem is my husband lost his business and file for bankruptcy and when we had his tax file for this year 2012 it shows below poverty income. My husband is hesitant to send his ITR for 2012 together with my docs. We had our co sponsor ready because we used one during my visa application. Do you think I still should send his ITR for 2012 even though its below poverty income? We dont have bonds left or any property because we give it to the bank for the bankruptcy. My husband now has a new job for 5 months now, we have his w2 for the new job and it shows he did not earn much. please help on what to do. Any comments is highly appreciated. Thanks

Is this gonna effect the visa process?
The guy's divorce is still on going and he met this girl online and they seem getting along well. The guy is now planning to go the Philippines to meet her, actually he is about to book his plane ticket soon. Is this going to be a problem that he is meeting his gf in the Philippines while his divorce is on going?
I dont think that will cause any problem if the main reason for his travel is meeting the girl. I agree with everybody saying dont submit the I 129F yet until the divorce is final.

Hi to all fellow couples with a Filipino fiance!
We are preparing for my interview at the US Embassy Manila. My USC fiance has an unusual employment history since he is self-employed but shares business ownership of a company which only started recently. Given this situation, we want to be completely sure that the financial support will be enough for a family of 3. I have read some threads related to this mostly saying that aside from the usual documentary proof (tax transcripts, etc), it's also important to show sustained income
I need to know if US Embassy in Manila accepts co-sponsor for K1 visa applicants. If anyone has the same experience, I'd appreciate it if you can share your thoughts on this. Any information related to our scenario will be helpful too.
Thanks guys!
My fiance is also self employed and it was a little bit lower than the required income. We got co sponsor its his dad and we were approved. gooluck

I am self employed... do I really need a employment letter?
I read on here someone made a "self-employment" letter basically saying they are self employed and they have been self employed from this date to this date and stated the nature of his business/occupation and current income.
Would that be okay?
If you are self employed there is no need to present employment letter during the interview. goodluck
-
Maybe they changed that also, I know there have been a lot of changes in Manila since they opened the new building. Key is that they're asking for you to return it with the documents.
Thanks Bob 4 Anna. That's the thing thats keeping me and my fiance sane for now knowing they asked me to send back the passport. I hope this will not take so long because it hurts us so much so far away from each other but have to settle with that because we still dont have other options.
-
hi,
calm down,we been through to that situation, just follow what they requested and send it them asap, they arent denied your case just for thAT matter...
Thanks femloveron. We are just so worried and it cost us sleepless nights thinking about my visa. How long after you sent them the additional you received your visa?
They're asking for the documents because they need them to approve you. If they had what they needed to deny you then it would have happened already.
Once you prove the Divorce and financials that meet the requirements you'll be approved.
If they return your Passport at the end of your interview that is a bad sign.
Oh my! they give my passport back to me and instructed me to send it back together with the additional documents
-
HI everyone! Im done with my interview but was put on 221(g) to submit additional documents first divorce decree original copy and last 3 months business bank statements of petitioner. We are ready to send all the additional documents to US embassy. I am just wondering if there is a chance that we'lyl be denied ( God forbid!)? Duirng my interview the CO said we will print your visa after you submitted the additional docs. Anybody here same situation with me or have been through with this situation? Any ideas guys? You reply would be great help to keep us calm. Thanks in adnvace

A person is a sponsor, not a company. A self employed person uses line 22 of their most recent (2010 in this case) tax return as their income number. Line 22 takes into account certain business expenses, etc. to help lower the amount of tax owed. However, in cases like this (affidavit of support) keeping the tax low means showing a small income amount. This small income amount does not satisfy the I-864P income requirements.
The $377k gross income does not matter. It is the $12,491 that is shown as his income. He can list assets to help make up the income shortfall. Or he could redo his tax return to show a higher income. This would require him to pay more $$ in tax.
These I-864 FAQ may help >> http://travel.state.gov/visa/immigrants/info/info_3183.html The I-864 guidelines are what is typically applied to K visa petitions using the I-134.
Thanks anh map for the help and info

HI Vjers. I recently had my interview and the Consule said that we will print your visa after you submitted the first divorce decree of the petitioner. But as I look at the letter from the 2go window the box with evidence sustained income was marked x. I am confuse because my fiance is self employed. His business ITR for 2010 is 377,640 USD and he has a separate US individual ITR 2010 of 12, 491 USD. We are household of 3- my fiance, his son and me. What else do I need to send back to US embassy aside from the divorce decree? They already have my fiance's ITR for 2010 for himself and his business and I 134. I really need your help. Thanks in advance!
is that how its works even if his company gross income for 2010 is way too much for the requirement?
