    write ur senator and in ur request, ask for a senior consular officer to review your case...also in ur email go over how u met and why u love each other, and give explanations for any reasons why the petition might have been denied (for us it was that i was older and he was younger, we did not follow indian marriage traditions, and we only met 1 time). and specifically ask what are the reasons for the denial? this way u will know why u were denied..

    u can also fill out a form G-639 - found on uscis form page - this form is for u to use to see ur file...ask for all the consular officer's notes to be included as well. this will help u to refute ur case..

  2. We had our 2nd k1 interview in Delhi last week. We both noticed something...a lot of denials are due to miscommunications. If your fiancee is not fluent in American English that might be the reason. she might not be understanding the question asked. For us, our interview was going fine and then my honey answered a question and then the CO got super aggressive asking him questions. I finally told my honey, "Honey Listen". then he finally was able to give the correct answer. Later we talked about it, and he said both me and the CO misunderstood him. We realized it was due to how American English is spoken. I saw this with another man too. I felt so bad for that guy - we all heard his answers and I knew he wasn't understanding the questions. I also saw that they will expect American answers - aka honesty and no covering of embarrassing situations. I don't know how to state this but in India and Mexico, people will give a polite answer instead of the truth to not be rude or to protect their honor. However, CO will want plain honest answer and not a cover up polite answer. I hope people can understand what i mean. that poor guy was giving confident yes answers but not giving the CO the detailed info that the CO wanted.

    please list docs asked of you so people can help you out to see what they want.

    i also noticed that for indian couples that were both present - the CO would still interview them separately or ask the indian USC to stay away from the counter. We saw one couple get denied. The USC Indian man was so mad that it was denied and made a scene, but the CO (an Indian women) kept telling him, sir she didn't answer the questions correctly, i gave her a lot of chances etc. when he asked to see a supervisor, she said she was the supervisor. but we also saw other indian couples approved too.

  4. She submitted everything at VFS about 12 days before the interview, and the way it seems is that the Co did not even review the evidence before hand. She asked my fiancee if we were really engaged and that indian engagements are a big thing, like your supposed to have a party and all that, my fiancee said we did have a party at a hotel and there were about 120 people there, then my fiancee said here is the album and banquet hall recipet take a look, then the CO said no I do not want to look at the album, nor do I want to look at anything you have. The CO then said if your fiancee has been here 2 times after the engagment which was in JUNE of 2010 why cant he get married here and live here with you, why do you have to live in the US after marriage lol, I do not know what more they want. The white 221G that thye gave says submit the following documents with your passport at the nearest VFS. Everything they want submitted we initially submitted prior to the interview, maybe they just did not review it. Can any one tell me how long it takes for them to review everything now that we are submitting all the same stuff with a white 221G.

    we went shopping, whoo-hoo!!!, at largest mall in Asia, Reliance mall, and had Sbarros...yum!!!!! we both kept getting sick on this trip, total bummer, but i'm glad we were just together. We also started to buy items for our wedding in US...YAY!!!!!!

    btw, questions asked were completely unique to our case. it focused mainly on my honey's conversion to christianity. he was even asked if he was attending a church.

    Was the USC allowed into the embassy? If so was the USC asked any questions? Those two questions might help in the future for people who have to go through the same embassy.

    Thanks!!! Yes my Fiancee was allowed to enter the Embassy and the VO asked her a lot of questions too,pertaining to the relationship and everything else .

    Yeah the first time they did refuse ,though the second time we did not want to take any chances we took about 2000 sheets of documentations with tons of pics too !!! Trust me it was super heavy bad i was carrying around in the morning Lol.. but i m glad that everything worked well . The VO did not see even one document this time ,but asked us lots of questions . I m just glad that Lord was with us and the visa was approved .

  8. It's possible that they decided that if you went through all of the effort to have a congressman get involved, you must be legit so they are ready to approve. I hope this works out quickly for you!!! :D

    Thanks a lot for all the active posts that everyone made and tried to to help us out .My old post is here http://www.visajourney.com/forums/topic/311947-k1-refused-at-new-delhi-thinking-of-cr1-dcf-now/ which refers to the K1 petition being denied .

    Well yes , the K1 was denied and sent back to the NVC from New Delhi , but that very day we wrote to senator and congressmen and a few more people and Miraculously today , Just by the grace of Lord Jesus , my Fiance got a call from the senators office saying that they got it reviewed by the supervisor VO officer and that they are going to recall the petition from the NVC and will do a re - interview for me . Ohhh .. we are so happy .

    We would appreciate if people can suggest us , in what all things we should submit this time .We submitted over 100 emails chats , tons of phone bills showing daily calls between us and text messages , skype screenshots and facebook screenshots ,still it was told to us that this is not sufficient .

    This time my fiancee will be with me during the interview and we do not want to take any chances .

    1)What are the possibilities of the Petition recall after the review by a supervisor VO officer?

    2) My fiancee is getting a lot of affidavits from her friends and family who know us and about our relation . How should i get an affidavit in India . Will the Notary from each person on a 100 Rs stamp paper do ?

    3) what all evidence should we take this time apart from what we took during the last interview ? Should we include much more of everything this time ?

    4)They say that the petition will be recalled from the NVC : so how much time should it take to get back to the New Delhi Embassy ?

    5)Our petition expires on the 16th June (next month )Should we send them a request for extending the petition or would it automatically happen because we are due for another interview ?My Fiancee has already sent them( VFS and New Delhi embassy) a mail Just now requesting them to extend the petition and not let it expire.

    Any help would be highly appreciated .

    Do you think that there could be a problem even when the embassy wrote in the letter to the Senator that we will schedulke another interview fro me when the petition reached New Delhi Embassy ?

    I would like to thank everyone for being so helpful for all the inputs .

    We have a new issue for which we are trying to get the answers , but nothing is getting clear , so here i m again .

    I had my K1 Interview on the 16th May and the Visa got denied because the VO did not think that we had a genuine Relationship . I received the passport back without the Visa stamp after 9 days (25th May ), and the petition sent back to NVC.

    My Fiancee had written to the Senator and there was a query sent to the New Delhi Embassy on the 26th May , now , on the 27th May, my fiancee got a call from the Senators office that they are recalling the petition back to the Embassy ,after the petition had been reviewed by a Supervisory Counselor Officer .

    We are just told to wait and that once they receive the Petition back there would be a Re interview done at the Embassy .We believe that it will take close to 45-60 days before the petition gets back.

    The issue is that the I129 F expires on the 16th of may and we wrote several emails to new Delhi Embassy , but no reply from them at all . We also wrote to VFS and just today after a week i received a reply saying

    "Dear Applicant,

    As per the U.S Embassy there is no provision of extending the expiry date. However, the consular officer has the discretion to re-validate fiancé petitions if they expire during processing."

    now this is a very generic statement that we all are aware about i guess .So i m completely confused as to ,if at all i will have a 2nd interview as stated in the letter to the senator by the New Delhi Embassy ,even after the Petition Expires? what should be our next step ?

    So I called the National Visa Center and they are sending our petition back to New Delhi for a 2nd interview..yay!! they said the petition should arrive there in 10 to 15 days. Has anyone been through this before?

    We are wondering:

    - Will the interview be scheduled and if so, will it take as long as the first interview to schedule? it took us 5 weeks to get the 1st interview.

    - does my fiance have to repay fees again and fill out packet 3 and 4 again?

    - Does he turn in the new documentation at VFS or bring with him to interview?

    An FYI, our petition was not re-affirmed by USCIS. I had faxed my senator a 5 page letter which they sent to Delhi Embassy on our behalf. We got a letter through the senator's office stating a senior consular official had reviewed our case and they were recalling our petition back from NVC (it had already been sent there) and they were granting us a second interview..yay!

  13. I just wanted to know if I could get a little assistance. My fiancee turned in her packet 3 last week and today I called the Department of State to see if the embassy had scheduled an interview, they said the interview has been scheduled for July 21, my question is what evidence will they be looking for at the interview, what should she take with her. Also I have emailed the embassy requesting that they also email packet 4 because the mail system in india sucks.

    Another thing I have found out recently through talking with other couples etc...you need to have met several times within the last year. If this hasn't happened then you will probably get the 221g slip or denial. Interracial couples who got approved had met several times within the last year. We only met 1 time for 2 weeks a year ago and the consular officer stated this in the denial letter. Other option if this is not possible is to state financial hardship but i would be afraid that this might affect your ability to show financial support.

  14. Update - On 7/7 our visa petition made it to NVC and was immediately sent back to New Delhi, but only because I had contacted NVC and they were completely unaware of the recall on our petititon. Very happy that NVC responds to emails quickly and quickly sent back the petition to

    On 7/20 my fiance received email from VFS stating that per Embassy he needed to turn in passport to VFC.

    ANY IDEAS ON WHAT THIS MEANS? why would they want passport if they kept it for so long the first time around? VFC people said they only deal with 2 categories - new cases where they are turning in docs for the interview or 221g cases. For 221g cases they said they either will be turning in docs or turning in passports. If they are turning in passports, VFC says visa stamp will be placed in passport.

    WHAT DO YOU GUYS THINK?? we are hoping for the visa stamp of course, but was told we were getting a 2nd interview previously by letter from the senator.

  15. hi everybody i went to doctore today becaus i could not eat like 2 day ago and that because they refusing my CR1 VISA i have some question and i wish to found the answers pelas

    1 is the fomre show that they refusing the visa or just they want more information

    2 if my wife call the senator do you all think that will help us

    3 do you think it good to cancel the application and have a new one or leave it like that till the uscis got my application and see what will happend

    4if my wife will send letter to uscis every week that will help or nop

    OUr visa petition was sent back to USCIS for review too. I am the american, so I called my senator, have your wife call the senator's local office in her town, not the office in Washington DC. THey will most likely ask her to do 2 things - fax a letter to their office describing your request - to have the senior consular officer review your file, to be told the reason for the denial as well. They will ask her to fill out a privacy release form. This will be found on the senator's website. she can do a search on his name to find his website. I went to fedex to fax my forms in.

    My fiance and i also wrote several USCIS offices, Embassy again, etc. Our emails were about 5 pages long and detailed our relationship. How we met, and how I have dated INdians before and how alot of Indians attend my church, etc. I got a call from the senator's office about a week later. The embassy amazingly agreed to give us a 2nd interview. THis is extremely rare, but I think it was my 5 page letter which did it. I quoted visa statistics and used examples of couples who were also denied at Delhi embassy. this happens alot at Delhi.

    I hate to say it, but more than likely they will still deny your petition, but should give you a definite reason for the denial.

    Also, you can use form G-639 - have your american wife fill this form out and request a copy of your file and ask specifically for the consular notes.

    I'd suggest seeing a lawyer too. Give them all the copies of everything you turned in and see if they can find what went wrong.

    THe petition is valid for 1 year, per that letter you posted, so I would not refile yet. I would wait for the process to continue.

  16. Yes I understand that, but still don't know how to find out why we were denied. How do we address it? Just refile with front-load information addressing all possible reasons for their denial? that was my last post I amde, all possible reasons I had.

    all my lawyer has said was "get married, there were no mistakes" on the first one and he doesn't know why we were denied either.

    You can fill out the G-639 form , Freedom of Information Act/Privacy Request and ask for your visa case file including the consular officer's notes. Form is found at uscis.gov

    You might have to pay a fee if the case file is too big.

    I read thru your comments on this topic and think you and me and my fiance were both denied for the same reason. Not enough time spent in person. When my fiance received the denial letter, it stated, the following "You also mentioned that you have only met the petitioner once for two weeks over a year ago"..Urghhh...In my letter to the senator, i stated that the requirements stated 1 time during 2 years..We regretted me not going to India another time.

  18. Thanks a lot Bec_Dipu , i was so confused about the affidavits as i have heard that we can also get it notorized from the US Embassy for $50 each . Well honestly that is a lot of money for 1 notarization. I m so glad i would be able to do it the way we do it normally for any legal use in India .

  19. The formal request you made is enough - after all, even on the example form here on VJ, it is not really a form, just a request letter!

    They usually grant the extension with no problem but because you had problems with the approval, never know if they will make an issue of it. Hope all will go well. You are doing all the right things! :innocent:

  20. Sorry you are having troubles, but sounds like the process is on track to be reconsidered this time.:yes:

    The only thing I know of to officially extend the validity of an application (though as you said, it is at the discretion of the consular officer to re-validate it, which usually happens) is to send in a formal request to the Consulate: please see the "Example Forms" on this site and under "K1 Visa Related Forms", click on the last one, "Request to Extend Approval of I-129F".     we did sent a formal request to the embassy as well ... It was not in a format of a form though . Do you think that would be an issue ?

    We thought that its ok to write them a letter requesting them to extend the petition formally .
