  1. The thing is, Mensajeria is basically something like UPS/Fedex; not sure that I would trust an errand like this to them. Not sure why would RENIEC have recommended that, but wouldn't get past whoever recommended that it was more a 'check with a mensajeria, maybe they can do it'.

    Chanchamayo and even San Ramon are not really that remote, I am originally from Peru actually, and been there many times.

    This time of the year is challenging as they are in rain season and can become isolated by a huayco.

    the Registro Municipal and RENIEC might want your novia be the one asking: as you might know, these kind of things are done 'in person' and the first thing they will want to see is her DNI; the use of power of attorneys is not so common and even if you have one, might not be accepted...That is why I was suggesting an attorney office...they would have more weight and carry a level of respect that will prompt people to do things, especially in provinces. Additionally, they would have other resources that might help to expedite things should a roadblock appears.

    Additionally, and maybe before contacting this people, Have you tried checking with the nearest consulate and see what they would say??

El Consulado Peruano en EU indica que las actas de matrimonio y divorcio son documentos públicos. El personal del Consulado Peruano indica que no puede obtener documentos y aunque hayan accedido en ayudar a abrir un diálogo con San Ramón no los vide muy motivados en hacerlo. Me gusta la sugerencia de un abogado, pero no conozco a nadien. Mas, el hecho clave es que nadien contesta el tel. en el Municipio de San Ramón. ¿Eso implica que un abogado de Lima al igual tendría que mandar a un mensajero para simplemente averiguar? Le voy a pedir a la embajada si me pueden recomendar un abogado.

  2. Just an idea: how about hiring an attorney office, say in Lima or Jauja/Huancayo (that is closer to Chanchamayo if I recall correctly) and they would make that happen. They will have conexions for the kind of search you need. It will cost you though, especially if you represent you are foreign.

    Best course of action would be if you or novia have a relative/friend in Peru; and make the arrangements thru them. If you do not, then be prepared to spend some $$$

    I would not hire just a mensajero.

    Chanchamayo is en la zona selvatica- very remote. The entire district of San Ramon is perhaps 27,000 people. RENIEC in Chanchamayo recommended a national mensajero service. However, I like the idea of an attorney's office. Unfortunately, my novia is part of the problem and I have no friends in Peru. Anyone have any other thoughts?

    I'm finding conflicting information on here and other sites about how to manage the medical/civil surgeon portion of the AOS process. My wife came in recently on a K-1 visa, she did the required medical exam in Lima, Peru two months ago and gave the sealed envelope containing the results to the embassy. She's never seen the results, but they were apparently acceptable, and she does have a copy of her vaccination history. I understand that she doesn't need to have another immigration exam, but she needs to do something to get her vaccinations validated. (Right?) A few threads here seem to say that, so long as she has a copy of the vaccination history, she doesn't even need to go to a civil surgeon at all, but most of what I've read suggests that she still must, even though all they'll do is put her history form in another envelope and seal it.

    Is a civil surgeon appointment necessary? Most of the offices I've called don't even know the process for K-1 visas and insist that my only option is to do another full exam, costing hundreds of dollars. Given that there are no civil surgeons within 90 minutes of where we live and I'll almost certainly have to take time off of work to do this, it is a huge inconvenience and expense even if they don't insist on subjecting my wife to an unnecessary second examination, compounded by the fact that they don't really seem to know what they're talking about, at least when it comes to K visas.

    My fiancée from Peru was examined in Peru, was given the sealed envelope containing DS-3025, but not given a copy of DS-3025. Upon arriving in the US on August 2012, the US Customs officers took the DS-3025 stating that it would be forwarded to a public health agency for review and no further follow up with the civil surgeon would be needed. That certainly added more confusion. The Customs officers did kindly make a photocopy of DS-3025 for us upon request. The suggestions here about going to a public health clinic to make sure all of the required vaccinations (including the annual flu vaccine) are complete seems sound.

    Do everything you can to keep from getting hosed economically. Ask the consulate in Lima for a copy of the DS-3025 and/or the physician in Lima who did the exam for a copy from your fiancée's archivo/file (you paid that physician enough money). Take a copy of section of the I-693 instructions stating that all you need is the vaccination section filled out in order to keep the US Civil Surgeon from hitting you with another exam fee!

    The 90 minute trek seems unreasonable, as does paying $250 for an I-601 waiver (if applicable). What do you think about making an infopass https://infopass.uscis.gov/info_lang.php?sel_lang=en appointment with the local USCIS office to speak to a supervisor about the lack of local civil surgeons?

    Make sure that you do not allow the 90 day period for requesting AOS lapse. Submit what you have in a timely way to preserve a filing date and at worst only get a RFE.

    As a matter of last resort, do you think that your local Senator or Congressperson could be helpful to you in getting resolution from USCIS such as appointing a local public health office as your civil surgeon? This latter point is reasonable as only the vaccination form needs to be completed. Stay strong.

  5. We got expedited thru nvc thank God. For those following my journey i just wanted to say that now is game on and hope for a expite on the waiver also. Geez soomuch still to do. Can anyone enlighten me on RIO requirements for docs?Should I schedule my medical even though i dont have an interview yet? We are being expedited so maybe interview will be march?

    Go to the Matthew Bender Immigration and Nationality Act practice guide at your local law library. It will be very helpful on particular issues and is easy to read.

  6. Man, it's been years, so my memory is really cloudy, but I do remember that my wife (then fiancee) and I ran around getting the following things:

    A copy of her birth certificate, which you have to get legalized by RENIEC

    A copy of her police files from the PNP

    Ancedentes Judiciales from the PJ

    Ancedentes Penales from the INPE

    The medical exam from one of the doctors on the list that will be given to him/her. She should run around getting all her vaccination documentation for this if you don't want to end up having him/her pay to get vaccinated for a bunch of things all over again, which I did.

    Again, I was doing this in 2009, so I may have forgotten something or times may have changed. Hunt around for information on the Lima Packet here.

    Medical process

    Beware of being pressured to buy the vaccinations from the panel physician- inflated prices! In various threads and posts here I have exposed the vaccination fraud in Lima- Melichón is a prime offender. I filed a complaint against her with consular officials. Most of the vaccinations on the list are available for free at MINSA or at a reduced costs at INS. MINSA sent me a list of their free vaccinations.

    The rush

    The consulate in Lima contacted my fiancée on October 22, 2011, telling her to bring all of those documents to a November 2, 2011 interview. What a panic! Get those documents ready in advance if you can. Too bad, you will not be able to attend the interview for moral support, to advocate, or to fill in the blanks for your fianc(e)e. I regret not having gone.

    The interview

    As of November 2011, 2 persons interview the K1 beneficiary separately. They asked "where did you meet, when did you meet, what is your fiance's name, where does your fiance live, how many times have you both been together in person, etc?" A consular official telephoned me in the US and asked me for documentary evidence like Western Union receipts, emails, cards, and anything substantiating a relationship. I had included those docs already with my 1-129F but it had been pushed to the back of the file. So, get those docs together as organized as possible and ask your fianc(e)e to make sure to make reference to those docs at the interview.

    The costs

    The visa issuance fee is $300 USD + $100 for the exam + those above gov't background docs + any vaccinations that are not free= $500+ USD Ouch! If you are unwary, the panel physician could scam you for $100+ USD for vaccinations available for free at MINSA.

  8. Didn't go to Dra. Melinchon, but Dr. Corigliano and no problems at all. I just showed him my child vaccine report, and he didn't put me any vaccine...

    I'm sorry this happen to you with Dra. but I guess this is happening, because the lack of control from the Embassy... the same thing happened with Dr. Situ a few years ago...

  9. Haz una busqueda aqui en VisaJourney y veras que muchos tienen problemas tambien en encontrar un cirujano civil en los EEUU quien entiende que no es necesario hacer otro examen tambien. O sea no solamente vas a enfrentar el problema de la transcripcion pero tambien eso.

    Por eso mucha gente (incluyendo K-1) solo acepta las vacunas con el cirujano civil en Lima porque elimina la necesidad de hacer las transcripciones de nuevo.

    Tiene razón. Cuando faltan vacunas el USCIS puede ordenar que la beneficiaria/o vaya por las vacunas en EU o que vaya con el Civil Surgeon a que confirme que se hicieron, aunque uno puede hacerse las vacunas en cualquier lugar según la guianza del CDC. Pero, el Civil Surgeon puede cobrar lo que quiera por llenar la forma- mas trinquete. Pero, le hubiera salido muy barata la cosa si se le hubiera permitido a mi novia conseguir sus vacunas en MINSA e INS.

  10. Tiene razón, pero USCIS requiere que vaya a un "civil surgeon," y no aceptan seguro, ni medicaid, solo cash! La cita misma cuesta $100-150 y no importa si ella había hecho las vacunas en el departamento de salud, tiene que hacer cita con el civil surgeon. Si hace las vacunas en Lima, no tiene que hacer nada cuando llegue aquí.

    Solo le digo para que no estes sorprendido. Es un costo adicional que muchos no esperan. Yo tenía suerte, como tuve una amiga que hizo el mismo proceso y me advirtió.

    Que bueno que me lo avisa. Tengo que investigar este tema mas a fondo ya que tenía la impresión que el civil surgeon de EU solo repasaba documentos y no cobraba. Uno puede vacunarse en cualquier lugar.

  11. I personally believe it's a tactic they use. Many people in Colombia say that either doctor accepted their vaccinations even if they got them as a child or even if they got them several weeks prior. However, there's also another group of people, my husband included, who were forced to get the "necessary" vaccines at their office and were not allowed to get them anywhere else, which is total bull #######. So, it is my own personal opinion that they do it at random to see who bites, and most do because they have no choice, it's either pay up or not get the visa.

    Exactly, Melichón refused to even produce the report unless my fiancée bought the vaccinations and told her she would be denied at the embassy if she did not buy; thus, Melichón portrayed herself as an adjudicator. The report must be produced and can indicate what if any vaccinations are needed and why. The Foreign Affairs Manual does not indicate that the physician may withold a report or act as an adjudicator, particularly since persons may request waivers for any vaccinations. A more subtle scam is the one you identified- trying to reject a recent a vaccination. If getting any vaccination prior to the visit with the doctorcito were improper according to a published regulation, a person's entire history of vaccinations would be invalid because the panel doctorcito did not sell them.

    However, folks should speak up with their embassy and Senate/Congressperson. In our case, had Melichón stated from the outset in October 2011, that she would not produce the report (I-693) without buying vaccinations, I would have reported her to the embassy back in October. But, Melichón delayed for months until my fiancée demanded the report, letting Melichón know that the absolute deadline had arrived and the extortion would be complete. That's why the next step is to escalate the matter at the embassy and Peruvian medical board.

    However; my wife's experience with Dra. Melinchon was uneventful. She paid the regular exam fee, and then recieved 4 vaccinations that were necessary. Out of the 14 or 15 required immunizations...the wife recieved four.

    She did not get the "chicken-pox" vaccine, or several others because either she had it as a child, or they were age inappropriate... and the Dra. did not pressure her. Several members have gone to this Dra. without incident; however, I believe the sincerity of your post, but perhaps she has changed her ways...or was new to the system of being an embassy doctor.

    In the past, Dr. Situ was considered a criminal doctor charging excessive fees.

    Se podrían percivir como excusas para una estafadora. ¿Les dijo Melichón que no estaban obligados a comprar ninguna vacuna con ella? 9 FAM 40.11 no indica ninguna obligación de comprar las vacunas de ese médico de la lista, se necesiten o no. Peor aún, MINSA (El Dept. de Salubridad del Perú) confirmó que las vacunas son gratuitas. En EU en mi comunidad, el Public Health Dept. al igual da las vacuna gratis. Melichón está comprometida porque me escribió alegando que las vacunas son obligatorias pero se quedó callada cuando la confronté con la ley explícita.

    Es sorprendente que los médicos como Melichón "se confunden en cuanto a los requisitos" cuando los beneficia económicamente y se perjudica su co-nacional y el ciudadano EU. Noten que Melichón no se comunicó con la embajada para informarse, aún después de ser confrontada.

Worse yet, MINSA (the national public health dept in Peru) confirmed that vaccinations are free. In my community in the US, the Public Health Dept. offers free vaccinations. Melichón is on the hook as she wrote to me claiming that the vaccinations are obligatory but remained silent when I confronted her with the express law.

    It is remarkable that panel physicians like Melichón are invariably "confused as to the requirements" to their pecuniary benefit to the detriment of their co- national and US Citizen. Notably, Melichón did not contact the embassy to get informed, even after being confronted.

  13. Estimados colegas. Tengan cuidado con los médicos en Lima. En el 22 de octubre mi novia fue con la Dra. Viviana Melichón para el examen. Melichón presionó a mi novia a ponerse vacunas que mi novia ya había recibido de niña. Mi novia se reusó, pero pagó por el examen (s.300). Melichón se molestó y demoró producir el reporte hasta hoy- 3 meses. Cuando regresó mi novia la semana pasada, Melichón se reusó a producir el reporte si mi novia no accedía a las 3 vacunas (s. 310). Denuncié a Melichón con la embajada.

    Indudablemente no hay ningún requisito de comprar vacunas con los doctores de la lista. Tiene uno el derecho de elegir donde hacerse el tratamiento y por el precio que uno quiera sea con el seguro SIS y el Dpto. de salud nacional MINSA o en un Public Health Dept. de EU. En mi Public Health Dept. en EU las vacunas son de costo reducido y gratuito según el ingreso. Tengan mucho cuidado y denuncien estas prácticas fraudulentas y extorsionistas.

    Pero le diré una cosa... si su novia no tenía sus carnets de vacunación, la Dra. tiene que recomendar estas vacunas, es su responsabilidad. Por eso, le dije a mi esposo que fuera a la clinica local para sacar copia de sus carnets y para ponerse cualquier vacuna que no había hecho de niño. De todos modos, si ella no se pone las vacunas en Lima, cuando llegue a los EEUU, va a tener que ir a un "civil surgeon" y eso le saldrá mucho MUCHO más caro que s./310. La cita misma cuesta al menos $100-$150.

    De todos modos, esa Dra. no debía haberle negado el reporte... que bueno que ud. se haya quejado a la embajada. Ojalá cambien de Dr.

    Amigos, tienen razón en muchas localidades en EU pueden ser caras la vacunas. Pero, en algunos departamentos de salubridad local de EU como donde yo vivo, el cobro es según el ingreso y gratis para personas de ingresos menores. También en Lima con el seguro médico SIS y en el departamento de salubridad MINSA las vacunas son de costo reducido para los adultos.

  15. You need to check with the US embassy or with the doctor doing the medical exam to see if you need to get them before your interview. In Colombia for example, they will not give you a visa unless you get the required vaccines which are MMR, TD and varicella (if you haven't had it).

    By the way, a K1 visa is considered an Immigrant visa, it's even listed at the very bottom of the Immigrant Visa section of the US Embassy in Brazil: http://brazil.usembassy.gov/application-requirements.html

    Also, when you click on Appointment Package you can select Forms for Fiancé(e) Visas (K1 visa category) and then click on the PDF document: Instructions for Fiancée Applicants . At the bottom of page 6 of this document you can read the following:

There is no requirement for the vaccinations prior to entry into the US (only upon adjustment of status), much less to buy the vaccinations from any panel physician. Other reported tactics by physicians in Lima are to pressure fiance(e)s to get HPV and other uneccessary vaccinations. Beware folks.

  16. En el 2008, mi esposo fue donde la Dra. Nora Lari (veo que esa doctora ya no está en la lista). No tuvo ningún problema, pero le di una lista de las vacunas necesarias mucho antes de la entrevista, y fue a la clinica local para que le dieran ahi en vez de pagar no sé cuanto en la Clinica Angloamericana. Fue con su certificado de vacunación al exámen médico y ahi solo le recomendaron 1 vacuna y nos ahorró bastante plata. :star:

    Peor, las vacunas que le obligaron a mi novia eran las que ya había recibido de niña- dipteria, sarampion, rubela, varicela, etc. Yo me quejé con la Embajada. Tengan cuidado.

  17. My wife had her medical exam today with Dra. Viviana. Of course the exam itself was 300 soles. The Dra. recommended her to get four vaccinations that cost 280 soles. In total, every thing cost 580 soles/ 216 dollars. (2.68 soles/ 1 dollar). She obtained the 4 vaccines that were recommended to you. She must return in two weeks to get her results.

    My fiancee went to Dra. Viviana Melichon, who from the outset pressured her to purchase vaccinations from her [Melichon] (3 vaccinations for S. 310). My fiancee paid for the exam, but refused the vaccinations. Our choice was to have the vaccinations done at the local Public Health Department in California, where they are low cost and even free based on the ability to pay. However, Melichon was unhappy with the refusal and delayed producing the report for over a month. Upon my fiancee's return to Melichon's office for the report, the staff refused to give her the report unless she bought the vaccinations, claiming a requirement. My fiancee caved in.     Other doctors in Lima have been removed from the approved list for vaccination abuse. Be careful folks.

  18. The likelihood of an average person adjusting status based on an immediate relative petition and getting a fee waiver is close to nil. They don't forward all otherwise unapprovable fee waiver requests to the Deputy Director. Even getting the Deputy Director to become aware of your case would require extraordinary visibility.

    USCIS standardized their fee waiver policy with the introduction of the I-912 form last year. I've never heard of them deviating from that policy since then. There's no harm in trying, except that it will almost certainly be denied and you'll have wasted your time.

    Hoy fue mi examen medico con el doctor Corigliano, muy profesional, todo perfecto.

    Lo que les puedo decir es que para evitar esos inconvenientes de las fechas cercanas se debe hacer seguimiento al caso y llamar a la embajada aproximadamente una semana despues de que haya recibido el paquete para que se pueda saber la fecha de la entrevista y preparar todo :)

    Las tácticas de la embajada en Lima han cambiado. Ahora otros y nosotros encontramos que le dan a uno 8 días de aviso para juntar todo antes de la etrevista. A otra pareja le hicieron lo mismo y lo reportaron en este foro. Por ejemplo, mi novia recibió el aviso en el 22 de octubre para una cita del 2 de noviembre. ¡Qué crisis nos causó! La pobrecita de mi novia.

    No hay ninguna ley que le prohiba a uno recibir las vacunas con el departamento de salubridad por el mismo precio que pagan los residentes de la nación. Tengan cuidado con el fraude de la vacuna.

    While I-485 is not one of the forms subject to automatic waiver upon the applicant meeting the criteria under 8 CFR §103.7(b), its fees are subject to discretionary waiver by the Director or Sub- Director. 8 CFR 103.7 (d). Subsection (d) provides in pertinent part:

    (d) Exceptions and exemptions. The Director of USCIS may approve…exemptions
    from any fee
    required by
    paragraph (b)(1)(i)
    of this section or provide that the fee may be waived for a case or specific class of cases that is not otherwise provided in this section, if the Director determines that such action would be in the public interest and the action is consistent with other applicable law. This discretionary authority will
    not be delegated to any official other than the USCIS Deputy Director
    .

    Cases online indicate that persons with exceptional circumstances have been granted waiver of the fee for I-485. While it may be tempting for some to react by saying that there is some sort of contradiction between the public charge requirement and the fee waiver, that is mistaken. Fee waiver requests are handled separately from the I-134 determination. A person making the minimum amount at the I-485 stage, 125% of the poverty line, may exhibit factors warranting waiver such as a) receiving a need based benefit, b) recent bankruptcy, c) non-recurring major expenses, d) medical expenses, e) disability, etc.

    Processing time for the fee waiver request may be an issue. If the fee waiver request is submitted at the same time as the I-485, rejection of the fee waiver may mean that the I-485 will be returned to you for re-filing possibly taking you out of the period for filing for adjustment of status. Perhaps, making the request well in advance of the I-485 deadline may be appropriate.

  21. Dra. Viviana Melinchon precisamente se encuentra en la lista de cirujanos civiles aprobados por la embajada (referencia aqui http://www.visajourney.com/consulates/index.php?ctry=Peru&cty=Lima y en la carta del paquete de entrevista de tu novia).

    No deberias estar desmoralizado. La embajada te ha dado la primera entrevista disponible - que bien que no tengan que esperar mas tiempo para reunirse. El doctor Corigliano sugirio una solucion para tu novia apurada - que simpatico de su parte. La doctora Melinchon les ha dado su tiempo sin cita - que suerte. Y la Dra. le dio sus vacunas requeridas - que bien que no le van a negar por eso, que bien que no va a tener que hacer esas vacunas en los EEUU que podrian costar mucho mas (ademas la embajada prefiere que reciba esas vacunas con los cirujanos civiles -- si ves sus intrucciones para el examen medico, le avisen que no deberia hacer esas vacunas en otra parte).

    Vi que tu paquete no llego para su entrevista. Lo siento mucho. Eso es muy comun para los del Peru. Sabes que Serpost no funciona.

    Bastantes personas se han quejado en este foro acerca de entrevistas precipitadas que no le permiten que las personas vayan preparadas. La lista de medicos que incluyo ud. esta obsoleta. Adjunta viene la actual donde no aparece Melichon. Mi novia hizo cita y la doctorcita se presto para venderle 3 vacunas por cienes de dolares. Afortunadamente ya le habia instruido a mi novia que no aceptara el trinquete de las vacunas de esos medicos, que al igual es una practica abusiva. Nadien esta obligado a comprar las vacunas con los medicos de esa lista oficial. Pero, los medicos se aprovechan de la ocasion.

    El aviso de las instrucciones indican que uno no vaya a recibir las vacunas (en caulquier lado) sin "recibir las pautas" del medico de la lista. Las instrucciones no dicen que la persona esta obligada a comprarlas con los medicos de la lista. Ni tampoco indica que las vacunas de la salubridad publica, despues de la pauta, son inaceptables.

    Hay bastantes quejas por parte de los Americanos en este foro sobre esa practica de presion por los doctorcitos a las parejas a que compren vacunas por precios elevados. Como dicen los vendedores ambulantes en la Capital de Mexico en cuanto al precio de sus productos, "segun el tamaño del sapo, es la pedrada."

  22. La semana ante pasada mi novia fue bastante apurada a la clinica americana en Lima donde los 2 doctores de la lista oficial de la embajada tienen sus oficinas. Mi novia iba apurada porque recibio el 24 de octubre el aviso de la cita de la entrevista K1 del 2 de noviembre. Cuando llego a la clinica le dijo el doctor Corigliano que el no la podia atender y que fuera con Vivian Melichon Espinoza. Cual sera su sorpresa que la Dra. Melichon intento venderle vacunas por cienes de $, sin darle a saber que las puede obtener con la salubridad publica y con el seguro nacional.

    Me horrorice cuando mi novia me dijo lo que la paso. Ni siquiera se si al embajada apruebe el examen de la Dra. dado el hecho de que no esta en la lista. Me siento bastante desmoralizado con lo manera en que la embajada esta manejando los casos hoy en dia- con citas sin aviso suficiente.
